A hearing was held Wednesday to decide whether a civil lawsuit by Gabby Petito’s parents should move forward against Brian Laundrie’s parents. Petito's family is suing the Laundries, alleging that they knew their son killed Gabby and did not speak up.

I think there is a difference between exercising your right to remain silent to not incriminate yourself, and not reporting a crime in progress; because the crime was still in progress and they directly participated in the destruction of evidence by not reporting Gabby’s location. They knew that not reporting Gabby’s location would result in further deterioration of her body and be far more distressing for the family members when she was found, if she was found at all.

@@gwens5093 Courts also use common sense. If they had knowledge that Gabby was dead and that her body was left beside a creek in Grand Teton days before her body was found, then I think you would have a very hard time convincing the court that the Laundries did not know the condition of her body would deteriorate left exposed to the elements and wildlife. This may not have carried any weight when they made their decisions, but it does not mean they did not have that very common knowledge. It is my understanding that the attorneys have a letter confirming that Roberta knew Gabby was dead, and more than likely knew where her body was located.

I hope this case gets to proceed. I get protecting their son, but maybe if they’d turned him in, he’d still be alive. Knowing she was murdered and letting her body decompose, left out in the elements, and not allowing her family to put her to rest, was inhumane. RIP Gabby and strength and love to her family.

Everyone fell to realize he is the one that murdered her, not his parents. As sad as it is.. them not speaking is in their constitutional right and cannot be held accountable. That's why they say"" anything you say or do can be held against you in the court law"" and your lawyer always says do not speak ...

@@sw1450 they may have gotten a lawyer because according to Utah police, he was a victim of DV. Right then, the lawyer would tell them to cut off communication and not talk to anyone. It's possible he lied to his parents, he was obviously not stable.

The Laundries not showing up even to a court hearing to me shows they feel they are above the law and hopefully the judge sees their disregard for the Petito family and the disrespect that everyone else has seen from them this far .. I hope they are held accountable for the crap they did/didn't do !! And i dont for one second believe they didnt know!!

Suing for what? There is no more justice for Gabby: the Laundries were not eyewitnesses, they did not instigate the murder and they were not the killers. Gabby was a beautiful girl and I am sure the Laundries loved her.

@@yvonnesookdeo5358 accessory to a crime (accessory after-the-fact). Impeding a criminal investigation. Harboring a fugitive Defeating the ends of justice by wasting police resources and manpower. Damages for pain and suffering from her parents. In most states, helping someone who committed a crime in any way (financial, emotional or cleaning up their crime), carried the same penalty as the felony crime itself. In some states, it carries half the legal penalty.

She was literally admitting to assaulting him, admitted to being the instigator the last time she was filmed by the police. Why do you continue to ignore that? Maybe if she had been arrested for that instead of being given the predictable "pass", they would have broken up and still be alive.

Exactly what justice are u wanting to be brought upon the innocent parents? How much money should they be made to pay for something they didn’t know or do??? They didn’t kill her, they didn’t say anything bc it’s their right to remain silent but this doesn’t mean they knew something just bc they didn’t say anything. So what justice should they pay? Why should they be punished for something they had no control over? Maybe they didn’t say anything bc they didn’t know anything. Maybe they were just trying to help their son get away from an angry mob that wanted to crucify him? But that doesn’t mean he told them anything or that they knew anything. They found a note from Brian and they immediately turned it in , just goes to show that they did speak up when they actually did know something.

@@broeheemed32 Assaulting _and injuring_ him. These were Brians Injuries according to the Moab Report. Gabby left scratches and bruises on Brian. The bruising and bleeding was from her hitting him with her phone From Investigative Review of Aug. 12, 2021 Petito-Laundrie Incident in Moab Park Ranger Ryan Kral, points out scratches on the left side of Brian’s neck, left side of his nose, scratch near the center of his face, and bruise and bleeding on the right side of his head. Officer Robbins finds an additional injury on Brian’s right bicep/tricep area. Brian said he was not in any pain, and that he "wasn’t complaining.”

From memory the Laundries chose to ignore phone calls from the Petito's and even called the cops when joseph went to their house to ask about his daugher. My opinion will always be that the Laundries knew what happened from the day Brian came home and they did everything in their power to protect their son. The funny part is it backfired and they ended up losing him anyway, instanty karma. Do the right thing no matter how it makes you look.

It doesn’t matter what your opinion is bc opinions aren’t law…there’s no proof that they knew anything so how can what they said or didn’t say be held against them … How do u prove that they factually knew something and didn’t say anything? I didn’t know lawyers can read minds … People want someone to punish and this is not right. Don’t punish his parents bc they hid from the hateful media and public. Laws need to change, it is impossible to just pass by the fact when Gabby body was laying dead for days and Brian goes camping with his family. Meantime my heart brakes every time i see Gabby's Mother. The parents concealed information. While Gabby's family was in desperation looking for their daughter.

