The guy was pointing out how unrealistic/not legal the Sergeant at Arms arresting the AG is. Plus, previous AGs, including Barr, did the same thing and none were arrested. The guy was the only rational person in this whole discussion. Tim was saying ridiculous things like “you do not have a country” unless the AG is arrested because Bannon was jailed for allegedly the same thing. That’s patently absurd. Whether or not the AG should be arrested (I disagree that the circumstances are the same), making extremely hyperbolic comments like that are silly and make Tim look like a lightweight.

Second of all, realistically, any attempt to arrest and charge him would have to be done through the DoJ after the courts (SCotUS would likely grant certiorari) hear the case. There are separation of powers arguments here. Since you are an attorney for the Idaho CoA, please cite the legal authority (statutory and/or case law) giving the Sergeant at Arms the authority to arrest the AG and explain why you believe the separation of powers arguments would be disregarded. Furthermore, what makes you believe the AG/his FBI detail would allow the Sergeant at Arms to arrest the AG? It is completely ludicrous and nothing more than a political stunt by Luna.

@Marine0451 Hur, a Trump appointee, said that (mostly to smear Biden) and right-wingers cherry-pick that part of his report, intentionally, and ignore the other reasons for Hur opting not to recommend prosecution. The major reason prosecution wasn’t recommended is based on likelihood of conviction which would be very tough because Biden was found with classified documents while legally allowed, as the president, to possess them (unlike Trump who was caught red-handed). To convict Biden, the evidence he had them in 2024 doesn’t prove anything criminal on its own (like Trump’s situation does). Prosecutors would need evidence beyond a reasonable doubt that he had them between 2017-2021. In addition, prosecutors usually look for willful retention by people who were in government and had the authority to possess them at one point. It is pretty clear Biden had them and forgot to return them (at least initially). They go after people who they have evidence took them right before leaving office (goes to intent) and who, when asked to return them, lie about what they have, only return some, and hide the rest. The close call (Trump’s is a very egregious example) is Pence not being charged since he wasn’t the current VP when the documents were found at his house.

They say that we don’t need the audio recording because we have the transcript that tells us everything. But if the transcript is everything from the audio recording then why isn’t it being shared? If they are in fact the same completely then hiding the audio recording serves no purpose. The fact they are fighting against turning over the recording tells me that it is different than the transcript.
