Hello,
I am Justin Paperny, with White Collar Advice, and Prison Professors.
In this video, Michael Santos interviews Federal Judge Stephen Bough. Judge Bough and Michael discuss, amongst other items:
What steps can a defendant take to make a favorable impact at sentencing?
What type of weight does Judge Bough put on a defense attorney's statement?
How frequently does Judge Bough see defendants invest the time and energy to communicate remorse?
Does a restitution payment before sentencing influence Judge Bough?
What influence do character reference letters have at sentencing?
And more, much more!
If you would like help on your narrative simply text the word NARRATIVE to 44222 to grab our free sentencing mitigation report. You can also visit www.whitecollaradvice.com/get-...

Thanks for the video Justin. This is valuable information from another stakeholder. Congratulations to you and Michael and Shon on your new partnership! I don't know where I would be if I hadn't found you to help me prepare for my sentencing.

I was accused of a crime I did not commit going on 2 years now. I hired a lawyer and was looking at 20 years. The judge, DA and public pretenders are all friends...I refused a plea so many times and won the case! The judge was pissed...🤣

First take responsibility for your actions. Second take responsibility for the impact your actions had on your victims. Third do not whine about how hard prison is going to be on you no one cares. Lastly apologize to the court your family and your victims for letting everyone who looked up to you down. This is a time to be humble not defiant.

What if your action had no victims ? Im going to deeply apologize for what I did that started my mess , but the after affect is just police seeking a charge when I caused 0 dollars in damage , no extra work , except for the detectives who prosecuted me

Mostly intuitive stuff but still valuable. The video did confirm one suspicion. At a certain point, I stopped asking for letters of recommendation because I had a feeling that too many would water down the overall effect.

In initial part of video, you talk too much about stuff not of interest to those of us watching, we want to get to the meat of the video. Other than that, this video was awesome!!! So informative!!! Truly appreciated & needed, Thank You!!!

I'm.confusednin that in your statement is it ok to talk about your past , like my situation is I believe a misunderstanding arose out of attempts to better my life. I was trying to clean up graffitti on my street , and during the process I had been looking into a locksmith job, I picked a lock on a utility box I've lived next to 27 years. I genuinely am sorry for picking it. However a utility worker showed up and said nothing was wrong with the box , we talked for an hour about fishing and was givin a mdop of utiity property when I did 0 dollars in damage and caused 0 problems with the utility. I should have gone to trial but my lawyer kinda sucked I get sentanced today and can own up to what I did do but i truly feel I didn't do anything to hurt anyje, except myself

Yes, we do. It’s an important asset to share with any sentencing judge. Please send a text to 818-424-2220. I’ll have a colleague reach out. Best, Justin

How does a defendant communicate remorse when they aren’t guilty but took a plead deal? No contest

This is interesting. However, I am listening from the perspective of someone who was arrested, charged, and convicted for a crime that never even occurred. It was difficult for me to lose all respect for law enforcement and the judicial system after experiencing this. It was NO accident that this occurred. It was collusion.

Does it not matter what you do in a mandatory mininmum situation
@WhiteCollarAdviceOfficial
@WhiteCollarAdviceOfficial 3 жыл бұрын
Of course it matters. Some defendants foolishly presume they will automatically get the mandatory minimum. Why, I have no idea. A defendant should work to prove worthy of the shortest sentence. Period!!

Thanks . So besides a 5k1 or rule 31 . Deres is still a possibility to get under the mandatory mininmum?

So what about all those victimless crimes that are now 80% of prison population, how are they supposed to show a judge they are sorry when their crime didnt affect anyone else why do they have to be sorry in the first place then? And who give this guy the right to "be mad" that a another person just because they choice to use drugs in the first place it's not their business!
@Aboutaprincess
@Aboutaprincess 4 жыл бұрын
There really is no such thing as a victimless crime, somewhere along the way someone was negatively affected "even if just as a taxpayer". Be an adult, take responsibility and do your best to move forward with whatever the outcome is. At the end of the day, you're responsible for your own actions; not the judge, police or anyone else, you.
