As far as we know, he's an unnamed NPC designed to fill a trailer spot. I doubt anything more will come from this but I'll be surprised if Rockstar does go further with it.

By not using the real names, they are infinitely free to make fun of all car brands and the types of people who buy and drive them(Read the descriptions of every car on the in-game website, they're hilarious) Because GTAV is a comedic parody of American culture. GTA's are essentially at a South Park level of making fun of everything... just in 3D. This is why South Park have called their lawyers up to 40 times on an episode before, that was 10 years ago-ish. As well as the legal disclaimer that they made and put befor their intro, something the network doesn't do, they just disclaim the age ratings. What South Park's disclaims, additionally, is that "All characters and events in this show - even those based on real people - are entirely fictional. All celebrity voices are impersonated… poorly. The following language contains coarse language and due to its content it should not be viewed by everyone." This is something they NEED to do if they're going to directly attack a real individual, company ect.

Tattoos are adjusted enough to not resemble him. Facial tattoos are not uncommon and many character creation system games have these options for facepaint/Tattoos can break out a list only to solidify this argument. could also argue that if inspired by his mugshot, he has no intellectual right to that property since all works made by federal agencies are automatically part of the public domain. Can even say Rockstar made it a big deal to not include such things that are specifically tattoos on him as they could violate DC copyrighted content since his look is also inspired by DC. only making them legally smell much sweeter than his argument. guy can scream till the cows come home, but like Southpark lawyers; his lawsuit is gonna probably end like Billy Micheal when he sued "Regular Show" claiming they used his likeness without permission only to lose that case months later.
