• First Amendment Audit.... 👈in the 1st video The postmaster lied,and the cop solicited a trespass. The cops also thought they were telling me the right thing,because the signs say trespass. But in today’s video,your gonna hear the postmaster(Lanay)and OIC manager(Andre) admit to the new sign that was placed on the gate since my first visit(and you guys can see in that first video at the end,that sign was not on that gate)which affirms the validity of my previous argument in terms of me entering that area from the sidewalk and not the main gate. Lanay also admits saying “they made a mistake and it won’t happen again”but what she is failing to realize,she is part of the “THEY” Gurnee Illinois post office.847-662-6943

And I don't believe the judge will be impressed with the claim that there was no law attached. Could this be superceded by the fact that we must pass street signage identification to get licensed? Code of Federal Regulations title 33 § 105.260 "Security measures for restricted areas." They don't actually need the CFR listed on the designated restricted areas, ONLY that it is restricted and no tresspassing. The vehicle search CFR is more for the vehicles that ARE able to go into the restricted area (ie., postal employees that drive/park their vehicles in the area) to advise them of the lawful authority to search their vehicle and possessions if they enter the restricted area. Just because the PostMaster doesn't know that, doesn't mean their signage is wrong.

Any place that is public property that is not open to the general public is considered restricted or restricted to authorized personnel only. You've got your facts wrong, my friend. Not only was he NOT illegally trespassed, he wasn't trespassed at all. The cops merely asked him to leave a restricted area, and he wisely complied. That's not a trespass. To be trespassed, TTA would have to re-enter the restricted area after being warned. He didn't do that...not even on this second audit. He wasn't trespassed, arrested, handcuffed, or detained - the stuff that tyrant cops love to do. Therefore, his rights were NOT violated. No one has the right to remain in a restricted area. Period.

They often say, "It's public but there's people's private information" You should advise them that it's not illegal to film personal information however it may be illegal to post personal information which could open yourself up to a civil lawsuit and also criminal charges depending on the State. It's up to you as an auditor to edit out anything of a personal nature before posting/publishing and you should reassure them that as a professional, you would certainly do that. You could also mention that their security cameras could capture personal info that is accessible to the public through freedom of information requests. Again if you attained that footage you would certainly edit it before publishing. You did a great job at changing the attitude of the Staff and Postmaster through your efforts. Thank you.

Yeah, your point about the signs is valid. If mere SIGNS are legitimate prohibitions to citizen entry, then a sign that said “No blacks allowed” would be as well. LAWS WITH DESIGNATED CODE NUMBERS AND CITATIONS LISTED are what government needs in order to restrict a citizen from public property.

James, the white signs that cite federal code (is it specifically for postal properties or is it regular federal law?) 39 C.F.R. PART 232.1(b)(2) are for VEHILCES ONLY as they DO NOT MENTION pedestrians, bicyclists, skateboarders and so on. Based on those signs, YOU and your CAMERA, CELL PHONE, WALLET and ID are NOT subject to "INSPECTION". If you look that federal code up you should be able to determine that it only applies narrowly to vehicles, not persons or their personal belongings.

The signage at the gate is correct. The Post Office has designated this gated area as NOT OPEN TO THE PUBLIC. If you trespass into a posted area it now becomes a criminal offence and the police has reason to detain and ID you. If you drive or park in that area your vehicle can be searched because you have given them consent by entering. Be careful.

The area I'm seeing on video is open to whomever wants to gain access. The rear street gates are wide open as well as the front side street gates. How will those signs stop the wrong person? Use your passion to better secure these areas versus violating the rights of a guy with cell phone.

For the record, the postal manager admitted that they were wrong not to have signage on one entrance. She did NOT, however, admit that the cops violated your rights…because they didn’t. They didn’t arrest you. They didn’t beat you. They didn’t even formally trespass you. Instead, they politely (and very patiently) asked you to leave. You complained to the manager that they had posted a new sign since your first audit. She said, “Then, that’s a good thing, right?” (20:05) SHE IS CORRECT! You brought about change. No, the "no trespassing" and "employees only" signs clearly define a restricted area. This is universally understood in law, and there is no requirement that a code or statute be attached. The "consent to search" sign defines an area that has unusual restrictions, not commonly understood like trespass/restricted areas, so it has a code attached. Under every trespass law I have ever seen in any state, trespass is defined in such a way that any "no trespassing" or "restricted area" sign limiting entry serves as due notice that the area is not open to the public, and is the equivalent of being told. A business or public entity is not required to cite a code or law to define the boundaries of restricted areas. They ARE required to cite a code to limit otherwise commonly acceptable behaviors that would be unusual to restrict, such as photography.

Does that post office have rural route carriers? Most of them use a personal vehicle for mail delivery and get reimbursed for it. That sign could be ment for them. I have known other federal property in high crime areas that have fenced in employee parking with the same signs.

