What most people fail to understand is that if normal, decent people are allowed to defend themselves from criminal activity, that activity will diminish simply because the criminals know what will happen if they commit their crimes. Criminals are not (and never have been) afraid of laws or the police. They Are, however, afraid of being killed. Common sense.

Well said. When I see or hear about people invading homes to burglarize or rob, etc... I am a Texan born and raised, and here (at least in West Texas/the towns where they haven't become Cali-copies) lots of civilians own firearms, are legal concealed carriers (now we have open carry with no need for license as well), many have the mentality of defending themselves and their family and property (also it's legal to do so without retreating), and it is well known that this is how it is, so I've always found it that someone who has been living here in Texas and knows all this information and _still_ decided to invade homes, burglarize, rob, vandalize property, etc... Knowing that most of these residences have people in them with guns that are willing to shoot them, yet _STILL_ do it is such a _STUPID_ idea! I can't wrap my head around what makes people think that they can get away with such things knowing so many people are armed and if this person get shot and killed, the rightful, legal, defender will most likely walk free (I'm sticking to in the event self defense was done properly and within the legal criteria). That's like, intentional, indirect suicide. Even criminals who break into cars in public areas like downtown and parks and parking lots, or criminals who mug people on the streets... They must know that more than half the people out here are carrying with intentions to use deadly force if need be. That being said, if someone is stupid enough to do such things in places like here... And they get shot and killed or maimed... Play stupid games, win stupid prizes 🤷🏿‍♂️

Here in Florida our castle doctrine law is one of the most precious freedoms besides the right to carry we have. It is very reassuring not to have to be afraid to defend yourself or your home from scumbag criminals.

Love living in Missouri we have the castle doctrine law (stand your ground). We can also open carry and conceal carry. (Without a permit) A lot of people call us hillbillys, but we love our familys, GOD and GUNS.

Last Tuesday as I was leaving a gas station a man followed me down the road. I felt like he was following me, and so I turned around because I was afraid of him following me home. He continued to follow me. I cut into a nearby neighborhood, he followed me, I sped up, he sped up. I get to a red light, look in my side mirror and see this man get out of his car and approach my car. He came and punched at my window and was trying to open my door. Keep in mind, I did nothing to warrant his attack. I pulled out my pistol, showed it to him because I was on the brink of shooting him had he gotten through because I was blocked in between a bunch of cars ahead of me, but he backed off in an instant. But by the time he could even step away from my car, a man in a work truck who was stopped beside me at the red light had gotten out of his truck and stuck the guy in the jaw from behind. Women should carry guns on them everywhere they go.

Amen Jennifer. Women SHOULD carry guns period. All of us should be able to for self protection. I hope you live in a state that respects self protection. "A strong body makes the mind strong. Amen. Texas is better than California , that I can say personally, since I live in California and in Los Angeles, no one is allowed to open carry or conceal carry on foot. No wonder why there is so much crime in this county. Since no one is allowed to protect themselves and the criminals will have their way. I had a guy high on methamphetamine approach me late at night at a small town gas station..... he was watching me and acting suspicious in the store..... I bought what I wanted and went to my car..... he followed me to my car at a quick pace and got between me and my car door issuing threats. I had a smith .38 revolver in my waist band.... I backed away while lifting my shirt to show the weapon, I never pulled it.... he ran around to the side of the building.... The gas station owner said this man had been a nuisance.... no telling what this idiot was going to try..... I thank God every day that man didn't make me defend myself.... I carry daily but hope I never have to use it.

I work from home and I had a guy knocking on my door persistently in the day time. I live in a rural area and I didn't know this guy who I could see through the window. I went to my bedroom and got my handgun and waited in my bedroom and heard him enter the house. I confronted him in the living room, gun drawn, and he ran quicker than I ever saw someone run. So fast he ran that his cap fell off on my porch. Just the gun was enough to make him retreat. I am glad he didn't charge me and force me to kill him.

Barry was right when he stated that in old British law "an Englishman's home is his castle" this did indeed transfer over with US Independence and become a basic component of US law and so it should be.