@@aliciacasta4771 "get to" is an awfully strange way to put grieving your child. There is nothing that makes that situation any better. They're right. You have absolutely no idea what you would do if it was your child facing their entire life in prison. I think they could have handled it much better but don't try and pretend that you'd be shouting your kids guilt from the roof top without hesitation just because it's the right thing to do. You don't know and I protect my daughter at all costs.

Gabby's mother looks exausted and absolutely broken by this ...I have a 25 hear old daughter and I just can't imagine going through something like this ...I honestly don't think I'm strong enough to keep it together if I were to lose my child especially in such a brutal way....I feel like the dirty laundries should be in jail for withholding information wich is the same thing as lying 🤥 wich they have done plenty of that as well...Gabby's mother has to relive this whole thing again and of course the dirty Laundries didn't have enough respect to show up in court ...why am I not surprised? I pray that the parents and family of Gabby get justice and I pray that God heals their hearts .

@@mariacarlos940 I know many people are angry and want justice. But how do we know they KNEW where her corpse lay? Where's the evidence? Innocence until guilt is Proven is so crucial a right that it is enshrined in the Constitution - and so many of us forget this. I imagine they will be asked not to to travel if this goes to trial. I wouldn't say they are living life...Once your child dies? And this incredibly public lawsuit... these things are beyond stressful. They are probably the Dead, walking. Just going through the motions. That's how I would feel, anyhow.

@@jeanakatherine9369 Because the Laundries lawyer is working ON BEHALF of the Laundries. Waldman (Depp’s lawyer at the time of Waldman’s so called defamatory comments about AH) made those statements on behalf of JD and JD was found to have to pay AH $2M for those comments.

When Brian went walkabout, his lawyer let out how "they were all grieving". Yeh, grieving what? _Supposedly_ NOONE Didn't knew Gabby was passed away for over a week or so yet. To the LAUNDRIE LAWYER, if _your daughter_ was hurt, lost, and you cldnt find her. You were desperate. You ask FIANCÉ & his family if they know as her car's at his home. They IGNORE you. How wld _you feel._ Wld _you_ feel they were causing you unnecessary grief, ESP if they _knew_ WHERE yr daughter was & that she was injured or worse....and this continues for over 2 weeks.. I think it's disgusting & caused immeasurably unnecessary grief 😔

Hard to say that to the lawyer, it’s his job to defend his clients. I’m sure I’m your scenario, he would feel differently, but it’s not, he’s being paid by this family to represent them. P.s. RIP GABBY, hope the best for her family 🙏

I don’t recall the coroner who gave a interview revealing she suffer blunt force trauma to her head.

It's simple, If you knowingly withhold information that you know could potentially be seen or deemed as evidence in a crime, you should be held accountable. If you don't offer that information freely than you're lying and withholding evidence, which is an offence. On top of that, (in my opinion) if they were helping Brian in any way whatsoever after knowing what he did, they were basically harbouring a criminal. Just because the police didn't know right at that moment, doesn't mean it didn't happen. They have no conscience and obviously no regard for human life.

You have to have actual proof. And they couldn’t be charged with obstructing of justice because there wasn’t even a warrant out for their son when he was alive! So they didn’t obstruct justice. In legal terms.

Proved. Therefore evidence must be gathered and presented to a Judge to press charges. Also they never were treated as interested people's or suspected as. They are legally always available thoroughly a Lawyer. They doesn't have to show up.

"The only thing necessary for triumph of evil is for good men to do nothing," that quote fits this case. The Laundries knew more and choose to let Gabby's parents suffer longer than they had to in just locating their daughter. Their son would be in custody today instead their silence allowed him to run and eventually kill himself. If it was my son I'm sure I'd want to protect him but when it's a crime of murder the only protection I could offer is getting him a lawyer and tell him to please turn yourself in. Their choices to stay silent created this entire mess and personally I believe they owe the Petito family something. They choose to withhold evidence in an on going case, at the very least thats obstruction of justice. JMO

Dropping your girl or boyfriend off before you come home is not abnormal. Having your girlfriend, fiancé's or husband's car is not abnormal. Gabby’s mother broke my heart watching her. They zoomed in on her, and her eyes were just so sad (of course), the dark circles, my heart just aches for her! To their entire family. The Laundries are despicable and poor excuses of human beings.

