Thank you so much. I recently had to go to court over this bullshit and spend over 3k on a lawyer. I was playing basketball with a friend after work (we both work at night) so we were playing at about midnight. A cop rolled up and I just expected him to just ask us what we were doing but he decided to tell me my car smelled like weed so he tossed it. I keep a to go sample size cup of adobo in my car because it's delicious on most food. He told me it was controlled substance. I told him it was adobo but he wasn't having it. It tested false positive for cocaine. I got a fucking FELONY charge for seasoning. I lost my long gun license as well as drivers license because I was a "high risk". My lawyer had an unbiased chef come in to court to smell the seasoning before my charges were dropped. I had to take a semester off college to afford the lawyer fees. I missed out on a good job opportunity because I couldn't pass the background check. It's okay now and I'm enrolled in school for the spring but I got my life fucked for a solid 4 months. (Also a sidenote nicotine can send a false positive on a breathalyzer test.)

But if you go to the sources that Charlie named in this video, get a lawyer, and get as much evidence as you can to defend yourself, then you'll probably be ok. But it's really up the the judge and the City if they want to send you to jail.

I met a cop who hates having to use a false positives test for drugs. I was on the street driving home from the local Pharmacy to pick up my anxiety medication. A cop pulled me over under the probable cause that I had drugs. I showed him my ID and the bottle of my meds and he wouldn't do the test because he knew the result would come out positive for PCP or something like that. He even told me directly and told me all about what you just described. He sent me on my merry way after that and apologized for the inconvenience.

The USA's judicial system is so dysfunctional that sometimes the actual prison sentence you will receive is shorter than the time you are in custody waiting for your trial. That's why some people decide to plead guilt and serve their sentence instead of waiting for a fair litigation.

Lol 95% of cases plead guilty because to say that you're innocent means that you're saying you didnt commit the crime when most of the time theres proof that they did. Inb4 reply to an old comment, I know. But they're actually not admissible in court, but are considered probable cause for arrest. There are stricter rules on admissibility in court than there are for warrants and arrests. In the 1970s-80s, forensic chemistry was basically meaningless, but modern science uses actual proven instrumentation (GC/MS, GC/GC/MS, LC/MS are common) which has significantly less false positives or false negatives. The main issue comes in with plea deals, because a lot of people don't know that the field tests are supposed to be inadmissible in court or expect that if the field test came out positive, the more rigorous approaches might also come out positive too. So even if it doesn't end up in court, there's still huge issues with it. Plus, there's plenty of developing techniques which can be used on site with more accuracy, such as electrochemistry techniques (what I did undergraduate research in) and Raman spectroscopy. The issue there is even if you use a more accurate method, you then have to train police officers who have little to no background in science to correctly interpret results. Source: I have a bachelor's in applied chem forensics; if you have a good background in chemistry and you want a forensic chem textbook I recommend Suzanne Bell's Forensic Chemistry, 2nd ed.

@@tjc7773 and the officers 99.9% of the time take what is found and used in the test and put in the evidence locker in case it goes to trial and then it's sent off to a more accurate lab nine times out of 10 they're not going and taking their Tylenol PM bottle out and testing the Tylenol PM just to put them in jail for a night. Yeah the field test probably do suck and are probably wildly inaccurate but it's highly unlikely that cops are going and taking a batch of brownies from the bakery scraping the sugar off and getting a false positive just to f*** with somebody so they can look like a f****** moron in court

my boyfriend at the time was driving my car and we had a guy in the backseat that i barely knew but he was friends with. he made a turn at a five point intersection. a cop pulls us over saying the blinker hadn't been on. he IDs all of us. guy in backseat has a warrant. takes him. my bf had bud on him so they take him too. they wanna search the vehicle. i forget why but i didn't want that shit so they bring a dog out to sniff the car and it apparently acts like there is something in the car. so they tow my car away and leave me on the side of the road and it wouldn't have sucked so bad but there was a hurricane coming and it started to pour rain. i walked to the mall and theres sand bags at the entrances its closes. long story short they finally let my bf out and i had to get my car back and it cost me hundreds of dollars and they never found anything in the car. it was a bunch of bs.

Public outcry is too focused on police shootings and protests for something like this to "catch on". That being said, I really hope that this issue does get dealt with eventually, and that's coming from someone who doesn't even drink alcohol, let alone anything else. Some of them should, but the punishments for it in the US should at the very least be lowered significantly. The "war on drugs" is mostly just there to pad the prison population to make more money, and the system tries to make sure that people who end up there once will come back there again.

Well put sir, very articulate and clear. I studied criminal justice and really lost the desire to work in the field when I learned about crap like this. A friend of mine went to jail for a drug charge and on top of prison time, she ended up paying well over $2,500 in court and other legal fees. Nothing is paid for in prison, phone calls, toilet paper and basic needs aren't giving to you despite being forced to serve jail time. You have to pay for basic things. IMO, all drugs should be decriminalized and possible legalized. Portugal did this and found that while Pot use went up, hard drug use, such a heroine and cocaine went down because instead of feeding money to the prison system, treatment centers received the money and as a result, addicts got the help they needed. I also feel your right not to blame the police officers, they are fooled just as we are by the higher ups, who know that the test is bullshit.

They shouldn't be necessarily legal, not things like heroine or meth. Marijuana, okay. But the punishment for being caught with them should definitely be fixed. Our whole system is so jacked and we have people serving 6 years for getting caught with an ounce and rapists only having to serve 3 months.

Watch enough videos where the dog doesn't react to an open window but to a closed door when close to an officer's hand is close to it and it starts to appear something is up. I wouldn't be surprised if officers unconsciously train dogs to react to people they are suspicious of or the dog develops a habit of getting false positives just to get attention.

