If one is detained, and the officer states that you can be on your way after you identify, with no other investigation, that is tacit admission that they are violating your rights. Otherwise they would actually be investigating the crime that you are suspected of( which is a prerequisite of you being detained in almost all instances).

😂🤣It must be inside HOA property or near HOA property ......some old person called police on him. 3years ago a guy riding a bike like 1am was stopped for not having lights one his bike .He refused to give his I.D .He ended up in ER room and then died. NV is stop and I.D state .

@@jarredcombs7603 If the officer has reasonable articulable suspicion of that, he has a lawful reason to detain the suspect. He can't just stop anyone he wants and say "you're suspicious" so give me your ID.

@@terrancekible9529 I mean SCOTUS was pretty clear on that in the Terry decision. Not sure what they don't get. Some people have this idea in their head that a cop's job is to make random searches until they "find the bad guys" and that is truly their idea of "police work". They really don't get why a cop can't just walk up and demand to see ID if you are walking down the road minding your own business. I suppose after Miranda, it took a few years to catch on. Cops were still making people confess during questioning and defendants were punished for indigence by not having any legal counsel for years after the decision. Hopefully we will get to a point where Terry is just as accepted and followed as Miranda.

This is the Armed Fisherman he’s from Florida where it’s legal to open carry a firearm as long as you are going to or coming from fishing. He does this all over the state of Florida. He is a notional treasure! He exercises his rights like we all should!

Of course its your freedom to NOT talk to them, but at the same time you are ASKING them to solve cases without giving them any information to investigate? Amazing how going to school for only 6 months lands officers in this position constantly. 6 months 12 hours a day 8 of which are normally firearm training and safety

This is the Armed Fisherman on KZbin. He's located in Florida and was doing videos about how open carry worked down there. Florida just passed constitutional carry, but prior to that the only way you could open carry was if you were in the process of fishing, hunting, or camping. Apparently, a lot of cops in Florida were not aware of this. Hopefully he gets a lot less harassment now that constitutional carry is a law of the land in Florida.

This guy is walking around with a firearm and filming specifically to get reactions like this. They're using a law that states they can open carry while fishing, so they're not doing anything illegal, but they know random folks will see them and call the cops. While certainly not illegal, the concerned calls make sense.. but the stop really should be "OK you're fishing? Have a nice day."

Cop deescalated the situation actually. It was obvious the guy was just fishing. It sounds dumb over the radio when you can’t even tell dispatch basics. And every on duty cop hears it. Poaching issues aside need to be handled by Fish & Game.

​​​​@@mikewilcox9348Not necessarily lol Lawyers have to know/be able to find *all* the laws in their field of practice and the nuance of how they're interpreted Cops don't need to know all the tiniest details/interpretations that belong in the court room.. but *_they should_* have a strong foundational understanding of Constitutional law and the handful of legal concepts that make up 80%+ of their calls! They should also have a legal resource database that they can _quickly accessed_ on the 💻 in their cruiser for more niche instances/unique local state or county legislation 💯 There also needs to be annual a yearly test to make sure they maintain competent levels of understanding for Constitutional laws and the situations they most commonly deal with 👏

Yeah, and that is why he should be ID. He is not currently fishing, he has an AR out and ready in a residential area "ON HIS WAY TO FISHING". That means he could go fishing or just say he is and commit a crime. There is reasonable and articulable suspicion of a crime being executed in the form of a shooting. If we keep saying it is okay for people like this not to provide ID and paperwork for the firearm while casually walking in public with an AR and holding fishing gear then we are also saying it is okay for criminals to get away with it in the same way. "Oh, yeah, Im on my way to fishing just after that elementary school full of innocent kids that could become nice targets officer. But you have no right to ask for my ID because I'm holding a fishing pole". That is actually not okay. If most of the population would open carry and have a rifle in their vehicle, then yes, dont provide the ID and if you do something stupid other people will put you out of comission. But as long as it ain't the old wild west or rural Texas/Montana... then you should simply say "yeah officer, Here id my ID, i'm on my way to this place to catch some fish and the law allows me to open carry while fishing. Anything else I can do for you? No? Then have a good day".

Caller talks to dispatch. Dispatch gathers some info. Dispatch plays the telephone game with an officer. The officer then shows up looking for whatever info he received from dispatch. There is no chance to vet the caller and more often than not the officer doesn’t know if he’s going into a near active shooting or just some guy going fishing.

You're just seeing a small part of the interaction. The fishermen is carrying a firearm. The statute the fisherman is referring to is open carry while fishing including to and from the fishing site

Just so everyone knows, this guy is walking around with a rifle hanging of his shoulder. It's a loophole in Florida law that let's you open carry while you're fishing. Somebody probably did call in a guy carrying a gun. I ain't no bootlicker ACAB, this is just the context that's missing from the clip. This guy is awesome for knowing his rights and flexing them. What are you even on about. A cop is well within his rights to ask someone for ID anytime he wants. A person not suspected of a crime can refuse to ID. Its not like this is a random encounter either, the dude carries an assault rifle around parks or down the road with a fishing rod for the sole purpose of having people concerned that the guy might be there to murder them and their children, so they call the cops. This guy only does this to make content, nothing else. To be honest, you should be outraged that someone is making a mockery of your rights to make a few nickels on youtube which could ultimately lead to restrictions on your rights to carry a firearm.

I once watched the Armed Fisherman doing a video exposition with a court. He spoke as if he himself was a lawyer. The cop who had arrested him was made to look a fool. The Armed Fisherman knows not only his rights, but the laws that pertain to his rights as well.

@@electricheartponythe fisher had the first amendment right to talk back to the officer the fourth amendment right to refuse to show ID or licence as he's not reasonably suspected of committing a crime. the cop probably knows these two exist but has no idea which subsection to look under for these specific laws and in this case the fisher is much more knowledgable about the law than the policeman you dont need to be a lawyer or "someone trying to cause trouble" to know your amendments. happy showing your ID to every police officer you meet and getting arrested for crimes you didnt commit buddy

Sure, if you live in a country like China. In the USA however, there is no requirement whatsoever to identify yourself to LEOs unless you’re suspected of having committed a crime, are in the commission of a crime or are about to commit a crime. Also, the police must articulate specifically what that crime is! If they do not state what law they suspect you of breaking, then you are not legally required to identify yourself! This is the law. No ifs, ands or buts. No exceptions. If you’re a US citizen and you don’t like this, then you have the right to try to have the law changed. Or you can move to somewhere like China, where the state is supreme and the people have few rights (if any).

He said the citizen was reported as a suspicious person, yet provided no law he was suspected of breaking, hence the cop requiring ID (not a fishing license) was erroneous at best. If you want to go ahead and give up your rights, go for it, but it just makes the rest of us have to fight that much harder to keep them. When cops are allowed to break the law without being challenged, the procedures become standard which is why so many situations get escalated instead of de-escalated because pride and authority get confused with right and wrong

@@goofyah-yo1vz You don't, but fact is we have a statute that precisely states that open carry is legal when traveling to, from, and during fishing/hunting. It's a statue that needs to get revised to only pertain to active hunting grounds, and completely remove the fishing aspect, because it's entirely pointless and people like this guy abuse the fact it is written to be legal. He is doing it because he likes to scare people and flex the fact he read a statute on the police that show up. (that and he is "fishing" for a lawsute when one of the dumb ones arrest him)
