Comparing the retention of classified documents, EVERY PRESIDENT has full authority to classify and declassify information separately from whatever action some subordinate agency may otherwise have taken with respect to any particular document or set of documents. Each president has done so, especially in establishing the libraries dedicated to their presidencies. Those presidential libraries typically house thousands of classified documents that are set to be de-classified at some time. Usually many decades after the political passions that prevailed during that administration are as dead as the leaders and treaties that might be embarrassed or imperiled by revelations. *_NO Vice President, nor any Senator or Congressional Rep. has any such authority attached to their office._* So the retention, possession and storage of classified materials by a Senator or Vice-President, Particularly AFTER their Terms of office expired, is NOT LEGAL, and cannot be compared with the authorities and rights of Presidents.

No, the ruling makes perfect sense! Official acts grant immunity, private acts, no immunity. The Trier of Facts (the original court, will have to determine what constitutes an 'Official Act' or a 'Private Act', and the defense can appeal the ruling all the way up to the Supreme Court if they don't agree with the findings.