Unfortunately here in Massachusetts we have "criminal protection laws" as I like to call them. It's disgusting. If someone breaks into my home in the dead of night, I am supposed to basically hurl myself out of my 2nd floor bedroom window and run away. If I defend myself, my family, my home, or another person from imminent threat to life or great bodily harm, I will go to prison, no questions asked. But I will gladly sit in prison to know my family is safe. Great video as always guys. Barry is missed greatly!

I personally was taught about respecting a gun and what it is capable of from the age of 5. I think if more people respected guns instead of fearing them we would have a lot less accidental deaths from guns. Guys keep up the good work. The world can use more level headed and common sensed people like y'all.

I say a prayer everyday before I holster.Then check my weopon .I will stand my ground for anyone in need not just myself. This is a thought we have to be firm on there is no time for hesitation .

One common myth about the Castle and Stand Your Ground laws is that they apply ONLY to a threat against your life - defending yourself against a person with a firearm or similar. That’s not true. You can defend yourself against assault as well. All such laws contain provisions for “serious bodily injury.” In other words, any situation where you might be seriously injured, by a perpetrator with or without a weapon.

castle doctrine would not have applied to the OJ case even if it was law at the time in the state because he was found not guilty of straight up homicide. Self defence never entered into it.

Florida law enforcement vows they will not enforce laws that violate the Constitution or infringe on the rights of the people to own firearms. florida, the gunshine state :P

Massad Ayoob’s Five-Point Checklist 1. Tell responding officers “I’m the victim; he is the perpetrator.” 2. Tell responding officers, “I will sign a complaint.” 3. Point out pertinent evidence. 4. Point out any witnesses who saw what happened. 5. If there is any hint that you are a suspect, say “Officer, you will have my full cooperation after I have counsel here. Mas has been involved in a lot of trials and is a seasoned expert witness in justified homicide cases. No one knows everything, but I'd tend to give his advice some credence.

Yeah, you should go point that out to Mr Ayoob, I'm sure you know more about it than he does. Please get on that and tell us how it turns out..... You're aware he's one of the foremost expert witnesses for justified shooting defense, right? He has participated in many cases, and gives explicit examples of why your advice is bad advice. *I* have no personal expertise here, but Massad *DOES* - who are you?

Well as I said, I have no personal expertise, however Mas *IS* lifelong law enforcement and has been instrumental in SPECIFICALLY this precise facet of the law as an expert witness and consultant. If you read his explanation, complete with case studies, you'll see why he stresses the importance of not allowing the other party to set the narrative and so on in the first minutes of the investigation. This is not based on his speculation, it's based on actual cases that went sideways because the justified shooter took advice like what you just repeated. Instead, he says to limit your interaction to the 5 small points above, point 5 of which is "I need a lawyer". So it's "I'm the victim, he is the perpetrator, I will sign a complaint, that guy saw it, here is the knife he was holding, I wish to cooperate fully after consulting with my lawyer."

It's good to note that Mas is absolutely *NOT* promoting the idea that one should be a chatty cathy, in fact the advice is to stick precisely to the script, and then shut up. No commentary, no banter, the script and zip it until your lawyer is there.

There has been cases were evidence was missed and later found resulting in someone being acquitted. If I ever have to go through something like that I’m making sure the cops know where all the evidence is.

You got the crux of the law correct and you guys are the first I've heard understand the support for this concept. Absent the commission of a crime all Americans have the right to be where they are at. Some states recognize this except if you have to defend yourself--then they pretend they are not aware of this right. Lots of folks are in prison for non crimes because of corrupt prosecution.

In Missouri, no matter what the situation is, unless they are actively attacking you with lethal force or have crossed your threshold, you cannot use lethal force. If you have "No Trespassing" signs, threshold rules can change to property lines (sometimes). Never shoot them in the side, back, or if they're on the ground, or they will not be considered a threat. I know of an old woman (70s or 80s) who was sued by a man who was kicking down her door. She fired through the door and injured him. She had given him warning. I personally know a man who was attacked by a boy (around 18yr old) in his home. The boy charged him with a knife after being warned several times. The man didn't want to kill a kid and shot him in the leg. He was sued for medical bills and tens of thousands of dollars for causing bodily harm. Unfortunately, the law makes it to where you have to kill them. Don't panic. ID your target. Aim for the chest. Fire.

