My name is Steven Whitsett. This is my first video in a planned series which will examine three questions concerning the American policy on sex offenders. (1) What exactly are the restrictions placed on the freedom of sex offenders? (2) Do those restrictions go far enough, or too far? (3) Do those restrictions actually make the community safer?

You are right, Monie. For example, a non-sexual crime like public urination can be sex-offender-registrable if one is caught with it and the infraction is upgraded to a sex crime charge of indecent exposure. Ditto for if you let your pants down without gratification and you are rung up also for indecent exposure--you might be on that dreaded list too. If you streak or flash and end up charged with indecent exposure--you could also be on the list too. To avoid trouble, if one is charged with indecent exposure, your lawyer should change the charge to a non-sex crime such as disturbing the peace or disorderly conduct--which will not get you on that scary list if convicted. It is not worth it as a person to be labeled a "chomo" even for a non-sex crime! It is never ever worth it! Registration laws needs to be abolished.

Also - on any online chat - if a recipient says things like "are you sure you are 18?" or similar tempting phrases - don't engage further! Stop! Close your browser! If you continue further, you will be honeypot-entrapped and you will be likely rung up for online solicitation of a minor--which will put you definitely on the sex offender list!

Thank you, thank you, thank you for what you are doing for all people on the registry! The best part for some of us is that you are from Florida where the state statutes and municipal ordinances are draconian. In truth, in coordination with some of my Canadian and German allies, we are working towards legal recognition from the European courts that the American SOR amount to human rights violations. @@CommonSenseLaws would it be easier to just leave the USA for sex offenders? Is life in the USA that much harder for them?
@CommonSenseLaws
@CommonSenseLaws 4 жыл бұрын
@@nuclearwaste2062 Hello Nuclear Waste. Your question is interesting and implies that you do not live in the US. It indicates to me that perhaps I should post a video explaining the life-long liberty restrictions placed on ALL sex offenders regardless of the nature or severity of the offense. In fact, the sex offender registration laws make it virtually impossible for SOs to obtain meaningful employment and also bar them from living in most residential areas. (Google homeless sex offenders and you'll get an eye full.) Additionally, SOs names, addresses, photos, etc, are posted online by the government for everyone to see... which means that SO face social isolation and ridicule for the remainder of their lives. They must also carry a stamp on their driver's licenses which identify them as SOs. And, of course, most SOs have severe travel restrictions placed on them for the remainder of their lives. In many states, they may no longer vote or attend university. And let's not overlook that they are barred for life from receiving housing assistance from the federal government. It goes on and on. So, yes, SOs are better off leaving the country. Of course, the federal government is now beginning to invalidate the passports of SOs, making it very difficult to leave. I believe things will only continue to get worse. I believe that the American SO policy has gone so far as to now pass the threshold for human rights violations based on the European Convention on Human Rights. Perhaps a long answer, but hopefully you get the idea. Hope it helps. :)

My question is, How do we stop these laws? How do we make the public see that these laws do nothing to protect them? I am seriously seeking answers. I tell my husband that if we can have protest maybe that would work. He, like I'm sure many of you are, is afraid that if sex offenders come together that he will just go back to prison. There has to be a legal way to stop these laws. I have spoken with the ACLU and they will not respond to me either. There needs to be a change, I just don't know who or how to do it.

Hi. I totally agree with your points on the injustices of sex offender US laws. I have a bf who has been charged twice with possession of child pornography. I love him very much and have not given up on him. His second charge involves 3 years at Lancaster in Florida. His first charge involved over $58,000 in fees before he would be released from probation. Luckily, he had family with money to help him. I was there for him when he had to start over and will continue to be there for him despite the labelers disbelief that I am standing by him. He is a human and deserves a normal life. I am 1/2 German and speak, read and write German and know how Europeans value human rights and giving people second chances. I love your videos. It brings the truth out about the social injustices that sex offenders have to live with for the rest of their lifetime. I would love to start a new life in a country that does not create obstacles, barriers and labeling. Thank you for bringing this topic out into the open. 🤗

The laws are kind of ridiculous. If he is creating or selling CP the absolutely throw the book at him but simple possession with nothing else done I'd say get rid of them give him some help, if he accepts and continues treatment no criminal charges filed. Also let's remove the legal barriers to people having those fantasies actually getting psychological help. The way our laws are written now a therapist has to report someone if they go to them for that. When in reality seeking help for it makes it much less likely the person will offend.

