Nice video, I have a question There is no H4 approval notice as she directly went to stamping on H1B approval notice in India. She has latest I94 and Visa stamping. These two documents are good enough or do we need to submit any additional document in place H4 I 797 approval notice ?

Hi Mandar, I have my current I-797 (non - I140 approved ) expiring in Jan 2026. However, I just received my EB2 NIW I-140 approved last week. Can I apply for my spouse's H4 EAD with these documents or do I need my company to file my H1B renewal 6 months before expiry (in June 2025) for new I-797 to process my wife's H4 EAD?

I am a bit confused about the category with which I have to apply for my EAD. Is it C09 or C26? My wife will be getting her I-140 approved for the first time, in next 10+ days. And her H1 is valid for another 16 months. I have applied for H4 COS (5.5 months ago) but, don't have the approved notice I-797 yet for my H4. Can I go ahead with EAD application, with her I-797 and with my I-539 receipt?

H4 EAD can be applied based on pending H4 which is based on approved H1b. So go ahead and apply.

Can we get H4 EAD without I140 ?? As per USCIS, Certain H-4 dependent spouses of H-1B nonimmigrants can file Form I-765, Application for Employment Authorization, if the H-1B nonimmigrant: Is the principal beneficiary of an approved Form I-140, Immigrant Petition for Alien Worker; or Has been granted H-1B status under sections 106(a) and (b) of the American Competitiveness in the Twenty-first Century Act of 2000 as amended by the 21st Century Department of Justice Appropriations Authorization Act (AC21). Hi, I have a query on H4 EAD. I was with an Employer (Say A) where my H1B and H4 was valid till Aug 2023, but recently I joined a new employer (Say B) . Employer B filled my H1B transfer and it got approved till 2025, They also filed the H4, I received the receipt notice but yet to receive the Approval for H4. Had one question. Currently application for I-140 has been submitted for approval under premium processing. My current 797 will expire in July 2021, so will apply for extension somewhere in Jan 2021. Hello Mandar, My husband is in US and I am currently in India. Not sure who is asking the question H1B holder (husband) or H4 EAD holder (spouse). Regardless I got your questions. H4 is dependent on valid H1B and EAD is dependent of valid H4. So even if your husband changes his job and does H1 transfer, you can also file H4 extension along with the transfer as well has apply for new extended EAD. Your current EAD extension may not be processed as you new H4 and EAD will be pending. It all depends on the timing.

Hi Jyothi, She should first try to get a job in California if she has an OPT with an employer who will file her H1b next year. I am assuming she is working in Boston on OPT. If she goes on H4, unless her husband has approved I-140 immigrant petition, she will not be eligible for H4 EAD.