I'm not going to comment on the law because I'm not from there. But if someone has a firearm it doesn't matter if they are turned away from you or on the ground they could still very well be a threat. Its completely situational. As for shooting someone, you aim to stop the threat not to kill. And center mass seems to be the best option.

In Mississippi you can use deadly force to prevent any felony upon yourself, another person, and your property. There have been several shootings in my area where home owners have killed people they caught breaking into their vehicles and the DA didn't even try to bring charges.

i live in maryland, Now we have a stand your ground law. Thank god. I have a maryland state carry permit. It was very hard to get. maryland is one of them states where its hard on gun owners. Iv had a carry permit for years and years now, but just recently has it been okay to use deadly force when the time comes! Not that it would have stopped me anyway. I would have still protected my family or me no matter what i had to do. If the situation called for it.

This video parallels what me and some friends were talking about. And my reasons to "if someone brakes in and just wants to steal your stuff what do you do?" I said "in my situation let them take all they want that's why I have insurance, but the second they start coming upstairs (which is where the bedrooms are)I'll be perked up at the top of the stairs, I'll turn on my weapon light and destroy anyone willing to come up them.

The Castle Doctrine originated in Rome and was established in law in England in 1628. The colonists brought that set of legal principles with them to America.

Well said guys. The only thing I would add is that if you have to use "deadly force" never,never,EVER give a statement to authorities without your attoney present. Even if you have to wait in a cell until a PD is appointed. Remember, ANYTHING, you say CAN and WIll be used AGAINST you.

I'm a 16 year old almost junior in high school planning on owning a gun when I turn 18 in the state of Ohio or possibly South Carolina so I looked up the gun laws of both states and then saw the section on the NRA's website about the castle doctrine and was like what the hell is that and googled it and I now realize I didn't have to I just had to watch this episode by the way love this series so far I subscribed a "wee bit" late but I like your guys's channel hope it grows in popularity with the gun group in America while I admit there are some really stupid gun laws in America

I have a carry conceil in Ohio. When I took the class 7 years ago, I was told you can't shoot an UNARMED intruder in your home. If they are armed, and you put more than 5 shots in them, that's called excessive force. I have yet to find anywhere on the castle law that says you can shoot an unarmed intruder. You don't have the obligation to retreat. I know a man who injured an unarmed intruder in his home with a bow and arrow and spent 6 months in jail. That being said, I disagree with this BS. If someone is stupid enough to break into a home unarmed, they deserve to get shot. Unfortunately, it boils down to who has the better lawyer. Or who has the most to loose.

It's true that if someone comes into your home, with a weapon...especially a gun, put them down. Obviously if the person surrenders before you can even pull the trigger it's not right to just execute them. However, the great thing about our nation is that if you break into any PERSON'S house, you need to be aware they might just have a shotgun or a nice handgun waiting for you.

I live in Muscatine and paid $60 for a class at the local gun range. After the class, we got a certificate to take to the sheriff's office and paid (I believe) $50 for a carry permit good for 5 years. Took about a week to get it. When the permit expires, it's about half that price (or less....don't remember) to get it renewed. This was back in December of 2012.

To Barry and Erick, As a Former Texas Corrections Officer i agree with you on the not shooting in the leg etc. for one big reason, i was a Tower Officer for a bit, they teach you to shoot center of mass for a reason, if you can hit the head or the leg consistently, the courts assume you have the skill set to hit them in the leg and disable them. That said it opens a legal hell storm the likes of which you never want to see period in civi, life.

I live in Massachusetts, the last time i read up about laws on defending yourself in your home. Is that if someone breaks into your home, you, and any other people in your home have to retreat to the farthest room of your home from the assailant, lock your door and say that you are armed, then deadly force is authorized if the assailant proceeds and has the intent to cause you bodily harm.

Hey guys, the Castle Doctrine didn't apply in the Simpson case for two major reasons. First, the Castle Doctrine is a self defense argument. O.J. wasn't using self defense as a justification for homicide. He was claiming that he did not kill anyone. More importantly, the deaths didn't occur in O.J.'s home. He was accused of murdering his ex and the other person in her home, thus no Castle Doctrine. He did it BTW...plenty of direct evidence, shitty prosecutors and a racially biased jury resulted in his acquittal.

Have you heard the saying if the glove does not fit you must acquit? the bloody glove found on oj's lawn was the strongest piece of evidence and it didn't fit him so he was acquitted.

