The FCC (Federal Communications Commission) of the United States has allegedly requested that a repeater club shut-down a large GMRS repeater network that was linked via the internet for allegedly violating FCC Part 95 Rule 95.1733 and FCC rule Part 95.333.
In this video go over the letter that was sent to all the members of the GMRS club that owns the repeater and explain the two rules that the club was allegedly violating by connecting GMRS repeaters over the internet. Many people have alleged, and feel that this overreach of the Federal Government (the FCC) may violate not only the First Amendment of the Constitution of the United States, but it may also violate the 4th Amendment as well.

As a licensed amateur radio and GMRS operator, I can confirm the FCC does communicate via email. I was contacted directly by: “Laura L. Smith, Esq. | Special Counsel | Spectrum Enforcement Division | Enforcement Bureau | Federal Communications Commission | 1270 Fairfield Road, Gettysburg, PA 17325” in February of 2021 regarding a frivolous claim of interference. After a very thorough explanation from me, her response back to me was “I consider this matter closed”. Anyone who doesn’t believe they will contact you like this, just FA&FO.

I've never heard of the FCC "emailing" a notice or warning -- I've only heard of snail-mail via USPS on official FCC letterhead. I makes me wonder if someone may be pranking/trolling/scamming the operators of that GMRS system.

Reading between the lines tells us that 1. this is a phishing scam, or 2. someone heard something they didn't like over this network (Likely something contrary to the current political narrative.) and reported it to the FCC, who like most other 3-letter agencies are doing right now, is absolutely "not creating a watch list" extra-judiciously and off the books.

Without a repeater all we have is an expensive walkie talkie. Without linked repeaters we have a community rag chew that we could have put on the local Next Door app. I'm suspecting a mad ham complained to the FCC in an effort to shut down the GMRS in an effort to get more people to get a ham license...

A sad ham was involved and felt left out..otherwise no one else would care. That being said, I am keeping my small repeater up and linked using a no phone internet connection (within the rules) as long as I can hear on CB channel 6 "back to the bench" for hours every day.

If it were me... First off I would make sure my repeater/network was in compliance with the FCC rules. If I found anything that was not, I would correct that. Then I would take some effort to verify the validity of the email, and if it in fact came from the FCC (at least a possibility), I would politely reply indicating I have checked my repeater/system, it is compliant with FCC rules, and inquire if anything further is required. I would not supply any list of system users - as others have noted I'm not certain there is any requirement for me to maintain such a list. If there is, then I would require a properly authorized and documented request before providing whatever (if any) information was available. But don't just tell them to stuff it, as (if it is a legitimate email) that has the potential to turn out ugly for you. If they are requesting a membership list for some type of legitimate business entity (non profit repeater group for example), then you need to need to get a lawyer who knows what the requirements are, and how to properly comply with them. Proceed smartly (intelligently), not emotionally.

Now that Chevron has been shot down by the Supremes I wonder how this will playout. The FCC cannot make up the rules as they go anymore. I can see GMRS becoming the new citizen band radio. Remember, they use to have CB licenses in the past, I feel this will be the same thing eventually.

A Kinder, Gentler FCC? After looking over the GRMS rules, interconnected GMRS repeaters ARE a non-local No-No (unlike Amateur (Ham) Radio Service). It would have been considerate if the legal "repeater(s) owner(s)" had left them up while turning off the illegal inter-repeater links. Perhaps the Kinder, Gentler FCC wanted to remind the inconvenienced GMRS licensees via email to read the rules of their license before taking official legal actions that may end with $$ 5+ figure fines (or worse)? I would think that asking the repeater(s) owner(s) to pass on such a message would have been sufficient without requesting logged or taped user's callsigns.

The FCC may not currently be using emails but the US court system does use emails or more accurately, electronic filings. At issue is that there was nothing listed on the FCC site.

Depends how far north in western ny and what repeater channel. There is a line somewhere near there you can’t use certain frequencies.

Has to be someone trolling them. I can't believe that the FCC would send an email like that. If they did, as you said, not legal. I would ignore it until they were ready to do some good old fashioned enforcing. I mean, look at some of these CB guys that were "busted" by the FCC. Running thousands of watts, cursing, threatening, and interfering always pretty much got away with it. Fines were proposed and then never paid.

By getting the privilge of a license, as others have stated, you consent to Commission searches. A broadcast station just got dinged for $25,000 for not letting enforcement personnel in, among other things.

