The fact the cat was on the plaintiff’s property when attacked and not even roaming around the neighborhood LOL like girl pay the damn lady.

"But it was an accident!" Like that absolves her from any responsibility. And the plaintiff also thought a good excuse for not paying would be the fact that the plaintiff wouldn't let her "help" get the cat down from the tree. The cat was already hurt, scared, & traumatized, and didn't know that woman. That just proves that the plaintiff isn't an idiot.

To be fair I believe the lady didn't understand causation law "but for the fact......" . In the end interview she did accept the law she said " I understand". Most people come out and still refuse to accept fault even after the law had been explained to them a number of times.

As soon as I heard "no leash", "let go of the leash", "dog ran off"....etc, I new the plaintiff was going to win. Too many cases with the same story

The way the defendant said she had “two kids, two dogs in the house” made it clear she wasn’t going to take full responsibility. She said it like that’s a lot to handle. Either way, unleashed dog attacks and it’s almost always the dog owner’s fault

The defendant definitely lied about the 1 vs 2 dogs.. it happened EXACTLY how the plaintiff said.. otherwise how else did she know the second dogs harness was on wrong?! I'm surprised JM didn't catch that!

I'm glad the plaintiff won. I'm sorry the cat got hurt. The defendant made a mistake, she's paid for it and let's hope she's learned by it. Better be glad you didn't call the fire dept. ... I think they can send you a hefty bill for their non-emerg. services. $$$$

As soon as I heard "dogs have been chasing cats up trees since the beginning of time" I knew it was over. Sis, cavemen were murdering eachother and raping their partners since the beginning of time, THINGS CHANGE, we have law and a society and a privilege of being in said social is that you are protected legally from the fault of others (in most cases). You are responsible for your own actions, accident or not. If I accidentally slip and stab someone, I am responsible. If fail to stop in time and rear end someone, I'm responsible. Which includes responsibility for the damages I caused.

when medication has to be adjusted, that's pretty clear emotional distress. Causation can go fairly far.....if a dog chases a cat into the street and the cat is hit by a car, the dog owner is responsible for the vet bills. If the car swerves to avoid the animals and crashes into something, the dog owner is responsible for the car owner's deductible. If the car crashes into a building and damages it, the dog owner is responsible for the home owners/ whatever insurance on the building. You might want to keep your dog on a leash and not give it to your little kid to walk....kids can't do much of anything with a large dog if it decides to take off.

The judge didn't argue that there was no emotional distress. She just said you can't seek damages for it in a property case.

Mental health medication often has to be adjusted due to tolerance and long term use.....it's NOT a legal action.

This is an unforeseeable consequence to the negligent actions. You can’t possibly anticipate it’ll further trigger someone’s anxiety. You can anticipate a dog chasing a cat and potentially causing harm to the cat. Sometimes our problems are our problems. This is one of those cases. It’s not her responsibility to care for her mental health. I say this as someone with anxiety.

@@elvickRULES interestingly, you don't HAVE to anticipate any PHYSICAL disability in a person.....if they have fragile bones, for example, and you hit them lightly and break their arm, you are liable for their fracture even though there's no way you could have known they have fragile bones. Apparently judges don't have the same standard for mental distress.

@@AP-uo7sp if the owner had had fragile bones, and the dog had knocked her over and broken her arm, the dog owner would be responsible for the fracture even though they couldn't possibly know that the owner had fragile bones. It's interesting that there's a different standard for mental distress.

i guess you are not a pet owner. And the defendant is still responsible, she should not have a young child holding a leash if the child could not control the dog. And because the dog chased the dog, anything after that the defendant is responsible

When the defendant said 'SHE let go of the leash' and added 'it was an accident' I knew she was lying hoping that if it was her that let go of the lease she wouldn't be responsible, whereas if it was her child, then she would be, but that is of little consequence, it was negligence who ever let go of the leash...

The defendants don’t pay for the ruling on the tv court shows, so this really did save her money.

She always says, the dog was being a dog and the cat was being a cat, but most jurisdictions have a leash law for dogs and not for cats, which means there was nothing wrong with the cat being loose but when the dog got loose it was in violation of the leash law

I still would have liked to see the fire department rushing out to the yard after getting the ‘cat-in-tree-call’ with a team of rough and tough men, carrying their big ladders, all geared up, ready to save the day….. …And then just focus on their faces when they’d see the 5 feet high tree…..

For me when I watch cases involving animals I never place the blame on them. It's always the people that are at fault. Your animal or animals should always be under your complete care and control at all times no matter what. It's your responsibility!!