I can't tell if you're serious or not. But, just in case you think he didn't do it because the glove didn't fit, try this; Take a pair of leather patrol gloves that fit, soak them in any liquid for a few seconds, then let them dry completely. Once dry, try to put them on without a struggle. Can't be done until the leather has stretched back out sufficiently and become pliable again. Any uniformed LE officer or motorcycle rider that has been caught in a rainstorm will agree. Now take a pair of leather gloves that fit, and try to put them on over latex or rubber surgical gloves...it' nearly impossible to get them on without a serious struggle. Especially if the were wet and allowed to dry off the hand (see above point). This leads me back to the point I made in the first post...incompetent (shitty) prosecutors. Any decent prosecutor would have objected to having the gloves tried on in the first place. If it was still allowed, then they should have had the City of LA pony up for 12 pair of light leather gloves that fit the jurors, and conducted the experiments stated above. Sure it would have cost a couple hundred bucks and taken a full day to do. But it would have completely negated the "if it didn't fit" defense. Viola!..a free trip for one to Death Row. The glove had O.J.'s DNA (dried blood) all over it. A fact that was overshadowed because the prosecutors were to stupid, lazy, or out-classed to nullify the "it didn't fit" bullshit.

ma8rk The reason OJ was acquitted was because the defense team proved that an anticoagulant chemical was present in the blood found on OJ's car and property. That anticoagulant was used to line the test tubes used to collect blood samples. When blood samples are taken, anticoagulants are used to keep the blood from thickening to a gel. The only way for the anticoagulant to be present in the blood found at the Simpson property, was if the blood had been transported there in a test tub containing that particular chemical. I don't know if OJ did it or not, but clearly the horribly corrupt, LAPD was eager to make it look like he did it. Together with the proven racist cop, Mark Fuhrman, who had openly bragged that he would plant drugs on black men he caught with white women, made an acquittal the right call. Remember it was Fuhrman who found the "bloody glove" on the Simpson property.

Justice Cardozo established the castle doctrine in a 1919 Supreme Court opinion, stating, "It is not now and never been the law that a man assailed in his own dwelling is bound to retreat. If assailed there, he may stand his ground, and resist the attack. He is under no duty to take to the fields and the highways, a fugitive from his own home…Flight is for sanctuary and shelter, and shelter if not sanctuary, is in the home."

Gammareign "turn the other cheek" is often misinterpreted, as have you. It simply means don't be quick to anger or escalated a situation.... it doesn't mean you have to be a punching bag or victim. In fact, (gospel ofJames I believe), knowing he was going to be "arrested", Jesus Christ himself told his deciples (knowing they would be in great danger), that, whoever had a sword keep it with them, and whoever didn't, should sell whatever belongings they needed to in order to BUY A SWORD! (paraphrasing of course)

When someone shows aggression, just fall to the ground. This makes it really easy for forensics to prove it was self defense if they attack on top of you.

Love your vids, but man you guys are way off base when mentioning Simpson. For starters, castle doctrine or stand your ground laws are ONLY introduced when a not guilty plea is entered on the basis of self-defense. Even mentioning Simpson in this video shows me that you guys should do a little more research before some of your topics.

As always, I appreciate the videos you put together. A couple of things require clarification re: castle doctrine and duty to retreat. They are different legal doctrines. 1) castle doctrine only applies to defense of habitation, with an exception for co-inhabitants. 2) duty to retreat (or no duty) applies to the concept of stand your ground laws. In order for this to apply, it must be statutory. Thankfully in GA it is. ( O.G.C.A. § 16-3-23.1). One thing to look for is what is known as the

Always remember something else: a jury is also allowed to determine whether a law itself should be applied to a particular situation. Judges and lawyers often don't tell juries this anymore, but a juror can always question the law itself and the applicability to the situation. Don't let a judge tell you that "you MUST find guilty if you find X" or any other such baloney.