I wonder if the FCC would respond to an email asking for more details about the use or misuse that got them in trouble. That second violation is probably key here, and this is probably what lead to the initial investigation, which uncovered the wireline interconnect. The problem they had is that the FCC office is in Buffalo NY, or not very far to travel.

A request does not violate the 4th amendment. If it was a "demand" with an associated threat, that would be a violation. As an example, the police can ask to see what's in the trunk if your car during a traffic stop, but you are allowed to say no unless they have a warrant.

This has actually worked for me in the past. I actually got a phone call from a guy saying he was from the FBI conducting an investigation. I asked for his info and office location. I then verified the info he provided after getting off the phone and called the office main line which I got from a separate source. Turns out it was legit 😅 All this to say he totally understood and it wasn’t a big deal

Its bigger than just the club. The entire area (585) Has gone virtually silent with only one working repeater that has been axed, in terms of coverage. Very strange! Another repeater, run by a very solid guy and veteran was shut down without fair warning. There’s a shit ton more to this story. Proud member of said club.

In my 45 years of dealing with the FCC and working in radio communications I have never seen the FCC send any type of violation notice by email. They do this by letter or by an actual knock on the door.

Not necessarily since they're also not sending the call signs out via mail anymore and so many people not giving correct mailing addresses and they got the repeaters owner by their call signs so it's easy to get them by their email address which they definitely want to keep up.

or in person if it were serious. They may even bring local law enforcement with warrants for backup. Again, if it were that serious. But yes, mail is the usual. (I would presume) Mail is relatively cheap and 99.9999% of the time is enough for compliance.

Bingo. Either the FCC agent didn't know the rules, or it wasn't from the FCC. Federal agencies are ONLY allowed to send notices like this either in person, or through the USPS. This is both so that people know when they're being scammed, and to establish an evidentiary paper trail.

@@CyborgAlienBariaur The FCC stopped issuing paper license because of the cost of paper and printing. They figured to let the licensee bear the cost of printing out a hard copy. However, the FCC is not going to send an email of a notice of violation. They will send it through U.S. mail. I am both a licensed Amateur Radio operator and I hold a GMRS license. If I need copies I jusy log into my FCC account and download the PDF, then print it. This thing has "HOAX" written all over it.

How do the know it ws the FCC? Is it the official email address or is it a Spoofed email? I can't count the number of times I get fake emails. Fake text messages claiming they are someone they are not. My first thought is to simply contact the FCC and ask if this is legitimate. If it is not then the person pretending they are in much more trouble than you all are!! Posing as a government official is a much bigger deal than the issues listed. My initial thought is someone wanted to shut it down as they weren't happy with somthing and saw this as a way to get back. IMHO

As a Licensed HRS Operator General class the FCC is quite good at documenting things and making it available on their official website. The fact it isn't documentos has the odor of the email being fake. I have never known them to send emails on violations only letters. I have never gotten any but I know of others who have. I Also have known of CB'ers running illegal linear amps that have gotten a knock on the door by an agent from the FCC and handed in person a citation of violation. You can't hide their tracking equipment is state of the art these days much better than the simple direction finding loops they used to use, they will find you if they choose to

Let me frantically type: I don't know that they needed to shut down the entire repeater, just the linking part. As for the REQUEST for call signs, it was just that, a request. They can request anything they want. I would decline to produce a list unless there is a court order. One could theoretically deny the existence of such a list, but would also be cautious about destroying evidence or lying about not having a membership list...that would probably be more contemptuous than the actual linked system. And it is not lost on me that if the club sent out an email to members...there is clearly a list of members. That said, I am a member of several clubs that I have never transmitted on their system. There have been 'some people' that have said and speculated that an internet linked GMRS repeater system is a no-no, and I guess maybe now we know-know? It will be interesting to see what becomes of this. I am also curious as to what other actions have been handled by an informal email and never made it to the formal complaint stage. Kinds like when the cop stops you to give a warning. It ends at that unless you get mouthy and defensive, then they write you a ticket and start measuring tire tread and mudflap length.

A d!ckhead at the DOT stopped my Dad one time because one of the trailer lights was out. My Dad flicked it with his finger and it came back on. Officer Head wasn’t happy about that, so he had him pull forward very slowly so he could check the tread depth around the entire circumference of ALL the tires lol

It could be that the FCC is finally stepping into the current century and sending out informal emails to legitimate honest GMRS users who may be in violation of the rules just by misunderstanding. It would save a lot of time and cost over a formal Notice of Apparent Liability.

