In a criminal trial the jury is forbidden from drawing an inference from invoking the amendment. In a civil trial they may and will as there is no criminal liability at stake only money. If you remember the Cosby trial and reversal by the Pennsylvania Supreme Court you will understand. In his civil trial Cosby confessed to drugging women then this confession was used as evidence in the criminal trial at which he was convicted. The Pennsylvania high court declared the confession inadmissable in the subsequent criminal trial as Cosby had been denied his 5th amendment right and threw out the conviction. Whatever we may think of the result the court's decision was correct. The prosecution had overreached and Cosby was released.