James, I think there is only ONE "Postmaster" at any given post office and maybe an Assistant of Deputy Postmaster. The rest are just Supervisors on duty during their scheduled shifts or days I believe. You might want to clarify all of that with a real full Postmaster or Postal Inspector just so you know and you are better armed when you visit one of your (see what I did there) post offices. ;)

I was watching a Long Island Audit video. A woman walked up to the camera and accused him of being a terrorist because of the camera. She said, the camera freaked her out. Gave me an idea. We need two people to record. One records the other "auditor". The other walks around holding up a clip board, or bicycle wheel, or two liter bottle of coca-cola like its a camera. While I am all for the preservation of our rights, your approach isn't accomplishing anything. It seems that you are only there to point out that they did the right thing only after you pointed out their mistake. The fact that the office corrected the error once made aware should be celebrated, not mocked, as you clearly seem to be doing. Too many of you so called auditors are only interested in telling people how right you are, instead of celebrating when the small things are detected and corrected. Kinda hypocritical considering many of these videos feature someone complaining about someone else always thinking they are right... You escalate things that don't need to be escalated. You people give decent folks that just follow rules a bad name.

@@jasonscott9260 I don’t believe so. There is definitely a spectrum of auditors with some falling outside the law. You can tell by the reasonableness of the totality of the circumstances who is in the right and who is in the wrong.

@@local-admin but, in this particular video, you only went there to tell them you were right. There were zero violations by anyone in this video, not by the first lady telling you incorrectly that you couldn't film or the second lady stating that you didn't have her permission nor the third lady that incorrectly answered you that it was due to safety concerns and especially not the fourth lady for her obvious display of professionalism and common courtesy to a fellow human being. This video was about nothing more than pointing out that you were correct, you made this video because you won and you wanted others to know it. What you accomplished was learning that your local post office cares when violations are reported and quickly implements corrective actions AND alerting the community that this office truly cares about it's citizens. And, not that I want to continue arguing with you, your video could/should have been shortened to clearly state the issue. You rambled on when you could have just pointed at them and laughed and said "I was right, you were missing a sign". You came to them with a problem and when they asked what was your issue you couldn't give them an answer. You were bragging because you were right, that's it.

Trespass or Trespassing ? A law student said there was a legal distinction, (My first thought is that it can not be true.) seeing is believing, he is right, so post your property correctly to keep the 2 legged pests off your land. (Trespass = People) (Trespassing =Livestock) So essentially you could own a large ranch and let people cross but bar herds of livestock. Basically he said that this is a usage of words that the government can play as an ace up their sleeve to draw if they ever get charged with “trespassing“. The court will rule against the non-government complaint and never say why. Even if appealed all the way to the Supreme court the guy will lose because he posted “NO TRESPASSING” instead of “NO TRESPASS”. Of course the judges will still rule against other individuals but the ace is pulled only when needed to protect their own. There is legal power in words! So just blot out the “ing” to stop those pesky two legged varmints. I got on the Internet and could not find one correct “NO Trespass” sign, all were “Trespassing”. Some say No Trespassing = you are on the land and are now told not to do it again, but No Trespass = do not come on the land in the first place. Below you will see that the legislative body makes a distinction. Nebraska, Section 28-521 Revised Statutes Chapter 28 Criminal trespass, second degree; penalty. (1) A person commits second degree criminal trespass if, knowing that he is not licensed or privileged to do so, he enters or remains in any place as to which notice against trespass is given by: (a) Actual communication to the actor; or (b) Posting in a manner prescribed by law or reasonably likely to come to the attention of intruders; or (c) Fencing or other enclosure manifestly designed to exclude intruders. (2) Second degree criminal trespass is a Class III misdemeanor, except as provided for in subsection (3) of this section. (3) Second degree criminal trespass is a Class II misdemeanor if the offender defies an order to leave personally communicated to him by the owner of the premises or other authorized person. Source: Laws 1977, LB 38, § 120. >> Nebraska, Section 54-403 Revised Statutes Chapter 54 Trespassing animals; distraint; notice. When any such stock is found upon the lands of another, it is lawful for the owner or person in possession of such lands to impound such stock. If the owner of the stock can be found, and is known to the distrainor, it is the duty of the distrainor to notify the owner by leaving a written notice at his or her usual place of residence with some member of the family over the age of fourteen or, in the absence of such person, by posting on the door of such residence a copy of the notice of the distraint of the stock, describing it, and stating the amount of damages claimed and the name of the arbitrator. The notice shall also require the owner within forty-eight hours after receiving such notice to take the stock away, after making full payment of all damages and costs to the satisfaction of the distrainor of trespassing animals.

Hey Bro 👋 I'm led to believe that under the Trespass Law, As long as it's posted *NO TRESPASSING* That it's legally binding, based on the simple fact, if you understand the meaning of No Trespassing, and you continue to proceed past the sign, you are Knowingly Committing and Violating The Trespass Warning. Which is Absolutely Enforceable Under The Law! I used to monitor a building and property which had been vacated and fenced off prior to demolition. I was constantly finding people squatting in and around the property. I finally was told by the Police Department that it would save me a lot of time and effort dealing with these individuals by posting *NO TRESPASSING* Signs. That way if a passing police officer saw anyone on the property, they could immediately arrest and fine them, and sometimes when caught, take repeat offender's to jail! I highly recommend that you look into your local TRESPASS LAWS to find out the legal ramifications!

The federal property I worked at we had to have signs that designated a restricted area beyond this fence. It was right next to the no trespassing sign and authorized personnel only sign. The signs were every 40 feet on the fence. We also had a signed agreement with the county sheriff authorizing them jurisdiction on the federal property. Agreement got renewed after each sheriff election. The new signs look to be ziptied to the fence. You are forcing compliance to the laws on them. They are slowly getting there. Looks like one more sign and a deparkation line at the gates to have everything in order. I like that you have cordial dialog with the employees to work towards the proper conduct.
