Where I live in TX, we have what is called the 51% rule that says that if an establishment earns 51% of its revenue from alcohol sales, carrying is prohibited. I can argue that is unconstitutuonal as well but it's a lot better than what this man just experienced in CA. Also, the alcohol limit for legally carrying is the same as for legally driving. This is yet another example of CA going out of it way to prevent people from protecting themselves, the Constitution and public safety be damned.

Years ago, a woman was eating with her parents at a cafeteria in Killeen Texas. Nutcase starts shooting up the place, and the woman had a gun, but it was in her car accordance with the law at the time. Both her parents were killed at that Lubys, and this woman's efforts with the Legislature eventually led to changes in CCW statewide.

I remember that. She wasn't allowed to carry where they were for some reason, and if she did anyway she risked losing some sort of professional license (I think she was a doctor or chiropractor). Worst part is the scum bag ran into the bathroom and offed himself when police arrived. Society didn't get the comfort of the system stopping him.

We need to put in place a law where if an establishment wants to remove your right to protect yourself, then they take on the legal responsibility to protect you. This way if something happens, you or your family can sue the establishment for not having adequate security to remove someones rights. There should also be an expectation that everyone is armed and their rights continue up until they enter your establishment. This would me they will need the adequate security to store your weapon while your rights are being violated. Put all the cost on the gun free zones instead of on the responsible citizen.

I live on the Washington/Oregon border and no longer follow CCW rules when crossing state lines because keeping my family safe is far more important than being a good boy and following unconstitutional laws. Luckily it was only a smash and grab experience for me that opened my eyes. Being a victim once, I proudly break those CCW border laws now...

My son worked at Kennywood amusement park with a no weapons policy posted and patrons were searched at the gate…..gang members snuck a firearm behind one of the perimeter fences and a huge shootout occurred. Fortunately he was not at work that day! It is a shame that the most violent occurrences take place in these “no firearms policy” types of places.

Rule of thumb, if I'm not legally able to carry somewhere, I simply dont go. If there's a sign on the business restricting my rights I spend my money elsewhere. Stay strapped, stay frosty, stay dangerous!

I am a former USMC combat veteran in Vietnam and have CCWs in 44 states except California where I live I have competed all the legal requirements and have been waiting over one year for LASD to interview me. So I’m not allowed to protect myself or my family or fellow citizens just as this Marine could not do because of The California State regulations.

Here in Texas, I never leave home without my sidearm. Even before open carry, I still carried it with me. It's sad what this Country is becoming because of the people who just do not understand the importance of carrying for the sole purpose of protecting innocent lives. I am not sure how you were able to obtain CCW's in 44 states, but would love info on that. I have PA and Florida and have looked into what other states would give me more reciprocity and there are none.

I actually got denied my CCW in Placer County. Before I tell you their "reasoning", I'll tell you what I think they denied me based on. I believe I was denied because I wore a beanie to the interview (my hair gets in my eyes, surviving transplant patient and I've worn one since, shouldn't even matter!), as well as the fact that I'm a security guard. Cops hate security guards, we all know this. They just hate them and it's a fact. They also hate poor people. Now here is their reason. They supposedly denied me because they "felt", yes "felt" like I was lying about why I was suspended from my job. I told them at the time I didn't know, which was true. Nor did I care to find out. My job emailed the suspension to me, and I was over that job, so I didn't care. He told me to give him my best guess, so I told him disagreements with a supervisor. That was true. I offered to look at the email while in the interview and show him, which he declined! That's how I know it's all bs.

Carry anyway. You have no duty to obey unconstitutional laws. In fact, having sworn the oath, you have a duty to uphold and defend the Constitution, so bearing arms the way we were meant to can be argued to be part of that.

The point being made around the 8:30 mark is so important. My wife and I go out, and she will ask me, "Hey are you going to get a beer or something?" If I say "No", she automatically assumes it's because I'm carrying. Most of the time she is right. However, I leave it at home, or locked in the car, ya sure I will have a drink. Why not? For me going out, I'd MUCH rather choose to be armed than I would choose to have a drink. Both of those decisions are net-positive decisions for me and everyone else around us.