I agree with you 100000%. As a pet owner I know my furbabies and what they are capable of. I don't let people in my house because we have a cat that does attack. I can't trust him around people. I will not be held responsible cause my cat is an asshole, spawn of Satan. Lol

I agree with you 100%. So many people think that the way animals think in the same manner as people. So much litigation arises whereby Defendants do not take responsibility. I love animals, but the blame does not always lie with them, as you stated in your comment, Adrian.

I actually agree with u Adrian. I had a cat that hated all kids but my little guy. She adored him. She never went out of her way to attack them. She would sit in her place and just ignore the kids. I had a friend that every time she came over would insist her 2 yr old pet my cat. That would be on her since my cat wasn’t doing anything but minding her business. I always thought, do u just really not like ur kid? Lol. So I had to start locking the cat up when they came over. She was a little cat, only 14 lbs. 😉

Where is the cat owners responsibility for not having the cat in a leash? Why are cats given a free pass so often on leash laws? I call BS. Judge M should have split the cost on this one - cat owners need to control their pets too.

So I agree with the ruling. BUT!! Does anyone remember that one case when a lady was suing her neighbor because his cat kept coming into HER YARD and ATTACKING her cat?? Judge M ruled in the dudes favor and said the lady should keep her cat inside if thats the case. I'll never forget thinking how insane that ruling was. Her cat was seriously sitting in it's own back yard and the other one would jump the fence and come stalk it then pounce.

The defendant was clearly negligent even if she says her child wasn’t the one controlling the dogs. When the one dog took off she should be the one who tried to chase after the loose dog and get the child present and the other child to keep the other dog inside the house. And how could she think that because she tried to call the fire department and the plaintiff refused meant that she’s absolved of her responsibility?

The defendant is at fault. Her dogs were not under control. Only one reason why cats, not just dogs, need to be kept under control of the owner and secured on the owner's property and not allowed to wander. This defendant is cognitively dysfunctional and digging her hole deeper with her testimony.

just based on the intro alone, I will say the defendant owes every penny of the vet bills, because as the judge always says, we don't punish the animals, we punish the humans, and she left her nine-year-old in charge of a dog and the nine-year-old lost control. That's why she's 100% responsible

I had same thing happened to one of my cats by Neighbor dog and cost me $4000.00 my cat had to have surgery plates and pins in her knee and pelvic were the dog attached her.. she stayed in hospital for a week .. my neighbor never offered a penny .. I had to pay every penny of it up front ...

What's with people who put over the top emphasis on "t's and d's in words? Do they not realize that they sound like little children who are just learning to speak? The way some of these adults pronounce "kitten" and "sudden" is insufferable, it is not cute, it is not endearing. Another case of "I didn't do it on purpose so it's not my fault." Lady, if you can't handle two kids and two (obviously untrained) dogs, then you shouldn't have them. Be a responsible pet owner and TRAIN YOUR DOGS! And when you screw up and cause damage, take responsibility for your actions and pay up! SMH.

When the plaintiff said "both dogs were in her yard" but then the plaintiff said "there were not 2 dogs" why doesn't that get followed up by the judge or the plaintiff saying no that's not true.Your think the plaintiff would have said something but her not saying anything makes it seen like she's lying.

Nobody come at me because I absolutely love my pets and I'm looking at this question from a logical view. Since they ARE considered property, how do you place a value on a 10 year old cat? You see these custody cases with a pedigree puppy and usually it's the purchase price of the dog. Would there be a cap on vet bills for an animal before it's too much? Kind of like a car, if the KBB value is less than the amount of damage, you can only collect the KBB value. Just curious how the judge figures this if animals are, in the end, property and not considered a member of your family.

Poor kitty!!! My cat Buttons had a broken leg as a kitten. My stupid cousin stepped on him. He didn't get a cast due to the break spot (up near the shoulder) but he had to be restrained in a crate for 6 weeks.

What gives cats more rights to roam freely than dogs? If you want to have cats, keep them indoors. If the dog had killed the cat, it would have done the entire neighborhood a favor.

So funny! Don't tell me, let me guess: you're single. Check your municipal code regarding pets off leash AND ON PROPERTY THE PET OWNER OWNS like Jack the Cat and his owner were on. Betcha people don't have to keep pets leashed on their own property. Then, contact your councilmember/ombudsman/whateva and demand changes you think should be made to what people do on private property. I'll see your proposed code amendment and raise you that crappy chair on your front lawn. "Larry's a da#n communist with no respect for private property." Turn on your ears.