That is what I am thinking. If there are multiple linked repeaters in that network, some poor soul, sick to death of hearing the same conversation in progress on most or all of the eight repeater pairs, may have done this just to enjoy some blessed relief and silence from the linked idiocy.

The "big deal" is that a GMRS repeater cannot have a phone patch connection, but CAN BE linked together for voice traffic. That FCC letter is largely harassment, and should be refuted by using 95.349 which is the "phone patch" rule, and also 95.1745 which states that GMRS repeaters can be connected for "remote control". That agent, no other knowledge withstanding, is FOS !!!

Yeah but in typical goobermint fashion the FCC just changed the wording on the website. There's no good reason why repeaters can't be linked via internet since it's not interfering with anything (I imagine even at peak usage times it can't be using THAT much bandwidth for simple voice transmissions). It all boils down to "Stop having fun" and "because we say so." The FCC can go suck it.

i have a couple of 8 watt Baofengs (BF-F8HP)..i have not gone on repeaters..i just fig'd about the time we'd truly need them..they'd be down, anyway & anyone i would have been networking with would be unreachable prior to such event we'd want to warn each other about. anyways..we are seeing a war vs our food, our grid, our transportation and now our comms. not to mensh the open border/invasion and draining of the US Treasury. & censorship. Oh, my. An email from the FCC? PLEASE! Someone got pissed off and sent an email, claiming to be the FCC. Like, no one has ever received an email from someone claiming to be a legitimate entity. This is all nonsense. Until the repeater operators receive an official letter, through the USPS, I wouldn't turn off a darn thing.

As I understand the FCC guidelines a LOI (letter of inquiry) would be MAILED as a persons first notice of an alleged infraction. Nowhere does it mention e-mail. And does this club own ALL the "interconnected" repeaters or are they individual repeaters owned by others included in their "network" as a courtesy to the community?

An official letter might come with a fine/NAL for breaking the FCC rules. If I thought the email was a scam then I might reply and ask to talk by telephone to verify just who the FCC agent is.

Email is not official communication, unless you are a nigerian prince. Whoever received it should add it to his junk folder & wait for a certified letter to show up in the mail, then take that letter to an attorney. This sounds like a phishing scam.

I don't see a problem with anything the FCC did. I personally avoid networked GMRS systems because they violate Part 95, but I never cared if anyone else used them. That said, those users took a risk and faced the consequences of it. This isn't a 4A issue at all.

This is why I keep a bucket of sand at the enterances to my properties. If interaction from an agent of the govt seeks information without the hastle of obtaining a warrant, I point to the bucket and tell them to pound sand. So far, so good. Im out three buckets and 28 lbs of sand

FCCs drinking coffee at desk, thinks I bet the easiest way to handle this complaint is to send an email because it isn't important enough for me to do any more work. Send. Now I can go back to sipping coffee and doing important FCCs work. My guess is they probably have a complaint about "Joe" or "Squirrel" transmitting music or profanity or something and they also want to send one more email telling Joe Squirrel to knock it off. Then sip coffee and do important FCCs work.

If true I do not like that they asked for call signs, they would need a warrant to obtain them. However I am in NY and there are a few connected repeater systems. They have taken over every frequency, it is a pain in the butt and annoying. A lot of users on hand helds have issues getting over the other repeaters.

They don't need a warrant. Anyone who operates any kind of radio repeater or system is responsible for the users of that system, including what they do or say and making note of their call signs, if applicable. There is no privacy involved. The licenses are issued to people and those people have their name and address on the license applications. Anyone listening with a pad and paper could write it all down or record the radio traffic. There's nothing in any of this that requires a warrant to obtain.

Well, let’s see, every time I key out, I give my call sign…. And every 15 minutes thereafter. Most of us filled out that application with our address… SO, they ALREADY have our info…. My guess would be some sort of a tribal territory dispute… OR somehow it has taken a political stance of left or right.

¿Why not just make the repeater a standalone repeater? No Internet or interconnect. that way the community still has communications. Second I would not act on an email, period. I need a formal letter.

Although the fcc keeps a current email address on file for every frn, I have my doubts that they actually used email for making contact for enforcement. My email is on file with the FSA and NRCS (and fcc of course) and have never received an email from either agency. Communication is always through the USPS.

I watched this FCC meeting. It is pretty clear that it is against the rules to communicate using a GMRS repeater or radio connected to the internet.