I live in Texas and though we dont have too many crazy gun laws ...the law that left this man unarmed in California ..Is also in Texas .......Texas law restricts the carry of firearms at places that sell alcohol. Bars that make more than half of their sales from alcohol ...So it's in Texas too The restriction on carrying a firearm in bars in Texas doesn’t just refer to traditional bars. It also applies to an establishment that earns more than half of its revenue from alcohol-related sales and consumption. In Texas, this is known as the 51 percent rule. In other words, the Texas Alcoholic Beverage Commission considers an establishment a “bar” if it makes 51 percent of its income/revenue from the sale of alcoholic beverages. It’s obvious that a bar is a place where most or all of the revenue comes from alcohol consumption. However, it can be difficult to clearly tell if a restaurant that also serves a full menu of food and nonalcoholic options is also a place where a firearm can’t be carried. This is why bars and restaurants in Texas display “51 percent” signs. These highly visible signs include “51 percent” in large red letters to further increase clarity. If you do carry a firearm into a bar or restaurant with a clearly displayed 51 percent sign, you could face some serious legal consequences. According to uslawshield.com, carrying a firearm into any establishment considered a “51 percent” place of business could result in fines of up to $10,000 and up to 10 years in prison.

@@nickabel8279 It's not about THINKING I can't mix the two. Obviously a single drink will not impair most people. However, it's that mixing alcohol and carrying is a quick and sure way to lose your CCW privileges. So I don't mix the two - simple as that. To me it's not worth the risk.

​@@PrimericanIdol Agreed. In my state, there is no limitation on carrying into a bar. There is however a legal limit on carrying while "intoxicated". If you are too drunk to drive, (.08) you are too drunk to be in possession of a firearm. Man must know his limitations.

If it wasn't for all of these darn mass shootings, I really wouldn't care to have to carry, but there's no way in heck I'm going anywhere in public without carrying these days because I'll be damned if I find myself helpless in one of these situations. One of the many reasons I am so glad I don't live in New York anymore because they got so stupid strict on firearm restrictions that it was nearly impossible to get a permit before I moved to a different state. How they think it is fair that good people should be vulnerable like this while the bad guys have the convenience of not worrying that their victims might be armed. Some of these states got their logic so backward and they think they're doing a good thing when really they're only hurting good people.

Mass shooting is not the only reason to carry a firearm. That exact though is was perpetuates the idea that firearms are a cause of only anguish. A firearm should be carried at all times. Not staged, not locked in some safe you have to speed run attempt your life but on you.

Honestly, you're 100% right. My family and I just went on a little 4 day trip where we were going to be laying low, but doing a few excursions around. Nothing crazy. Nice area, yada yada yada. My wife asked before we left, "Are you going to carry?" I said, "Shooting can happen anywhere. Why would our vacation be any different?" She always tells me that she feels better that I carry.

I saw a guy in the upper parking lot trying to unlock a pistol case and due to stress he was fumbling badly. By the time he got the pistol out and loaded the sheriff's were on site. What I learned from this incident is that Commifornia gun laws make us unsafe. 😢

Cook's Corner is classified as a restaurant under the California Alcohol Beverage License Control Board search. Primary purpose is food sales with a "portable bar" secondary license. Many local residents are unaware of this. For those in OC, always check the website and carry where you can - I pray for those who lost their lives in this tragic shooting. It was too close to home

I, too, am a ccw holder in Orange County california and wanted to add this: My trainer told me that, as long as they serve more than pretzels and nuts, you can carry. But - you can not drink.

In 1965 after 2 years overseas, I was waiting for my ship at the Boston Navy yard. I had no idea that a gang war was on. I was in a Charlestown bar when a gangster started shooting at a guy behind the bar. I was standing right beside the shooter. Suddenly, two cops were holding him and banging his arm on the bar. I heard more shots while going out the door. Two other sailors who were there, told me it took about 8 Boston cops to get the pistol away from the thug. You never know what you might be walking into.

I'm up in Missouri and we're extremely pro gun, almost as pro gun as Texas. And even we have that ridiculous policy on not having firearms in a bar. I really think it needs to be that you can bring a gun into a bar but no alcohol can be in your system while carrying. I think that would be a great compromise.

We actually have that very law up here in Minnesota. They even allow you to drink while carrying so long as you keep your BAC below 0.04.

I can argue that is unconstitutuonal as well but it's a lot better than what this man just experienced in CA. Also, the alcohol limit for legally carrying is the same as for legally driving. This is yet another example of CA going out of it way to prevent people from protecting themselves, the Constitution and public safety be damned.

