My sincere request to please throw some light on how to oppose or object to the Criminal Petition in High Court seeking quashing of FIR and Chargesheet. We only get immense information of how to file and draft FIR and Chargesheet quashing, but no information is available on how to draft an objection to the quashing petition.

Police has lodged FIR U/S 294 IPC, In this alleged FIR complainant is police itself, No eye witness was there. Essential ingredient annoyance to other is missing, as you have told in the video. Neither investigation officer has investigate any independent witness. Moreover, incident took place at 11:45 AM and FIR registerd at 13:16PM. But in written statement in front of magistrate IO has said incident took place at night.. Sir, in FIR complainant has mentioned that I along with my friends were standing behind auto and singing song, but in FIR they didn't mentioned the auto no. Neither during the investigation IO has mentioned anything nor they have taken any statement of auto driver.. Sir, my question is if I challenge this FIR in honorable High court Is there any chance I get some relief?

To me it appears that all the points stated by you regarding discrepancies in time or not mentioning the number of the auto or not examining any independent witnesses (even a police officer can be a witness, to whom your lawyer may cross examine during trial), may not help in quashing FIR, excpet the point of lack of essential ingredients of the offence i.e. annoyance. There is some chance if the essential ingredient of section 294 is lacking. All other points could be good for defending yourself during trial not for quashing FIR. *CAUTION* : *_Please don't treat this as a legal advice of your case. This is a general guidance based on your question.