Judge Milian always says that the People's Court was the first Court show on TV and that's not true. The first TV Court show was the "Court of Current Issues" from 1948 until 1951.

Her cat was scratching at her, the owner, while she was attempting to get him down from the tree? Looks as if the cat would be relieved that it's owner was coming to rescue it. Or am I wrong about that?

So, when an animal is in pain they don't necessarily react rationally in some situations. The cat possibly was in a dire amount of pain they preferred to be left alone and even though the owner was trying to help, as it was against what the cat wanted at the time, naturally they will retaliate with that defensive nature. There have been times for example my cat has been terrified and even the sight of me isn't enough to calm her. Sometimes, just like people, animals want some alone time to process things before acting.

Actually, that’s exactly why many of us do now. Our ancestors’ constant anxiety kept them alive because they were suspicious of everything and ceaselessly on alert. Again, all of you morons need to stop pretending expertise in things you have NO education in. I realize that’s how Fox trains you to be, but it’s enraging and grotesque by the standards of EDUCATED people.

@@jazminepatton5649 We all have mental health issues. We have all suffered, death, trauma, horrible things. At some point you have to do your best to get stronger. There are awesome therapist out there that are free, pray or keep suffering. But you’re right it is mental.

“Call the fire department”, is the defendant living in 1950? It’s so clear the defendant is at fault for not controlling her dog. Anything to avoid responsibility and keep her cash. What little integrity the defendant had was just sold on national television for $1076.71.

I was rooting for the Plaintiff until she threw in "emotional distress"... so greedy. If you let your cats out and they are allegedly "emotional cats" then you lose credit. I'm not saying the Defendant was correct- she was at fault most definitely, but to add that she's an emotional wreck and had to up her meds- girl, please.

If the defense was the cat broke its leg falling out of a tree, I don't buy it. Cats don't break legs and they don't fall out of trees. They have these things called nails, or claws if you will, that make sure they don't fall out of trees.

OH WOW!! This plaintiff is a nutcase!!! “I’m a sad sack of crap, and my cats heal me” I get so tired of people during for emotional distress when there pet gets injured. I would have ruled in favor of the defendant in this one. There was zero evidence that her dog had anything to do with the cats injury.

Honestly I think plaintiff was trying 4 more money with emotional distress. I agree she should definitely get money 4 vet, but emotional distress. Thankfully cat was ok, was not bitten by fog, was chased and thankfully not hurt by dog physically.

Defendant probably paid a "breeder" $1,200 for a shitsuakitapoo (or two) mutt and told her nine-year-old to wait while she fixed the harness on the other dog (mmm....might be some pit bull in a dog which needs a harness to go for a walk) and the first pittie shitsuakitapoo broke loose from the 90 pound kid.... She got off cheap. Wait til her pittie shitsuakitapoo maims a human. Homeowners' insurance have an exclusion for dogs bred to be vicious. I hope Jack the Cat healed well! 😺😺😺😺😺😺

bad news.....fire depts do NOT rescue cats in trees anymore...at least not in Canada. Kids that wind dog leashes around their wrists are GREAT......the kid acts as a drag and the animal,/ larger kids can get away. Small dogs on leashes and little kids are done for.

I don't get why the judge goes into how she let go of the leash & the dogs will be dogs after the woman already maturely admitted what happened & already mentioned what the judge went on to say. She knows this, she admitted it, she took responsibility for it. I don't know if it's for ratings or what but that plaintiff seems like she's a few crayons short for sure. Seems a bit odd. Why am I willing to bet that chick has no one else other than that cat. her anxiety bullshit is just that, bullshit. drama queen

IDK I don't believe the defendant is entirely at fault. If you have a cat outside, off-leash you also bear some responsibility. A squirrel, a raccoon or an opossum could have spooked the cat, having the same outcome.

The defendant's dog isn't a wild animal, it doesn't have the rights to roam wherever it wants to. The plaintiff's cat was in the plaintiff's yard. If the cat were in the street and the dog gave chase, then yes, they would both be negligent since both animals should have been under their control. But the deciding factor is that the altercation happened between two domestic animals, one had permission to be on the property, the other trespassed.

@@shaund9759 And my point is the cat had permission to be on the property, the dog did not. If my dog got attacked by someone else's dog on my property, it doesn't matter what measures I didn't take to keep my dog safe on my property, the other person's dog had no rights to be on my property.