The problem with them remaining silent is the messages from her family and the timeline of events. If they lived at his parents house and they left together, and he came back without her, and even if he said she went home; wiuldn't the messages from her parents saying they didn't know where she was indicate Gabby is a missing person. She didn't have her cell phone or debit card because both were in his possession. Once finding this out, why wouldn't his parents turn the van and all her possessions over to the police? Why would they not provide any shred of evidence to help find Gabby? Why a camping trip if his fiance is missing? Why not report him missing until days after he left? Come on,at some point its not silence to protect yourself, its silence to cover up lies and felonious actions.

Maybe he came home with paperwork from Utah police and said they're taking a break from each other. She never drove the van anyway so it's not suspicious. Maybe they got a lawyer because of DV, but they cooperated with police and didn't secretly do anything. The media exploited this for profit. There's no evidence they knew. All of a sudden you think Brian was honest with his parents right off the bat? You know he killed her, but you think he tells the truth?

From a legal standpoint, Petito attorney did present direct precedent on several of the arguments for dismissal. While I think he may face evidentiary hurdles at trial, this case should survive motion to dismiss

Not on the Laundrie side don't get me wrong, but that's exactly what his job is. I'd bet money he personally doesn't believe the Laundries as far as he can throw them, but his job is that he has to find any legal way to defend them. Trust me, I 100% agree with him using big words to sound smarter but he knows those words and he has to use them in the courtroom, he has to use legal jargon for his case or else the judge will just throw it out. Again, not disagreeing with you and am on your side but knowing the law like I do he has to grasp on to any little thing for his side. That's why lawyers are so mistrusted and called liars. They have to put all of their own beliefs to the side and "believe what their clients say is truth and defend/ prove that 'truth' ". It's really frustrating to be a defense attorney.

I find it fascinating that people sympathise with one party and therefore the opponent attorney is somehow evil and mischievous by how they present facts and their use of "law language". I mean that why there's law school and court decorum. That is what being a deffensive attorney looks like and he is rather good, it is about getting the opposite party to prove facts. I know very little about this case but I'm getting the feeling after JD v Heard ppl came see random trials just to judge lawyers and place judgement on parties based on sympathy. Just use some sort of common sense to understand where everybody's coming from... , I mean is it still good that people have the right to be professionally represented in court even if they're serial killers or ya'll rather burn them on a fire pit without a trial or a hearing or whatever? sheesh

Aside, it's amazing how many attorneys won't even do a decent job and charge thousands in Florida. I have a stepmum thieving my dad's trust monies to me with her super attorney firm and attorneys have been lousy, cheering on the attorneys to violate me. It is very odd how worst criminals get all these rights of better law!

they hired an attorney after she was reported missing and they knew something had happened. why hire an attorney at all unless they knew something for sure, you dont hire an attorney because someone went missing unless you know something bad happened. he must have told them something happened to her, probably blamed her for it, or said he had to kill her to protect himself. They went on a family trip while Gabby was laying under the ground, decomposing, and they all knew it. they sat around a campfire, took pics, laughed, and had family time, making memories. who does that knowing she was gone.

The parents hindered an investigation, and (likely) tampered with evidence in same investigation-both of which are criminal acts. And yes-what an attorney says on behalf of their client lends reasonable questions to what the Laundries knew, and refused to offer to LE.

I have 2 adult boys and will and have always backed them if they were in the right. But will be the first one to hold them accountable. I Love them no matter what, but if I knew they did something so horrible, I would be there to take them in to tell the truth and face what is ahead. Brian's parents knew and hoped that he would make it to another country in my opinion. Instead of doing what was right they let this family suffer even more. 😪

Petito's will need to prove the Laundries knew where their son was and obstructed the search to find him. And will the standard of proof is lower in a civil suit, it may be very difficult to prove. If I was the Petito family, I'd be more likely to sue the police that encountered the couple and failed to investigate and take steps to separate the couple and to follow up. Maybe, this is just a tragic case, and the one responsible for Gabby's murder is dead. We can't always get legal relief.

The fact that he came home without Gabby and cleaned out the van? I would definitely be asking my son some serious questions. Gabby also lived with them. Back when the statement was issued, the Laundries and lawyer were the only people Brian had talked to when he came back without her, I remember when they made that statement thinking wow maybe she's alive and there is some kind of explanation to all this. I can only imagine the hope the Petito's felt. It is outrageous and despicable to wish for a reunion when at the very least the lawyer knew she was dead.

The experience with the Utah police may have scared him out of dealing with the Wyoming police and decided to deal with it from home, but that's just a guess.