I'm barely getting by on part time delivery driving and fear I'll even lose that should I get convicted. That most jobs I've applied to all state they don't want me and the ones that are felony friendly can't help me till years after conviction. It all needs to stop in my eyes and some need to go as far as tge laws as well as the registry. The public doesn't need to have access to the registry at all since it doesn't really help anyone and many on the registry of low level offenders shouldn't be felonies yet misdemeanors at best. Ones time is served and the "dept" paid to society. Nobody should have to continue to be punished forever yet that's how the screwed up laws are in the US. I recently started posting to my KZbin channel again. Within a week of my first videos going up. My wrongful conviction back in 2007 that landed me on the Registry was brought to the surface, and a lot of my friends on here abandoned me. This prompted me to effectively shut down my channel and cause me a great deal of internal suffering. Everyone on that list is treated as tho they are the worst of the worst, regardless of the circumstances surrounding their specific case. It is unfair to people like me and many others. I feel for victims of abuse I truly do, and I believe that people that cause others to suffer in any way ought to be held accountable, and pay the appropriate price accordingly. I do not however condone the actions of the Registry Board in the fact that they lump everyone into the same group. Maybe it's just my bias talking, as in this instance I clearly cannot rightly clam an un-biased view. However I have given this a lot of thought, and honestly believe my statements have merit, and therefore worth expressing. ~Bodie

I have read up on many of the petty ways one can be labled as such for things such as public urination. I read up about people here in US who did things such as streaking back in the 1970s and then paid their fines for this minor offense and then come 20some years later, they were forced to register as a SO just for streaking 20some years earlier when the Nazi style laws took effect. I will add that the USA for the last 200 years never lived up to its standards of being the land of the free guaranteeing everyone rights. USA has allowed slavery to go on until 1860s, the chasing of the Native Americans off their lands by Andrew Jackson pushing them in reservations, forced sterilizations due to the Eugenics movements of over 100 years ago, segregation, failed war on "drugs", banning people from housing and employment just because they got into trouble with the law holding their past against them long after they paid their debt to society, and the latest way of singling out a group of people for persecution-the SO registry. All of these things and then some and USA fighting unneccessary wars picking fights with other countries trying to force its will on the rest of the world. In spite of "more" people and articles now claiming here in USA that the SO does nothing for public safety, there is still fear mongering and hysteria against someone and groups of people with the SO label living nearby them and the unneccessary harassing of these individuals-sometimes even by news reporters.

There are 13 states where peeing outside can put you in the registry along with two consenting adults doing their deed in the beach or car. Even adults soliciting an consensual adult prostitute can land on the registry in some places.

I agree. Some sex offender laws should be abolished. In fact, sex offences should be handled as a public health issue like drugs I.e. counseling programs, rehabs etc. The exile bullshit will only gain more crimes and has nothing to do with rehabilitating the criminal to be more productive in life. And that shit has got to change. Otherwise, anybody can become a victim of these laws.

I don't even have a sex charge but when I left prison the parole board decided they thought I should have to register as a sex offender until I was off parole because THEY thought I had the 'intention' of sexually assaulting my victim, despite the fact that I not only didn't have that intention but also that I didn't commit the act of it. That was 2 years ago and i still have 2 years until I'm off parole. Since then they have repeatedly tried to change the terms and make arguments about what the law supposedly says to make me have to register indefinitely. I can't afford a lawyer(yet) but i do plan on fighting this too. They are violating due process (in my case at least) as well as administering a cruel and unusual punishment upon me. I wish you the best man, I'm subscribing now.

