Sir , if the foreign judgement fall under any of these exceptions then always appeal filled or a new suit is filled ??? (But if the judgement is obtained by fraud then decree is not conclusive in nature then appeal is not filled of that foreign judgement, i m confused)

Sir , by an Indian person ,if one suit is filled in India and one in another country but the party is having domicile of other country then which decree is valid if in that foreign judgement they didn't recognise indian law .

Brother both countries have similar laws, so it's interpretation be same, it is possible that the case laws which I have discussed might be used by Pakistan higher court, but I sure u that SC of Pakistan has also interpret the laws in the same way, in which the Indian sc have decided

i have one doubt in narsima rao case... in exception it was state if the Respondent gave consent the decree of the court is valid... but while we reading the jurisdiction of courts it was clearly states that consent of parties never determined the jurisdiction of court.. it creates conflict? please gave ur opinion on this?

Having no jurisdiction on subject matter, consent don't give power to court to trial The case but if 2 or more courts have jurisdiction, consent to file suit in one court Is valid

One suit filled in foreign court then one court on the same cause of action can be filled in Indian, Res subjudice will not apply. But on the same cause of action two suits can't be filled simultaneouly in Indian court

Explanation simply says the a suit pending in foreign court does not preclude the party to file a case in India so Res subjudice is not applicable in this case. Section 13 simply says the judgment of foreign court is conclusive unless fall under the 6 category in which it is not conclusive.
