Need more context. Are they controlled by different players? Then no problem.

Since it's a Legendary Creature, one would have to go as per the legendary rule. If it's on the control of the same player that is

Two players can control the same named legendary creature on their own boards. the "Legend Rule" only applies if a single player controls 2 copies of the same legendary creature. Unless of course they have a card like Sakashima of a Thousand Faces, which states the "Legend Rule" does not apply to permanents you control.