I used to go to Cook’s Corner occasionally when I lived in Rancho Santa Margarita, which is about four miles away. The food there was awesome, particularly their bacon double cheeseburgers. You’re correct, the term “bar” can be used rather loosely. The place had a really nice “family “ atmosphere. It was frequented by bikers, young families, tradesmen, military (mostly Marines), and locals who just liked to hang out there. I was sad to hear that something like this happened at a place that I loved to go to so much. Now, it has a permanent stain left on it thanks to some wack-a-do. To the Marine who was in this video, Semper Fi from an Army veteran, thanks for your service to our country, and I’m so glad that you made it out of this terrible situation physically unscathed. I know the mental part is another story. I’m surprised that you were able to find cover there, because there really isn’t much. You made some really great points in this video, and you are correct.

In Texas, we have the 51% Law, with the applicable warning signs for Bars, and separate Bar areas of restaurants that serve alcohol "by the drink" !! Neither permitted nor permit-less carry is allowed by State Law beyond the posted signs !! ALL signs that prohibit permit-less carry, permitted carry, or both, must be conspicuously posted OUTSIDE of EVERY entrance to any/every business that wishes to prohibit, or is LEGALLY REQUIRED TO PROHIBIT the carrying of firearms within said business !!

I was caught off guard just the other day giving a friend a ride home from work. My piece was in my bag in the trunk because i packed in a hurry to go home after, and by the time i noticed what was happening i could only watch in what felt like slow motion. Luckily the assailant aborted last second due to high foot traffic but i could see he was about to produce a weapon and target me and her. Stay vigilant! Stay ready! Always!!!

Live in Arizona, bars here can allow firearms into bars. Happened around 2007. The news etc. Said "all the bars in Arizona will be killing fields" etc... Well 2023 now and almost never is an issue. Also I go into bar/resuraunts armed ALL the time, haven't drank an alcohol since 2000. (not AA) just a life choice so I love being able to carry in these places with my family.

As a Northern CA resident and CCW holder. My local sheriff (that does his own CCW interviews) told me that we are allowed to carry inside an establishment that you describe in this video as long as we are not sitting up at the main bar area. We can patronize the establishment as long as we are not consuming alcohol while carrying. I wish all sheriffs felt that way.

My dad told me when I was very young, yes you will be arrested if it’s discovered your carrying while standing/sitting anywhere near the bar area and drinking. However, if you sit at a booth or in the areas with tables away from the bar sipping a beer, the authorities might take it as frowned upon but you are safe from his understanding. It’s once you walk towards any bar area you’re SoL.

I'm an LTC (License to carry) holder in Texas. The law here on that is if the establishment earns 51% or more of their revenue from alcohol sales specifically for 'on site consumption', you cannot carry a firearm. It is called a 51% establishment. I only commented because he mentioned that it would have stopped inside if it were in Texas. I don't know the specifics of the establishment that this happened at, but I'm not so sure you could carry in there if it were Texas. God Bless the victims and their families.

I’m a former Desert Storm Marine in Michigan with a CPL. In Michigan you cannot carry in a place that makes 51% or more of alcohol on premises. First off these are the most places I want to carry. Secondly, there is no way to know if the place is legal or not! How is that enforceable? Exactly as described in this video! It’s crap!

Even here in Texas if the place is listed as a 51% astablisment you may not carry. Alchohol and firearms don't mix. That said if the place have a "restaurant" area you can get away with carrying in that area if you do not drink. That is a winnable arrangement here in Texas.

It should be based on whether someone is drinking or not (and whether they are intoxicated). I'd probably be ok with a restriction that goes as far as not being allowed to carry if you're consuming alcohol in a bar.

@@MrTheDif I get that. There are still places that just don't need any firearms to be in. Nightclubs, shoe show clubs and the like just don't need anyone in with firearms. The local watering hole when the person who is carrying stays dry can be a good thing. It would have stopped this one a lot sooner.

Also in Santa Clara county our sheriff Laurie smith was charged for corruption. She would decide who gets CCW depending if they trade her an iPod or donate hella money so as an American citizen how are we suppose to react to this? The 2nd amendment was made to check the government when they infringe on our rights, it clearly states that government shall not infringe but look where we are at today. It’s a shame and sad that they don’t care or value human life, especially our children’s lives

I have carried my gun since the 1990's, I carried everywhere, church, supermarket, theaters, parks, schools, and even checked my weapon in at the airport and carried it at my destination. I always believed in having it and not need it, than needing it and not have it! It actually became a mindset. However I knew, no capital buildings, court house, federal buildings etc., but I carried everywhere. Now if they have a sign or policy or law stating I can't carry, I don't go there!