+Crafting Creepers it is known that veteran dogs will "find" a false positive because they receive praise when they find something. But that's how training animals works, you give them a test when they find your training substance do that they have that connection later. the problem is there isn't a good (ethical) way to train dogs not to lie. not getting a treat is equal to nothing at all and doesn't really match the negative reinforcement or punishment that needs to be administered.

Not exactly, but dogs (especially these drug-sniffing dogs) are really great at reading their handler's body language. The dogs know when their handlers expect them to find something and when they don't.

i got arrested coming back from work for possession. i got stopped and i didn't get one of those tests bc it wasn't super relevant but the officer stopped me and i told him i was coming back from work and he stopped me and asked for ID, i said no because you don't have to. Then he told me i was misinformed (which i wasn't, but wasn't 100% sure at the time )and not cooperating, so i just handed it to him (hindsight is 20/20, but imagine if you were in my situation not 100% sure of the law). Then he asked to look through my bag, i said no and he told me he would tell my college about the incident (he saw my student ID in my wallet) if i didn't comply. At this point I was sure that had to be illegal....essentially threatening slander. So (again hindsight 20/20) i flipped out at him and told him he had no right to do that and started walking away. He grabbed my arm to pull me back, and i pushed him off of me and started walking away again, then he drags me back, puts me in handcuffs for assault and "fearing for his safety" and searches the bag, finds my weed, and arrests me. It was only 7gs or whatever so I'm not in jail, but still its fucked up how police officers can do that and get away with it. I guess to be fair I was a little high (i smoked right when i got off from work), and probably did smell like weed a little, but still. For anyone saying its no big deal bc it was just a small fine, it is bc it went on my record for 6 months....which forced me to withdraw my applications to transfer colleges to a school in china. School there is much more affordable (only 5k a year), and therefore it put a huge financial burden on me.

It's pretty bullshit. There was one day when I was in highschool. Over the intercom I get called to the front office. I have no idea why and there is a cop there. I freak out thinking something happened to my family or something but no, they escort me to a car where they are doing a random fucking search for drugs using a k-9 unit and the dog just happened to sniff and bark at my car. They immediately just assumed I was on drugs and even went as far as to ask me "When was the last time you used drugs?" I have not once in my life used any drug, not even alcohol because I'm a bitch. They told me either I unlock my car and let them search or they are going to break a window to get in. I don't want a broken window because some dog barked at my car so I unlock it and let them search. The dog goes in and sniffs around and starts digging at my seat. My seat is torn open because of this dog, I had nice leather seats and this dog digs and breaks the stitching open and starts putting his nose in the new hole. The cops either wanting to just pretend they didn't see that or actually not paying any fucking attention assume it's a hole I used to store drugs. They then want to search my entire backpack and everything. Whatever they aren't going to find anything so I let them. They don't find anything as I suspected and they let me off and later I found out, doing some looking for myself that I had some bacon crumbs on my seat from this sandwich I ate the other day. TL;DR I almost got busted for drugs because of bacon and a search dog that tore open my seat.

I'm not an american so I don't know what it's like over there, but over here in England I've been on protest marches and we all get given cards reading our rights when it comes to stop and searches and also contact details for a solicitor if the worst comes to worst. It has got some of the people closest to me out of deep shit.

I'm glad you're spreading awareness about this, man. This is a serious issue. Like you said, the prison industry is about profit, like any other industry. And they use these tests for two reasons. They know they're cheap. And they know they're unreliable. Why use a test that works, when you can easily void the citizens rights with a false positive? It's a fucking shame is what it is.

Couple things. First up, the entire video is about people who DIDN'T have drugs on them in the first place, you fucking genius. And secondly, I just want you to know that ignorant, intolerant dipshits like you are the reason I honestly won't care when the nukes start flying. I'm an addiction counselor, I deal with "druggies" on a daily basis. Hell I used to be one. And I can tell you firsthand that these people, the ones you get a rock hard 3-incher condemning, are victims, not criminals. They're survivors of severe childhood abuse, or rape, or both and worse. They started using because it's easier than suicide, and living sober with all the fucked up shit going around in their heads just isn't worth it. Louis C.K. actually said it best: "Here's something that is going to solve literally every single problem you have right now, but seriously, don't do it". And then it starts to consume them, they forget who they used to be and become this creature that exists solely to find and use their drug of choice. They lose their memories first, then their ability to speak coherently, then their sense of humanity altogether until they're basically braindead. They run out of money, and withdrawals (which are something I have firsthand experience with) are a feeling I wouldn't wish on Hitler or Pol Pot. So they steal, and they degrade themselves, and eventually they realize that they can't possibly sustain this lifestyle, so they kill themselves, with nobody to mourn them or even notice that they're gone. And all because someone decided to use them as a punching bag, or a masturbation tool. But they're all terrible people who deserve to go to prison, right?

One ended up getting arrested for domestic abuse and the other for attempted murder. They had everything, I was with them and their parents were great to them, they were just busy but they always spend time with them if they could. I'm talking about those fucks. In forensic chemistry class we learned about 'presumptive tests' and 'confirmatory tests'. The tests you're talking about here are presumptive tests, these serve no other purpose than to rule out some substances and narrow it down to "this could potentially be a drug." Presumptive tests HAVE to be followed up by confirmatory tests, which are more in-depth analyses with extremely low rates of false-positives to determine the exact chemical composition of the compound in question. You will never be convicted based on a presumptive test alone. The real tragedy here is suspects not being informed about this and having them agree to some shitty plea deal even though they're perfectly innocent.
