You need to have the police to trespass a person. The security guard didnt even have a license for the gun. Now he's been convicted on multiple counts. 25 years to life in prison now. Is this the same company that patrols down town Portland? This is what happens when you de-fund the police and then replace them with untrained security guards with no police academy training. The issue was the store manager was perfectly fine with him taking them, and they had a years long arrangement. However, Lowe's corporate did not approve of that arrangement. They are the ones who hired the security firm, and the orders they passed down to them were to put an end to that arrangement, and prevent him from taking the pallets. Meanwhile, the store manager was still allowing Freddy to take them against company orders.

The reason it is murder is because the guard could have easily stepped out of the way of the vehicle if he felt threatened by it. If the guard had been in a corner without a way to escape the path of the vehicle, then it self defense.

Oregon supreme court has held that there is no duty to retreat before using force in self-defense. The guard was otherwise performing his job lawfully up to the point of shooting. The only question is whether or not it was lawful self-defense. Since there's no duty to retreat, not retreating does not invalidate the self-defense claim in this case.

@@johnychrist2559 Look, I was simply replying to the aspect of "duty to retreat" in Oregon. I'm sure there are plenty of details that we don't know about the entirety of this incident. I'm not sure where you got the information that the guard attempted to handcuff him first, I certainly didn't see that in the video. But worst case, that could be another charge of false imprisonment / unlawful restraint. I'm not saying the guard is innocent of all criminal charges, it's up to the state to prove he's guilty of the charges they brought, and obviously, they feel they have the evidence to do so. But, just from the video, I don't see how they will overcome the self-defense claim. Even with everything this guard did wrong, he did not pull out his firearm until after the victim put his vehicle into gear and drives it forward toward the guard. The moment that vehicle moved with the guard in front of it, the guard now finds himself at risk of great bodily harm or death, which he has a right to defend himself against. The moment the guard fired btw, the vehicle had reversed back into the parking space, and then the wheels had turned towards the guard, then the guard fired. I only point that out because the guard did not have to wait until he was struck by the vehicle before he decided his life was in imminent danger. Now you can flip this and make the same argument for the driver. The driver could have felt his life was in danger, and it was. Perhaps in an alternate outcome, the guard doesn't fire and the driver does in fact run him over. The driver would also have an argument for self-defense; some out-of-control guard was pointing a gun at him. It is possible for both sides to have a valid claim of self-defense. In summary, all I'm saying is the guard can be guilty of some charges, and at the same time still, be innocent of the murder charge if he can raise a lawful self-defense claim. Some criminal aspects can invalidate that defense, but I don't believe any of the charges brought against him would. The trial is around the corner, so I guess we'll see what evidence comes out and how the jury ultimately feels.

Your place of employment can make rules (limiting your free speech by an employer is definitely allowable), but they can only enforce them with the threat of terminating your employment. Anything further would be civil or criminal and in most hypotheticals, no different than if you did the same thing and weren't an employee. This guy brought a gun to work, the worst that his company can do is fire him. Everything else he did is defined in the Oregon Revised Statutes, and ORS 166.250 makes no difference if you're at work or not.

Your life isnt threatened when a car is moving at 5mph. It can push you, but youre killing yourself if you just stand there 🤷🏼♀️ The only instance where force may be permissible is when the guard's life or the lives of another person might be in danger. Then he tries to go after the woman when she gets out yelling at the security guy and says she is calling the cops. That’s when the guy in the truck pulls his truck forward to block this physco from getting close to his wife by pulling the truck forward which hit the security guy. The security guy should never been allowed to work for a security company and should never have been allowed to purchase a gun. It's unreasonable to claim that the driver was "simply trying to leave" when his passenger door was ajar and his wife was outside the vehicle. This was an aggressive and menacing act, and it was reasonable for the security guard to suspect that the driver was going to make another attempt to strike him, especially when he turned his tires towards them and revved the engine. While the security guard could have handled the situation better, it seems that the individual who was shot did not recognize the authority the security guard had over the shopping complex, which was granted by the owner. The deceased person's derisive and aggressive actions led to the tragic outcome. Despite the mistakes made by the security guard, I don't believe his actions constitute the charge of 2nd-degree murder. The guard was within his rights to confront the trespasser, and to utilize deadly force considering that a truck can be used as a deadly weapon, as it potentially could have been used in this case. This unfortunate incident highlights the need for better communication and proper handling of grievances, this situation should have never escalated to this point and many lives were forever altered because of the ego and temerity of both of the individuals shown in this case.

That security guard has zero right to block the path of that mans vehicle he's not a cop. I know I am right cause that over weight loser is now rotting in jail for life.

@Nick-zs1kx In your partisan opinion, maybe, but the reality of life is that if you try to run over someone who is armed, you will likely be shot. Basic common sense. It's unfortunate that two men lost their lives that day over a dispute that could have been resolved with a mutual respect of life and the ability to communicate more effectively.

This belligerent aggressive man chose to engage in an altercation with an armed security guard after being trespassed and then tried to strike the guard with a vehicle, any reasonable person would have just left the premises. He had ample opportunities and room to do so. It is evident that you are a pretentious fustian who advocates for people who commit felony assault and then cry murder when the victim defends themselves. The guard had every right to confront this guy, but he should have been a bit more level-headed and had asked for police assistance, but he absolutely did not have to allow himself to be struck by a vehicle driven by an entitled, unhinged lunatic that refused to abide by rules and common decency. Regardless of all this, the fact you cannot concede my overall point, which is the importance of communication and de-escalation is an indication of your own savagery and propensity for violent acts against authority figures.