I have a bar near my work that no longer allows people to carry weapons into their facility. They even have a sign in the door that says so. I used to go there for drinks sometimes but will no longer choose to do so.

If your BAC is low enough to legally drive, you should be allowed to use a gun for defense. But if you do so, you better be able to show that your use of force was legitimate. Having said that, I myself don't drink -- but there are many places that sell alcohol but have really good food. I have also gone to a bar with friends and had plain old sweet tea while they drank.

California is a stand your ground and castle law. You can operate your firearms against another firearms attacker even while having a alcoholic drink. Your bac level for non intoxicated levels is 8% aka .08% meaning if you like budwiser its 5% .05% you can drink more then 1 12oz can

This is why I adamantly refuse to patronize any business that bans concealed carry. If carry in a type of business is banned by law I do not enter and if I walk up to a business that posts no guns allowed, I turn around and leave. The only place I cannot follow that is Doctor/Hospital visits or government business such as renewing registrations or driver's license.

Since I started carrying a year ago, my habits have changed in a few ways. The main ones being 1) I actively avoid any premises that openly expresses any desire to cultivate a target rich environment, and 2) I don't drink when I go out because I don't want to be in any unfit state to carry while I'm with family or away from home. In summary, I carry wherever I can when I leave home.

Oddly in Taxachusetts they treat carrying a firearm the same as operating a vehicle. You can carry as long as your BAL is below .08.

In New Mexico, I can’t carry in a school zone, at a post office, in the Bosque (a wooded area near the Rio Grande) since I am usually there as a chaperone for a school function, at a doctor or dentist office, and in a bar or restaurant that serves mixed drinks. In New Mexico, a lot of restaurants serve margaritas.

In some states, it's not just a rule, it's a law. Here in Ohio, they changed the law 8 years ago. Now, you can bring a gun into a bar, if you're not consuming alcohol. Going to constitutional (permitless) carry last year does not appear to have changed that law.

The same lunacy exists here in Florida. Just walking through the "adult section" (bar) of a restaurant with your CCW is illegal. So, a dinner at Texas Roadhouse means "go around " not through the bar. Smaller "oyster bars" make CCW impossible.

Counter to common belief, Texas has a 51% law that prohibits carry (open or concealed) in any establishment where 51% of sales are derived from alcohol. So, we take it further, not even policy, but is a law. And penalties are stiff.

One of the most valuable and challenging college courses I took over 35 years ago was utilitarianism, with an emphasis on Jerry Bentham and John Stuart Mill. Suzanna Hupp who saw her parents being murdered before her at a Luby's restaurant in a mall with a no guns policy forever regretted her decision to leave her gun in the car. Sometimes the greater good like the preservation of life requires violating lesser rules and laws.

I agree, and I also agree that drinking while armed may not typically be the best idea. However in this case it could have saved lives. But then I wonder, what would have been the consequences for you if you ignored the law/policy and were armed and stop the threat. Wouldnt the lesser of evils Prevail ? Or jail time

Growing up in the PNW absolutely every single hunting season at practically 75% of camps are fully stocked with rivers of beer & boxes of whiskey peppered throughout em all & I've seen dozens of people who have been successful earlier in the day get tilted in a celebratory fashion, I've yet to hear or read about someone accidentally getting shot. It is because of hunters safety is required to hunt in most if not all states in order to pursue any big game animal therefore you are taught at a fairly early age how to respect firearms fully as well as treat them all as if loaded regardless if it's real or a toy, never point at anything your not willing to shoot, last but not least at all times upto expected firing the weapon always keep your booger hooks off the trigger! 😉

Texas has the 51% law. If a place makes more than 50% of it's money from liquor sales it has signage saying so and can not carry in.

In Minnesota you can carry in a bar if your BAC remains under .04%. Cross the river to North Dakota and you gotta disarm before entering. Luckily restaurants that also serve alcohol (something like less than 30% of their revenue from alcohol sales) don't count as "bars".

I'm pretty sure the Florida statute allows impairment limits, the same as driving and boating. Also, it allows a concealed gun in the dining area of a restaurant, but not the bar area, and not in an establishment that is only a bar, without food, or limited food. Interestingly, the impairment limit is only for brandishing or firing. Carrying can be at any time, I think.

I am a retired Florida LEO and I carry 99.9% of the time. I have a CCW and I also carrying under the Federal LEOSA, which allows me to carry in all 50 states, including the District of Columbia,and in all U.S. territories.. I have never had to use my weapon, but I carry because I refuse to be a victim…….
