You know, I’m not a lawyer and I have never spent any time in a court room. Still, I somehow was under the impression that lawyers do not lead the witnesses narratives. They ask a question and the witness answers, not the other way around. All the videos I have seen and heard re. this case is the other way around. The lawyers are telling the story and the witnesses answer yes, no, or correct. We certainly are not hearing the testimony of the witness. Can someone who ACTUALLY knows something about courtroom procedure unscramble this for me?
@MissysAngels8 ай бұрын
Well the defense can ask leading questions and ask witnesses to just answer yes or no… This a well known defense lawyer so he is doing his job, most defense lawyers don’t bother. The state can not ask leading questions but if other side doesn’t object it usually slides…
It's permissible because he is basing it on their own sworn affidavits, the video evidence, and the testimony as it's occurring in real time. At points he is leading, is objected to and then rephrases or moves on. The real problem is, the accusers lied to no end and it's undeniable. The video discredits them and they are giving testimony that greatly conflicts with their own sworn witness statements. Because they did this, he is allowed to use this tactic to try and confirm what they are in fact claiming. *They brought this all on themselves, initiated the violence based on lies, then tried to blame Miu for 100% of what occurred with mob lies.* He never should have been brought in on those charges, they should have been appropriate like lying to police, tampering with evidence, a much lesser degree of manslaughter and so on because he is guilty of that, but not 1st degree murder and 4 counts attempted 1st degree murder. *That truly requires they accusers did nothing, and he started assaulting them unprovoked which obviously is not what happened, but it's the story the lying accusers and incompetent prosecutors have been trying to paint, and I hope it blows up in their faces.* There's no justice in dishonesty.

*You can clearly see she wasn't punched in the face and this contrived lie is blatantly that because it's the very first claim made to the deputies, and it was followed by a barrage of sworn affidavits by the accusers that were inconsistent, discredited by the video evidence, and further conflicted with their actual testimony which altogether, proves perjury by all of them.* The prosecutor tried to use their ages as evidence of unconditional innocence, and I understand some people are corrupt and immoral enough to support that, but I most certainly do not. Nic Miu should have been charged with lying to police, tampering with evidence and other appropriate charges that the evidence supports because 1 count first degree murder and 4 counts attempted first degree murder are in complete and total fraud. *I largely suspect the prosecutor did this under the presumption he will be acquitted, and it will prevent the locals from harassing him, other public servants and the courts as a whole.* Convicting him based on the evidence would be injustice and fraud. It's a blatant persecution instead of an appropriate prosecution. *I am sickened by everything and both sides, but the bulk of the onus is on the teenagers, the young adults and the parents that supplied minors with hard liquor and beer.* The video shows clearly that had he not used deadly force to defend himself, it's reasonable to speculate they soon would have started holding him under water. The video shows that when they shout "he hit a girl?!", he had in fact stabbed the girl and never struck her in the face. The stories of the accusers changed rapidly and repeatedly, and when shown freeze frames of their own faces roaring with laughter in a state of drunken bliss after bullying and assaulting the man, *they actually had the audacity to testify the video shows them when they were terrified of Nic Miu at that point in the event.* He needs to be acquitted. This is that "white privilege" they talk about that factually doesn't exist, but financial privilege does and is the basis for these fraudulent charges. These are not "children" much less innocent children.

You're wrong about her getting stabbed, she never got punched or stabbed. A different girl got stabbed.
@JonDeth8 ай бұрын
@@pennytinklenberg3305 I may have mixed up names, but no girl was slapped or punched by Miu. They changed their testimony to contradict their sworn statements made to the sheriff's department. In their sworn statements, they all say it was a slap and that they saw it. When they reviewed the video and met with prosecutors, it was made obvious that he could not have slapped her because at that point, he was holding the knife in his right hand. This is why they all changed testimony and said it was a punch since that was at least theoretically possible, but with that they all then changed testimony to they never actually saw it, or they don't remember it. Then it became 3 claiming to see the punch instead of all of them, and the rest were unsure or suddenly didn't remember. *This is just one of the countless lies they told.* The young women claimed to be impartial and there to help, but when Miu is walking towards them he begins speaking to them and motions with his arm to the young men, and the 2 women cut him off from speaking. Then, once face to face, he begins to speak again and motions towards the teenagers again and for the 2nd time, they cut him off. It's at this point the brothers and AJ have approached but are off camera, and Miu has armed himself because he's now surrounded in all directions in the shallow water of the sand bar. They all lied and due to the viciousness of their wounds and one dying, they are lying in pursuit of revenge rather than justice. A lot of locals posted about these people when this first happened and exposed them for being despicable liars and bullies. It's all so very twisted and the irony is Nic Miu is an engineer and the teenager he killed was planning to go to college to become an engineers. Ironically, that's what I went to college for. They may have gotten along had the teenagers and those young adults not gone on the attack. He met someone that was the very thing he wanted to do with his life and instead, assaulted him and died for doing it.

@JonDeth8 ай бұрын
@@pennytinklenberg3305 I'm sure I have some details wrong, but I have a lot of very critical ones correct. If we were to tabulate each event in numerical order of occurrence, it ultimately shows he was attacked first, and multiple times before anyone was stabbed. It will also enumerate before he was attacked or stabbed anyone, he did try to explain himself to the 2 young women, AJ Martin and the brothers. It also will enumerate they cut off his talking, and the brothers and Martin were in fact in his direct path to leave but off camera. The breakdown based on timeline ultimately proves self defense, and their original witness statements given to the sheriff's department claimed he Nicolae Miu was nearly knocked unconscious by the strikes he took. The video shows that when they all said in their original witness statements that he slapped the girl, the knife was in his hand, and he could not have used a slap. I am being as unbiased as possible, but I have grown to favor Nic Miu due to all the lying of the accusers. He made very serious mistakes, and he did accost their raft chain, but he was also lured over by a cell phone being held up, called all kinds of names, and then was in the process of locating his property once he saw he was vastly outnumbered and completely out of favor. *The bottom line for me is,* who attacked first, who lied about how the events occurred, the order they occurred in and that they were terrified of Miu when they were show on camera roaring with laughter, mocking him, lying about him and ultimately, he was in a position of grave bodily harm by the time he withdrew the knife. They attacked him multiple times not even seeing the knife, which tells you where their minds were. He did nothing to provoke a physical assault from the entire mob of them, and this is why it's self-defense. *If his use of lethal force for self defense were challenged, I would understand that, but the charges he is facing are dishonest and the pursuit of revenge, not justice.* By the time Miu was lying to police, and had tampered with evidence by trying to ditch the knife, the most critical events proving self defense had already occurred, and while those post violent tactics he used are crimes, it does not change the facts about who attacked first and how viciously they all attacked him. It's one person against 13, and multiple members of the 13 including the young women had assaulted him. At that point, he was justified in using a weapon even with how gruesome and deadly it was.

Too much “testimony” by the prosecuting and defense attorneys in this trial. It was as though they thought that they needed to state the circumstances with each and every witness in the event they had forgotten their experiences. This begs the question as to why it took so long for the matter to go to trial. Also, technically, attorneys are not permitted to lead the witnesses. That said, Mr. Miu was found guilty of murder and he will have a great deal of time to do some soul searching as to his actions that produced immense suffering and death to one young man.
