This is one of the most harrowing cases I've watched. They threw an innocent man into prison on the confession and testimony of a woman who was so badly attacked that she was in a coma for three weeks. A very bizarre system of justice. Poor Kevin.

it happens more often than we know, unfortunately. i watched this video on a young child who was allegedly sexually abused by her uncle. she was left with him to baby sit by the father, the father and uncle were brothers. te uncle was convicted and spent 11 yrs in prison. ostracised by everyone even his own family. he was finally found not guilty after forensici unreliable. the forensic pathologist in the case was also arrested on 11 other cases he botched up! a nightmare really!

Diane's mother might have put something in her head. It's weird that they put Diane on stand after doctors warned not to try to fill in the gaps in her memory after the incident, and her supposed revelation came about while trying to communicate with her mother. While she may not have done anything wrong, I think Diane should have apologized to Kevin. I would have.

I find it very difficult to believe that an educated system, like the judicial system of the USA, could accept a conviction of another citizen at the testimony of a mentally incapable person after such an injury. Somewhere along the line, the system should automatically have blocked the progress of this case, until substantiated evidence was delivered for a conviction.

The dramatization of the woman's memory trigger moment makes it look like the husband's identity might have been planted in her, either inadvertently or in subconscious confirmation bias, by the alarmed, questioning mother. A lawyer could inject a reasonable doubt around something like that, or simply the POSSIBILITY of that. The objective would be to sow doubts in jurors' minds when the woman and her mother the witness are cross-examined. The woman would be subject to cross examination and all the memory questions lawyers have. Similarly, the woman's mother, there at the time, could have her memory of the EXACT details questioned, and questioned, and questioned until she herself had some doubt about whether she had influenced the woman's memory. Still, one interviewee said the woman was very convincing to everyone's eyes in court, and the mother's testimony most likely wouldn't be doubted initially so it would be a lot for a defence lawyer to work against but consider: "You recognized your husband?" Followed by a lot of questions about recognized by what features, exactly, finally to arrive at "so you THOUGHT it was your husband, correct? So you ASSUMED it was your husband, correct?". "And you were EXPECTING your husband, correct?". It's an area where linguistics and the psychology of memory and suggestion combine and produce experts in investigative and legal applications. At time of the conviction, however, I don't know how much expertise in that area may have been developed and available. It wasn't until 1992 that specialized psychologist Elizabeth Loftus and co-author Katherine Ketcham published "Witness for the Defense: The Accused, the Eyewitness, and the Expert Who Puts Memory on Trial". In 1994, Loftus published "The Myth of Repressed Memory" so that new specialty emerged years after the conviction. One way or another, the defense only has to make it LOOK like the prosecution has NOT proved its case beyond any sort of reasonable doubt that can be had by the jury, given the array of doubts that (hopefully) can be had (now) about how the accuser identified the figure in the doorway. That would be the objective, at least, but much easier said than done.

From what I read, I think Kevin received $650,000 for his wrongful imprisonment. (Or maybe that was the amount for Roy Brown, I forget) but it seems that Diana still believes that Kevin was involved - claiming he struck her, left, and Parker came in and attacked her. I don’t know but I what I do know is that it was an incredibly dumb move for Diane to even be at the trial to testify-given her brain injury. Wouldn’t those boneheads think that the attack affected her memory? It’s basically common sense. I just hope Kevin and Diana are alright today and that Chantel Marie is resting in peace.

What's with these military guys and drugs and crime? Green's case was one of those most unfortunate timing issues. There have been other cases where a seemingly guilty suspect leaves the scene - before a crime, and a creep slips right in and commits the crime. If the system would do what it's supposed to do and go by proof, then these things would not happen.

The miscarriage of justice in this case was the gross negligence by the prosecution, who seems only to be looking for a conviction, no matter what. That’s how we can see this happening. The prosecution far too often forget that their task is not only to get a conviction but that the *correct* perpetrator is convicted. As much as they are responsible to find inculpatory evidence, their duty is to search as hard for the exculpatory evidence, but all too often they don’t.

Come on. You have a serial "bedroom basher" in the area, but you choose to prosecute this guy for just one of these extremely similar crimes. Why not look at him for all of them then? He probably had an alibi for at least one, I'm guessing. Eye witness testimony is notoriously bad, now let's toss in a devastating head injury on top of that. Did anyone try to corroborate his alibi? Witnesses from the restaurant? Was the closer one actually busy when he claimed to drive past? So much reasonable doubt. What was his defense attorney doing?