They knew that their son committed a murder, and that there was a hunt in several states for the woman their son murdered. They covered it up, Lawyered up, and time and money was spent looking for a live woman when they had knowledge that she was DEAD! They covered it up, took him camping, and when their son became missing, With a gun from their home, how long till they reported that?! They knew exactly where to find him because he TOLD them where he was going. I hope Brian's family feels the same grief as the family of the woman he murdered, but in my opinion, they brought it on, and their silence killed their son. Someone needs to ask their lawyer why he NEVER insisted that Brian turn himself in? Maybe Brian's Parents should sue him!

Based on the premise that everything you said is true, The moment they helped him, they became an accessory so they now have a constitutional right to remain silent to avoid incrimination. I'm not arguing that they weren't wrong but I am saying if that's the case, they can't sue for them not speaking up, maybe a wrongful death but I think they would need more for that. They're in pain and want someone to pay in some way. It's very sad.

@@lazydaisy2292 Except they are not using their right to silence, as they have not been subpoenaed, or testified to this matter to police. So they haven't pled the fifth. They have not been charged with a crime, so they would actually have to walk in that courtroom, be sworn in, and invoke it. They know a crime happened, because they hired a lawyer and have not ever, at any point, said a single word, till they called in police to rescue THEIR MURDERER SON! And even worse of an insult to not only the parents of Gabby, but the rescue people, the police, in several states, looking desperately for a woman they hoped to save, and likely hundreds of thousands of dollars spent to find her dead body! They in my opinion, are not much different than the Crumbley's who bought their son a gun, and, when he drew pictures of dead kids, refused to take him home even though they knew he had his gun in his bag! They left him there and children are dead for their actions. The only difference is Brian's family, is free to live their life with no consequences beyond the fact that the gun in this case, took the life of their son, and maybe for them, it was easier that, then to watch him go to prison for murder.

Plain and Simple they can’t prove that Brian told his parents he killed her, this is all under the assumption he told him. Denzel said it best in Training Day *Its not about what ya know, it’s about what you can prove* While I feel terrible for the Petito family, the fact remains they are not liable because Brian could of hid it (although highly unlikely).

They got him to bring home the van, scrubbed it and went and got their vehicle because they knew he wasn't coming back. That statement by their lawyer is heinous knowing that they knew she was dead. They found where their son died way too easily. There were people with cameras everywhere and the Laundries walked right to where he left his bags. They knew where he was. They are dirty in this. Their son isn't here to answer questions and take his punishment, but they are. They are an accessory after the fact.

It’s 2am, in Lancaster, England and I am (as you can see by my comments) beyond angry about these dirty laundries, they blocked Gabbys parents attempts to contact them. The parents went to the laundries house and even though they were at home, they refused to answer the door, they are hard faced criminals, I hope they get 50 years each. Do you Americans really want slugs like these in your society?

There is so much suffering for the Petito parents. My heart goes especially to Gaby's mother. Her face is torn as she is reliving her daughter's plight. How indecent is the absence of the Laundrys' parents !!! Such low moral son, such cowardly parents.

I actually appreciate the argument of the defense lawyer. We always have to protect our constitutional rights. Even if what they did was reprehensible the question is was it illegal. I'm glad that we don't just so easily move within the law that it is pounded out and argued out as it should be because it really affects all of us in the end all of our rights.

So for example, if your son goes and commits a massacre, kills people, and gets to run away back home. His parents can exercise the right to remain silent in order to protect their son if they choose? How would that not be an accessory to the crime, by protecting the killer? Brian had just killed gabby, his parents knew and were protecting him by keeping silent. I just don’t understand this loophole for the crime of protecting a criminal. Didn’t they incriminate themselves by protecting their murderous son?

The Laundries should be made to be present - cowards that they are - if this had been Brian who Gabby had killed and did what Brian did, they’d be doing the same thing… they are horrible horrible people and should be present in the court. They should WANT to face their accusers if they are innocent of any covering for their so-called son.

Playing devils advocate. I would argue Bertolino's statement "On behalf of the Laundrie family it is our hope that the search for Miss Petito is successful and that Miss Petito is re-united with her family," is not misleading. The search for Miss Petito was successful and she was reunited with her family. The statement does not indicate found and reunited alive.

Don't we have a right to not speak to someone, even if were not under criminal investigation? I'm not charged with or being investigated for any crime, but I still have a right to not speak to the lady standing behind me in the line up at the grocery store. Fact remains if they knew, they made an INHUMANE decision not to tell those parents where she was. The whole world was looking for that girl and they knew and chose not to say anything to anyone for that matter. How could one mother do that to another? It's SICKENING and shouldn't be acceptable one way or the other.

The FACT that the Laundrie's protected their son KNOWING what he had done is CRIMINAL and they are CULPABLE in the murder of Gabby. PERIOD. Whether any court finds this or not, they are CULPABLE and should be so ashamed of themselves! What is clear is that the rotten apple did not fall far from that rotten tree!!!
