Sir, partition suit for ancestral agricultural land between 5 brothers. preliminary decree was passed for partition of the suit land. plaintiff after the preliminary decree entered in to Release deed with R2,R3,R4 and relinquished his share for some consideration. now after death of R1, LRs ofR1 are fighting for their 1/5th share. This release deed was done with out the knowledge of the court. now during the Final decree proceedings, the decree is still to partition for 5 parts among the brothers. is the Release Deed valid?(done with out court permission)now how the land will be dvided in to how many parts??

हाँ , सामान्य तौर पर रखे बही खातों को मान्यता तो देगा परंतु केवल उन्हीं खातों के आधार पर अपने फैसले को आधारित नहीं करेगा। बही खाता केवल एक अतिरिक्त साक्ष के तौर पर होगा,फैसले की बनियाद के तौर पर नहीं।

If any person died without will and he was unmarried and his brother and sister also died and he has two mothers then how can his property will be distributed among his nephew can stepmothers nephew entitled share in property

This person father and both mother also died before his death and one daughter also died after his death (unmarried) and his mother married(1965) with another person after persons death and person have 2 brother(full blood relation) and 2(half blood relation) can half blood relation brother entitled share in died person property

@@ghanshyamnagar6967 Then go to class 2 heirs. If there is no class 2 heirs the properties will devolve upon agnates and cognates. If there are no agnates and cognates also, the property will go to government. It is called "Escheat ".
