And the plaintiff also thought a good excuse for not paying would be the fact that the plaintiff wouldn't let her "help" get the cat down from the tree. The cat was already hurt, scared, & traumatized, and didn't know that woman. That just proves that the plaintiff isn't an idiot.

To be fair I believe the lady didn't understand causation law "but for the fact......" . In the end interview she did accept the law she said " I understand". Most people come out and still refuse to accept fault even after the law had been explained to them a number of times.

Sis, cavemen were murdering eachother and raping their partners since the beginning of time, THINGS CHANGE, we have law and a society and a privilege of being in said social is that you are protected legally from the fault of others (in most cases). You are responsible for your own actions, accident or not. If I accidentally slip and stab someone, I am responsible. If fail to stop in time and rear end someone, I'm responsible. when medication has to be adjusted, that's pretty clear emotional distress. Causation can go fairly far.....if a dog chases a cat into the street and the cat is hit by a car, the dog owner is responsible for the vet bills. If the car swerves to avoid the animals and crashes into something, the dog owner is responsible for the car owner's deductible. If the car crashes into a building and damages it, the dog owner is responsible for the home owners/ whatever insurance on the building. You might want to keep your dog on a leash and not give it to your little kid to walk....kids can't do much of anything with a large dog if it decides to take off.

This is an unforeseeable consequence to the negligent actions. You can’t possibly anticipate it’ll further trigger someone’s anxiety. You can anticipate a dog chasing a cat and potentially causing harm to the cat. Sometimes our problems are our problems. This is one of those cases. It’s not her responsibility to care for her mental health. I say this as someone with anxiety.

@@elvickRULES interestingly, you don't HAVE to anticipate any PHYSICAL disability in a person.....if they have fragile bones, for example, and you hit them lightly and break their arm, you are liable for their fracture even though there's no way you could have known they have fragile bones. Apparently judges don't have the same standard for mental distress.

I actually agree with u Adrian. I had a cat that hated all kids but my little guy. She adored him. She never went out of her way to attack them. She would sit in her place and just ignore the kids. I had a friend that every time she came over would insist her 2 yr old pet my cat. That would be on her since my cat wasn’t doing anything but minding her business. I always thought, do u just really not like ur kid? Lol. So I had to start locking the cat up when they came over. She was a little cat, only 14 lbs. 😉

Judge M ruled in the dudes favor and said the lady should keep her cat inside if thats the case. I'll never forget thinking how insane that ruling was. Her cat was seriously sitting in it's own back yard and the other one would jump the fence and come stalk it then pounce.

The defendant was clearly negligent even if she says her child wasn’t the one controlling the dogs. When the one dog took off she should be the one who tried to chase after the loose dog and get the child present and the other child to keep the other dog inside the house. And how could she think that because she tried to call the fire department and the plaintiff refused meant that she’s absolved of her responsibility?

Nobody come at me because I absolutely love my pets and I'm looking at this question from a logical view. Since they ARE considered property, how do you place a value on a 10 year old cat? You see these custody cases with a pedigree puppy and usually it's the purchase price of the dog. Would there be a cap on vet bills for an animal before it's too much? Kind of like a car, if the KBB value is less than the amount of damage, you can only collect the KBB value. Just curious how the judge figures this if animals are, in the end, property and not considered a member of your family.

So, when an animal is in pain they don't necessarily react rationally in some situations. The cat possibly was in a dire amount of pain they preferred to be left alone and even though the owner was trying to help, as it was against what the cat wanted at the time, naturally they will retaliate with that defensive nature. There have been times for example my cat has been terrified and even the sight of me isn't enough to calm her. Sometimes, just like people, animals want some alone time to process things before acting.

If you really care and love your cats you keep them inside or have them on a leash. It should be equal blame.

bad news.....fire depts do NOT rescue cats in trees anymore...at least not in Canada. Kids that wind dog leashes around their wrists are GREAT......the kid acts as a drag and the animal,/ larger kids can get away. Small dogs on leashes and little kids are done for.

I don't get why the judge goes into how she let go of the leash & the dogs will be dogs after the woman already maturely admitted what happened & already mentioned what the judge went on to say. She knows this, she admitted it, she took responsibility for it. I don't know if it's for ratings or what but that plaintiff seems like she's a few crayons short for sure. Seems a bit odd. Why am I willing to bet that chick has no one else other than that cat. her anxiety bullshit is just that, bullshit. drama queen

IDK I don't believe the defendant is entirely at fault. If you have a cat outside, off-leash you also bear some responsibility. A squirrel, a raccoon or an opossum could have spooked the cat, having the same outcome.

The defendant's dog isn't a wild animal, it doesn't have the rights to roam wherever it wants to. The plaintiff's cat was in the plaintiff's yard. If the cat were in the street and the dog gave chase, then yes, they would both be negligent since both animals should have been under their control. But the deciding factor is that the altercation happened between two domestic animals, one had permission to be on the property, the other trespassed.

@@shaund9759 And my point is the cat had permission to be on the property, the dog did not. If my dog got attacked by someone else's dog on my property, it doesn't matter what measures I didn't take to keep my dog safe on my property, the other person's dog had no rights to be on my property.