The laws are completely out of line when it comes to sex offenders. It practically punished forever without end and it's wrong. Its like people are willing to forgive a murderer, thief, or even an abuser over a sex offender. My eyes have been open,to how screwed up the system is and how severely messed up the laws are against sex offemders. I'm facing just my furst ever offense yet am terrified I'm going to be branded forever amd never be able to,reintegrate into society like they would a murderer, thief, or abuser.

800,000+ registered offenders. 200,000 of which where children when convicted. some as young as 8 or 9 years old. We've placed kids who are just curious about the human body or are victims of abuse themselves and acting out because of that abuse in the same registry as the most predatory rapists. AND WORSE the general public doesnt realize this is the case, and are led to believe the registry is only violent criminals thus allowing the system to violate more and more people's rights. This is not public safety or justice in any way.

I would like to tell my story briefly, I am one of the first group of people to be placed on Megan’s law in 1994 For lifting up a girl skirt at school I just turned 14 years old . I am now 43 years old which means I been on there for 30 years . I was forced to drop out of school in the 8th grade because of this and I choose to work instead. I choose to learn about Glass which is called a Glazier and I am one of the best Glaziers in the country. Why have I been on there so long is the million dollar question ? At the age of 18 I had consensual sex with a 14 year old who told me she was 17 , she got pregnant and that’s how my name came up. I was arrested and was told her real age. I did 2 years in prison and was released in 2003 I then found out I would have to be on Megan’s law for 15 years with a parole officer and was given dozens of Unhuman rules , requirements and restrictions I was completely shocked. I Did about 7 years and they found out I was one of the top 10 charcoal artists in the country and just opened my own Glass company LLC . I was starting to make the papers from my art so they took me off the registry but kept me on supervised psl. I ended up doing 15 years on parole or Psl as they call it and the most I got was a small motor vehicle ticket in all that time. I was easily removed from the psl after 15 years which was 2018 , my lawyer was fighting for me to be removed from Megan’s law all together but the court said hey remember when u were 14 and lifted a girl skirt up ? Well we are not removing u off . That made me stronger to be even more successful, so I started more businesses and always stayed as a Glazier to the point where I became so good no matter what glass company I worked for I was the highest paid employee. I was never fired from a job because of this , I never was turned down from a job , I was never denied a apartment or house. I have horror stories from life on psl and I mean horror stories. I would like to tell those stories along with how I beat them and didn’t fail in life and right now I am extremely successful. I earn a 6 figure salary, I had No problems since I been removed from Psl until Now . I had a opportunity in Arizona where I can double my success and the NJ detective found out and violated me for leaving NJ and not telling Arizona police that I was there to work within 10 days smh . I am pissed that Law does Not want anyone on Megan’s law to be successful. I have a story where a police officer tried to set me up in NJ for crimes he knew I didn’t commit and if I didn’t have the money or resources I would have went back to jail and everything I done would have been wasted. But I out smarted him and hired a private investigator and he got the truth and all charges was dropped with a apology from the judge I have that report right now in my icould that I want to make public a long with all the illegal stuff I seen in these past 30 years . I have stories and proof that will raise so many eyebrows my email is alluniqueconstruction@gmail.com

I’m not a SO but I know that these laws are unconstitutional and only exists to make money for the state. I bet those laws would change if they started going back and finding people with a DUI on their criminal history and retroactively forced them to register on a website and not allowed to go in any store that sells alcohol or live near any place that sells alcohol. It’s the exact same difference. If the government can protect one life from a drunk driver, it’s worth oppressing anyone who has had a DUU in the past.

