Real property is not considered when determining indigency. Only liquid assets such as a checking account, savings account, certificates of deposit, stocks and bonds, as well as income from one's current employment are counted towards one's ability to afford council. A house, or anything that is required to maintain employment, is not counted. That being said, even if this guy had $500k in cash, that would be long gone before the trial even started. Good attorneys are not cheap and pleading not guilty on a homicide case is going to require a great attorney.

The title really should read that he pleaded not guilty to first-degree murder. It will likely be undisputed at trial that he shot the judge, but his defense will probably argue that it wasn’t premeditated and hope for a conviction of a lesser-included offense.

Do you have even the slightest clue how much defending a DP case will cost? Of course he will end up with a Public Defender. I know it seems unfair, but that's how our system works, and it's better than any other ever devised (so far anyway.)

A typicaly DP case costs around $500,000 to defend, so his $115,000 salary doesn’t even make a dent. On top of that, he’s done being a cop, so that income isn’t coming in next year or the year after. That money is gone, and he still has to provide for his family with whatever’s left, and he can’t get another job since he’s locked up. With just his salary, he’d be in the negative. He needs a public defender.

@@RunattaIf you qualify for a public defender you are entitled to have the public defender. If you don't qualify you're entitled to pay for your own attorney. What they're saying here is that the public defender has not been appointed yet and I doubt the sheriff qualifies under the financial guidelines. It seems as though the public defender is actually there as a friend and he shouldn't be representing himself as there on behalf of the public defender. The Commonwealth stated that the public defender is not listed as the sheriff's attorney. You can't just show up in court. You have to put in an appearance

It's highly unusual for the DPA to get involved without an appointment from the court, but as an attorney myself, for a Class A felony charge I would charge at a MINIMUM $50,000. With the high-profile status of this case I'm not sure if many local attorneys would get involved. Not only are you going to defend the client but you, as the attorney, will be hounded by media. It's a wild case.

That could be made up gossip, but if it's the case then it's important for a jury to have that explained to them. Everyone is entitled to a defense, even those you deem "guilty" before knowing anything about the case.

The judge was grooming the sheriff's daughter while she was clerking for the judge and basically saying you had to give me this if you want to proceed and advance in your career. The daughter was journaling about it after seeing psychiatry that Father read the journal flipped his shit and then took it straight to the judge and showed him the journal and the proof. The judge got cocky basically said you can't do anything about it and this year said oh hell I can't. Boom boom boom problem taking care of

The "Sheriff" arranged a back door deal to try and make the State pay for his defense. Who shows up in Court with a Public Defender that was never assigned to the case? Fishy as heck. That "lawyer" needs to get the boot and be investigated. Sadly, he will probably get the case and be rewarded (paid) by the taxpayers.

He's probably friends with the public defender. PD showed up hoping to at least get him through the arraignment. Sheriff will resign, wife will either pack up and leave with all the money, or start divorce proceedings to protect their assets. Then he'll apply as indigent and get a PD appointed. Makes the most sense financially from his standpoint. You people don't think outside of the box at all.

No doubt he'll be characterised as an 'upright citizen', a 'pillar of his local community', a 'stalwart member of the local church', a 'real family man' etc., etc. and, therefore not a danger to the public and might even be let out until the trial begins. Having seen children and young people and people with severe mental health problems and even women in labour chained and shackled, I asked myself the same question about his not being restrained in any way. Seems a little odd.

He is protecting this case from the beginning although he is not getting paid anymore than he already did to do so. The public defender knows that capital eligible cases can cost over 200k to litigate with a private attorney and that he will likely be covering this case because an incarcerated individual who just lost their job cannot just come up with 200k. Please don’t talk about things you know nothing about.

I watched the hearing... what I got was, the current sheriff who is still employed and making $115,000 a year salary, with paid for property in Kentucky and property in Tennessee...IS NOT ELIGIBLE FOR A PUBLIC DEFENDER.. the judge made that clear, so did the prosecutor. Just like every criminal that has money, he will be paying for his lawyer...mark my word... His next hearing is, I think the 10th of next month. ... Did you listen to the video? The lawyer next to him was a public defender who had not yet been appointed by the court. So the judge had to go through the steps to see if he was eligible for a public defender, which he determined he probably would not be. But because he is a Sheriff he has to have a preliminary hearing. So the judge appointed that public defender to represent him at the preliminary hearing only telling him if the case proceeds he will have to obtain a lawyer.
