The Drowned And The Saved was a great way to wrap up the Governor Shalvoy storyline. Sam Watterson really digs deep into this one and I still love Cutter's talk to Shalvoy. "I'm not Jack McCoy". Epic!!!

Spousal privilege doesn’t prevent one spouse from letting the other spouse testify, it only prevents the state from compelling a spouse to testify against the other.

I thought it protected either party, gave them a reasonable expectation of privacy, regardless of the other spouses choice to testify or not, but I could be wrong for sure

Spousal privilege does give a married couple the expectation that their private conversations can be kept secret and not be dragged out into the light by the state, but if one of the spouses wants to shine the light on their private conversations they are free to do it.

Couple of thoughts: 1. McCoy’s “Drowned and Saved” monologue was one of his finest moments on the show. 2. The Shalvoy storyline was up there with the show’s best season-long arcs, up there with Van Buren’s cancer storyline and Schiff’s election arc. 3. Tom Everett Scott and Alison Elliott were brilliant as the Shalvoy and Rita 4. Did the elf keep her tiddies? 😂

Love the storyline, appreciated what a principled justice system could be no matter how idealized in fiction. But only realization I have is, if this happens in one of the most progressive country in the world, it is saddening for the rest of the globe in similarity. Path of Least Resistance, I doubt any person in public office will follow through what the protagonist did.