I have a good hard earned career now and my wife uses that as an excuse as to why i don't visit. It breaks my heart to have to see my baby girl growing up without her father. To see me through a screen. She smiles when she sees me so I know she knows who i am, but still. I miss my wife alot and everyday I spend trying to improve my life, ultimately buy a home for us. Eventually, I have considered moving to another country like Germany even if that meant revoking my US citizenship. Yes, I agree that this is a huge victory. But we must keep in mind a few things: 1.) This affects only the folks convicted between 1988 and 2011. It does not help those convicted post 2011. We must keep fighting for them. 2.) The restrictions still in place for those convicted between 1988 and 2011 which are not directly related to the registry still amount to violations of human rights. And we must keep fighting for them as well. Yes, a huge victory which should all take pleasure in. But still a lot of work ahead. Please keep the info coming!

I also am in the same boat. My case is a bit different but im a level 2 in NY and I did 5 years starting after I turned 20. I won't say I was totally innocent. I did the crime against a loved one and minor but was classified as being violent solely based on her statement. Which in turn gave me the level 2 classification. I will swear to the almighty Himself, that I never forced her to do anything, physically or otherwise. I myself was abused as a minor, though back then that didn't register in my brain. I regret the choices I made at that point in my life and i wish things were different but I refuse to be responsible for an act of violence I did not commit. However, i must register for life even though I did the time locked up. I'm not saying some don't deserve the life registration, but they changed the laws so nonchalantly and out of fear. Fear makes people do stupid things. Salem witch hunts anyone?

Registries at the very least should only be accessible to law enforcement. And it should only contain severe crimes. Essentially a little girl catching you pissing on a tree lands you on the registry. A woman at Mardi grand flashes her breasts and ends up there if a kid sees her. Actually there shouldn't be a registry period if the court has deemed that person can safely be released then the punishment should be over and full rights restored. We are the only country that has a public registry. Most countries dont even have one period.

I live in Ireland so I did not know much about the SOR , I heard of Meghans law over the years , but I did think too much about. I don't have any SO label attached to me or do I know anyone who has. in fact it was binging on KZbin that I came across those Chris Hanson setups with the police and cameras, I looked up the SOR for a few of the people shown and started getting an idea of the lifelong sentences as a lot are homeless, suicidal and unemployable after wards not exactly rehabilitation. Then hearing that 20% of 850k were juveniles when their crimes were committed and many more under very questionable crimes such as public urination or the Romeo and Juliet scenarios. So it does not matter on the crime just branded for life, also the matter of putting their lives and their families in danger by some unstable vigilante as we have seen recently. Now I am in no way condoning actual crimes against victims because it stays with that victim probably for life and can have horrible consequences , but I also understand that people dehumanize and demonize SO after the media whipping up a frenzy. Over all those types of extreme restrictions are not necessary for a lot of offenders and are simply for political gain, if a person is that dangerous then the law show change to pass a life sentence in prison. Also with that pathetic show with Chris Hanson , it was obvious that a lot of the men were not real paedophiles but we're almost lured into a fly trap when you read the transcripts ,they were probably didn't care young or old women just suckered when the decoys reel them in ,of course they are potentially doing something very unsavoury and very illegal but mind boggling that the police ,the Courts , prosecutors think this is justified to join Chris hanson for ratings or whatever. I wish you well and it's good to hear you are seeking sanctuary in Germany, it's a fantastic country , you are a good spokesperson for people that a lot of the public will have little empathy for and a lot of that will be from the media frenzy and labelling

Ironically, in many cases, actually committing a criminal sex act is met with less jail time than committing non violent, non contact offenses. Sentencing guidelines are a joke. I have no objection to the existence of the registry so that law enforcement can know who is in a particular community. Where it goes too far is when that registry is not only made public, but used to place so many restrictions on a person that it is basically impossible to live or work. Bank robbers aren't forbidden from being with 1000 feet of a bank. Murders can live wherever they want without public shaming. I can't go within 300 feet of a McDonalds because many of them have playgrounds. I'm not a predator. Registry restrictions accomplish nothing, are expensive to enforce, and create criminals out of people for doing something that anyone else can do with no repercussions. It's a modern day Jim Crow era.

