Realistically the most likely reason Tony isn't charged with any crimes is because of Nick Fury. SHIELD has a lot of sway in the MCU and seems to operate on their own terms in many cases. Fury's contact with Tony at the end of the first movie was probably not only enough to get him as an agent of SHIELD but also make sure any crimes he committed were considered justifiable under the conditions they were in.

This is exactly what I was thinking when the video started. Superheroes are pretty much breaking laws by being superheroes. However, in the MCU, some of them are covered in at least some of their acts by being government sanctioned. Captain America, Falcon, and Hawkeye all started that way, though they wound up going rogue in Civil War. War Machine has always operated under government authorization. The Sokovia Accords temporarily brought all those that agreed to it under legal operation, which applied to both Iron Man and Spider-Man.

Most of this was likely covered by some "conditional immunity" clause written into Fury's S.H.I.E.L.D *"Avengers Initiative"*. So long as he kept Stark's name on the list of members (or even potential members) it probably blocked most government agencies from pursuing action against him. This was followed up after S.H.I.E.L.D collapsed by the "Sokovia Accords" and Stark being one of the initial signatories of that legislation.
@CouchSpud91 Жыл бұрын
And going by his actions in Civil War, pretty much all of the legal ramifications of his actions were suspended so long as Tony acted as a lapdog for General Ross and the group in charge of enforcing the Sokovia Accords. I actually think the iconic line "I am Iron-man" is his real life legal loophole for keeping his suits privatized. he is identifying himself as the iron-man and making no seperation legally between himself and his suits, an individual can not be legally considered a weapon because that would involve legally labeling them as property, and so by claiming that he is iron-man and therefor the suits are an extension of himself he is creating a legal loophole to prevent the government from seizing anything.

fun fact, the movie producers did an amazing job of understanding the law. the government wanted to confiscate his suits in iron man 2: if they were illegal unregistered destructive devices, they would have just taken them, not asked politely for him to turn them over cause "i want it tho". and if he registered them, the US gvmt could just replicate them, since form 2 registration for non-standard NFA items requires schematics

Another reason they never went for him too hard as he was the only one that could produce and maintain the product. That is why he got away with it.
@SisterCasendra Жыл бұрын
One possible reason why Iron Man doesn't get arrested could be the existence of previous human weapons in the MCU's history. To quote batman "We're all criminals Clark, only difference is you have a boss." The ironic truth is that most superheroes likely belong in jail from various crimes they commit. Vigilantism is a crime, just them assaulting a criminal is crime itself. I like to think that it's the large public support that stays the officials hands in most superhero cases. Can't prosecute someone if no one presses charges or does the arrest.

With Tony working for the DoD and being a military contractor he does get some freedom from like half of that list as well as being friends with a couple Senators from those days

Great theory, as always. Considering the fact that the MCU has all kinds of super men and women, super weapons, aliens and exotic materials, Tony is not so bad comparing to the other...

My son said that shield is part of the government and has "authorized" all of Tony's actions. So this negates anything as illegal. I asked why scott Lang got additional probation for his actions in Germany, he said that Scott wasn't on Tony's side, he was there for Captain America, so it wasn't authorized by Shield. Shield wouldn't press charges for Tony's hacking so that takes care of that. As far as the illegal explosive devices, you have to prove it, soooooo, Tony is scot free. Scott is not free. Yeah for big government.

Wouldn't it be cool if this was a mini KZbin series? Where Team Theorist highlight the various crimes movie characters have commited?

Don't forget in Iron Man 2, Pepper's on the phone complaining that Tony's trademarked suit and the technology within it was taken without a warrant or arrest or seizure. Rhodes didn't have a warrant of seizure with him. If Tony wanted to, he could've taken the case to a federal court for violating his Constitutional rights. Furthermore, because the Air Force modified the suit using a third party contractor, Hammer Industries, he could sue for disclosing everything about the suit and it's software. I Iron Man 2, Tony held a lot of cards, but let it slide because SHIELD was working with him. SHIELD was the reason none of these charges came to light and it was them that kept the government from owing reparations from theft, damage from illegal seizure, revealing corporate secrets to a rival company, and endangering lives at the Stark Expo because they allowed said rival company to modify said trademarked suit. And that's just the second movie.

*(**6:30**)* Peter didn't die (get dusted) because he was fighting Thanos. That would have happened regardless of if he was out in space, or sitting on his couch at home.

he still put him in danger even if he wasn't snapped thanos may have been ruthless and killed peter thought he told peter that it was dangerous and tried to send him back but capitan america civil war
@Galaxxymeeps2 ай бұрын
i feel like peter dying isn’t really starks fault because even if he wasn’t in space the snap was universal so no matter where he is or what he’s doing he would have still had that same chance of dying but that wouldn’t be tony’s fault would it?

I think the films directly state that every action he takes after Civil War is sanctioned by the Sokovia Accords, except of course when he goes behind their back.
@matthewpatrick7263 Жыл бұрын
Being a SHIELD consultant and later signer of the Sokovia accords would probably have cleared him of many of those crimes. Not to mention all the bribes flying around...

To be fair when Peter died in space he did tag along against Tony’s will.

You realize based on how Thanos claims his snap works, Peter would've been dusted literally wherever he would've been?