The last thing I want to HAVE to do is have a duty to retreat. Though I cant stand my ground in my state, if I'm in bed and an intruder decides to break in, it's nice to know I can defend my keep and my family. It's nice when the law works for you for a change...Great work guys!!!

if you blow someone away, cops will want you to give a statement right away before you have a chance to collect your thoughts, in hopes that you will say something incriminating, if you blow someone away, tell people you have chest pain and go to the hospital - you are now an medical emergency and will put a screen between the cops and you and give you some time to collect your thoughts so you can testify with your head instead of blurting stuff out of emotion and shock if someone is messing with your car, press the car remote and the car will blow its horn and usually they'll take off, this way you can distract them while you call the cops in safety

Good point. I have been through an experience like that. It was a very scary thing.I had a young man try to come through my garage window and it was 3 in the mornig.I used my training from my father and military as well.I gave a loud warning, in which, the person ran off after that. I ran to get my firearm,as well as wake my parent's. We called 911 at 3:03, the first police officer arrived at 3:08. I live in a small town of 4200 people, NOW DO YOU WONDER WHY I have guns, first hand account here.

A local lawyer explained to me that if my yard is fenced in, and someone breeches that "Clear Property Line", "Trespassing" sign or not, I can legally hold them where they stand at gunpoint and if they continue to move in MY direction whilst on my property, that I am able to claim a "Show of aggression" on the grounds that the criminal continued even after threat of force was issued, and use deadly force to "stop the aggressor" Other states may vary, but in FL, protecting your property is legal

Awesome explanation of Castle Doctrine and SYG. It should probably be noted that if someone is pointing a gun at you and wants your wallet, it is much safer to give up your wallet than to try to beat them to the trigger. Just because you CAN legally shoot someone, does not mean that it is the best option. Remember, it costs a fortune to defend yourself in court, no matter how justified you are...

Just in reference to the UK, for your own interest/humor.... Self defense is all but banned. 2 reasons i say this are as follows. 1. A pop star was chopping vegetables in her kitchen and some dudes were in her yard and started looking at her window, in shock she waved her knife at the window. She got arrested for that. 2. a man was trying to break into a house. As he was walking across the plastic roof it gave way and he fell through and injured himself. He then successfully sued the home owner

As a criminal Justice student I want to clarify that these laws are actually legal defenses. Under self defense, defense of property, defense of habitation, etc. you will be arrested and can (prosecutors can decide not to prosecute) go to trial. Also if the jury doesn't believe you or you don't fully meet the requirements of the defense you can still be sentenced.

constitutional carry missouri means if you legally can buy and own a firearm you can carry it concealed, it does not offer reciprocity for CCW in other states like a permitted CCW holder. However in Missouri and other states there is a stand your ground law called CASTLE DOCTRINE which we have recently expanded to include friends and family members that can access your firearm with your permission can "dispense appropriate force if you are not able to and/or they notice the threat before you do." all that being said in Missouri if you legally own it you can open carry or conceal carry with no permit legally.

I agree. Good priorities, like family first, are fundamental. When talking tactics, vs strategy its good to focus on what you know about the situation, and legally that is were all the difference between a justified shooting and criminal or civil action matter; totality of the circumstances.

I live in missouri and our castle law states any where you reside us defendable by force it doesn't matter if its your house car neighbors or hotel room. Also the minute someone enters your home uninvited weather they have a weapon or not they are considered a threat and use of force is legal

Thank God they reinstated Castle Doctrine here. It's also nice to see people packing if they choose open carry around stores and restaurants. I'm not religious per say, but God bless the Constitution and all our good gun law states.

I'd love to see you review in plain English the latest Ohio gun laws, "Stand Your Ground" , "Castle Doctrine", & especially the latest , no permit required "Concealed Carry" Laws. Unfortunately, I was in the hospital when that law was past, but I understand that a permit is no longer required for a CCW Permit in Ohio, so I missed the bulk of the law at that time!! From what I know, even with Constitutional Carry you cannot be within 1000 feet o f a school. So, pick your routes wisely going to the range.

I'm from Southern California and it's pretty much very very hard to get a concealed carry permit if you are living in Los Angeles County or Orange County. If you're living in San Bernardino County, it's pretty much easy to get a CCW and also the wait is not that long as well.

OJ Simpson is an absolutely horrible example to use in relation to the Castle or Stand Your Ground laws. He was the vicious murderer, not a victim attempting to defend himself. None of these self-defense laws, nor the protections against prosecution or civil suits therein, would apply to him in any way whatsoever.
