I have watched the video multiple times, my opinion doesn’t matter on who’s guilty or who’s not. What does matter is I showed my 18 year old son the video, who looks a bit like the young man that passed, because I wanted him to see how a situation could turn out. One of which includes “Unnecessary defensive force - The defendant genuinely believed they or another person was in imminent danger of death or serious physical injury and that the force they used was necessary to defend whoever was endangered, but the belief of danger or the force being necessary was not reasonable.” I think this fits here MUCH better than 1st degree. The shock alone of the escalation to blood bath yeah Dad shoulda gone silent, lots of shoulda dones for lots of people. I've witnessed a fatal car crash, no one was partying. We as spectators did what was needed. I sat with the driver that lost a best friend instantly. .. I knew he was in shock and I told him this was not your fault, there was nothing you could do at the road speed just feet away from the intersection when the light turned yellow. That day a man chose to turn in front of them, hesitated, then gunned it, damage done. I'm so grateful to have had my head in a good place to be extremely aware of every unfolding detail visible. I wish a young man did not lose his life basically because it escalated because of people that had NO CLUE of what was going on decided to go over and put their 2 cents in. UT’S JUST HORRIBLE!!! I do not find the man guilty I do think it was self-defense. That’s my feelings. But I do think some other charges need to be brought on to some of the people that decided to violately hit this man. And also for the under age drinking and the lying. The way people act now days and having 12-13 of them around u doing what they were doing I would have to defend myself also. So far, on the stand, every single one of these young adults, and teens, and prosecutorial witnesses, have identical cases of 100% memory loss as to what they, and their friends did that day. Yet incredibly, every single one of them are able to clearly recall exactly what the man did, and why they were attacking him. Their acquired severe, and selective memory losses all manifested identically, and left them each with the exact same few memories. That’s absolutely remarkable, and should be one for the case books. Furthermore, two years ago, right after it happened, no one of reported the man saying something inappropriate about little girls, or he that he punched a girl. Yet again, they’ve all recently regained the exact same two terrible memories to explain they were attacking the man because they “were so scared of him”. If they continue to not remember literally anything they, or their friends did to that man, this is going to end up a mistrial.
@Nephthys-ness8 ай бұрын
100% ?? -- that's the whole amount. "Not remember Literally ANYTHING" ?? Even the Judge disagrees with this representation. In fact, what you'll hear are Sustainments on the grounds of "Asked and Answered", followed by enjoinments to "Move on". Prosecution is letting them do their dance for the 70+ witnesses Pros can call, and irritate the adjudicators of fact with their boorishness. Def. is earning their keep. Mr. M knows 5 languages and defects from Romania with his whole family under Ceaucescu?!? - side note (& probably wasted here ) but speak to insecurity at his having no friends when he came to USA in HS and the Mens Rea behind his inciting aggression / desire to be close to the group of teens - and subsequent gutting, slashing and merking kids 30 years and 70 pounds less than him.

12:57. The it was said Miu charged the teenager. Then the attorney said “you use the word charge. Where there’s a video on it we get to decide.” Sure, Mr Attorney, the jury gets to decide whether or not the word “charge” applies to the manner that Mr Miu approached the teens. However, the reason this witness is on the stand is so he can state what he witnessed. He is stating that he witnessed Mr Miu approach the teens in a manner that this witness would characterize as charging. If you are watching the Olympics and the event you are watching is the 100-yard dash you wouldn’t say “I saw the athletes approach the finish line in a manner I would call running”. You would say “I saw the athletes run towards the finish line” because that is what you _saw_. A witness is on the witness stand to say what they witnessed. This witness is doing a good job of responding to this attorney’s questions, despite it all.

He also ditched the weapon. As a grown man you should have the common sense to just leave before it got to that point and find his group in case he needed help. The kids should be charged with assault and at least underage drinking. There have been many times as a teen that another group started with us and we left the situation because we knew it was just gonna end bad. As a grown man starting to argue with drunk teens is just stupid. Regardless you can not slash 5 people and kill. He had wvery opportunity to leave knowing the teens were not gonna stop. Someone should have also told the teens to carry on as well. When he left and tried to get to his truck then lied he screwed himself.