I've never laid hands on a minor, nor would I, but clearly I shouldn't be allowed to work in a school. The fact I can't go to a bar with friends without committing a felony if 250 feet away across the street there is a Chuck E Cheese is just crazy. There is so much emotion tied up in this discussion, much of which is understandable, but rules need to be based on evidence and effectiveness, not on emotion and some politicians desire to look "tough on crime".

I watched your video until 3:51. I get it that your life is much more complicated and your opportunities are few. For an intelligent man that is a bitter pill. My impression, however, is that instead of choosing a relationship with a consenting adult, you prayed on a confused and vulnerable child. As an aspiring medical professional, you knew what you were doing. I suspect that your victim's life took a turn for the worse and he will bear that burden for the rest of his life. My head does not get around the concept of a "Debt To Society" when the victim was an individual. For me, the overriding priority is to prevent harm to more children. Do you have an alternative strategy for protecting children from predators? You may be familiar with the case of Micheal Guider in Australia. He is a prolific child rapist and killer. If our justice system was more like yours, then he would not have been released so many times. After his second release, he quickly reoffended and then escalated to killing a 9-year-old girl. How can a system be constructed that would distinguish you from him? I did not see an expression of remorse from you, but rather there was bitterness towards a system that is intended to protect children. Michael Guider also shows no remorse and is bitter towards the system that incarcerated him. Note that Guider has never disclosed the location of the girl's body so that her parents can have closure. How wise is it to release a sociopath that habitually preys on children? I apologize if my opinions seem harsh. My sentiments reflect disillusionment in my local justice system. www.change.org/p/don-t-let-michael-guider-hurt-any-more-little-girls/u/24964467

Hello, Will. Thank you for sharing your thoughts. You are correct in saying that I do not show remorse. While I certainly appreciate your thoughts, let us both not assume that you know the details of my situation. One of the details you do not know is that 13 years after my conviction - long after I was finished serving the sentence for the sex case - the "victim" came forward and admitted in a signed affidavit that the accusation he had made against me were false. In the affidavit he explained in detail his reasons for making the accusations in the first place. Unfortunately, Florida law does not recognize recantations without corroborating evidence. Such evidence didn't exist 13 years after the fact. So, I will live with the conviction for the rest of my life. So, you're ultimately right: I have no remorse.

@@Will_CH1 Good morning (German time). I respect your willingness to soften your opinion of me. However, I still believe that whether I am innocent or guilty, ALL human beings are entitled to certain basic human rights... which includes the right (as recognized by the UDHR and ECHR) for folks to move on with their lives after completing their court-imposed sentence. I vehemently object to life-long penalties except in egregious cases. As well, I believe that we should be very careful not to lump all offenders or offenses into the same category. Reality is that while there are definitely some sick individuals who are repeat violent offenders, the vast majority of cases are not so extreme. This is not my opinion. The statistics are readily available from the FBI and DOJ. Very few things in life are really so cut and dry, so black and white. There is almost always more to the story. In no way do I advocate or condone the abuse of children or adults. But all cases should be viewed objectively, rationally and dispassionately. If we're honest with one another, we will agree that we usually do not get all the details. We hear only what the media, prosecutors or advocates want us to hear. (When a man is sitting in jail, he does not get much of an opportunity to make public statements like police and prosecutors.) Yes, there are many guilty folks in prison. Unfortunately, because merely an accusation (without supporting evidence) is enough to sustain a conviction for a sex offense in the US, there are an awful lot of folks in prison because their girlfriends got angry with them over cheating, or wives got angry didn't want to share custody during divorce proceedings. I just finished a long day at work and I'm rambling. Sorry. :) Hope you have a great day. And, again, I appreciate your comments.
