The plaintiff says she hired the defendant as a handyman in her 23-unit building. She said he confirmed he was licensed and insured, but that wasn’t true. Now the bathrooms he worked on are leaking, so she’s suing for the money she paid him. The defendant says he never told the plaintiff he was licensed and insured. He alleges she’s suing because he filed a complaint after he was injured at work.

My daughter-in-law lost her left hand in a high school shp class. They surgeons reattached it but it didn't work. She is amazing and can do anything. She still plays the piano, dances, gymnastics and she just went rock wall climbing for the first time. She has a few prosthetics but I've never seen her use them except a few photos here and there. She was able to braid her own hair one handed before she left the hospital!

I’m a legal assistant at a workers compensation defense firm, so we would’ve defended her if she hired a lawyer (and had insurance). If you have employees, you NEED insurance. Insurance will cover the workers comp benefits and medical bills because you pay to have insurance and that’s a perk of doing it. If you don’t have it, you’re stuck paying for that all out of your own pocket!! Tips from the bad guys of workers comp: ALWAYS report your injury the day it happens to your employer. Take photos of your injury and what caused it (if applicable). Go to a doctor ASAP and request copies of those medical records. HIRE A LAWYER! You will be taken advantage of and offered shit for money if you don’t have a lawyer.

@@meekthegreek1623 Typically all employers (their insurance) will pay workers comp benefits until they think you’re either healed, able to work light duty, or you quit. But if they stop paying and the employee sues for more money, either wage-loss benefits or medical bills, that’s where we come in. We rarely see people under 35 years old, so older people usually have preexisting conditions or have been hurt before. So they aren’t necessarily scamming but like you can’t say your back injury is from work if we subpoenaed your medical records and saw you had back surgery three times before. We hire people to find jobs for the employees based on their injury restrictions and skill level so they can go back to work to make money, but 90% never take it. We do see serious cases though and I dislike my job because of that. A piece of hot metal fell in a man’s boot and burned him so bad and then his skin got so infected he needed his lower leg amputated. But then again a Dominos Pizza worker was suing for rotator cuff surgery because he hurt his shoulder grabbing an EMPTY pizza box from under a pile of EMPTY pizza boxes lol.

Harvey needs to understand that even though the defendant was not going to get the fine Workers Comp collected from the plaintiff directly (He would have indirectly, they are the ones that would have paid the $25,000 he believed he would receive) that incident would go on her company's file. No company wants claims on a file with Workers Comp, because that can draw attention to them they'd rather not deal with. I dealt with enough WC cases in my career, to give these words of advice; NEVER let an employer talk you out of filing a claim, ALWAYS go to a doctor immediately, because some conditions can take days or weeks to manifest, and it bolsters your case if you sought medical assistance immediately.

SIDE NOTE - my X-FIL blew off his entire hand. Surgeons were able to reconnect it and has 100% full use of his hand and all 5 digits. It took $$$$$$$ and lots of therapy to make it work again. His Dr even wrote an article about how you CAN have full use of your extremities IF you do the WORK to make it useful again.

This wasn't a simple case of a landlord hiring a guy to do a bit of work, she hired him full time to maintain her buildings and therefore should have been declaring him as an employee and paying his insurance, and because she wasn't AND probably wasn't declaring her income, that's why she was fined $16000. Hopefully with that money he can have better surgery done on his finger, because it looks like it was done by an amateur...

And not sure of your age, but most adults have children, not necessarily child support, but children bc they are married. Two parent households, normally don't amass this type of wealth...😒🤔. She is clearly the exception, not the rule. So it's not as easy as no designer tennis shoe or fake hair 😒. Hell, if that were true I would be wealthy and most people I know. I hear you, but if it were that easy, most people would be wealthy and we know that's not true. Realistically, this lady don't seem reputable, she don't even have insurance to secure her wealth. First off, I just watched an episode where a lady was suing a friend for money she paid on a cruise & her kid was injured & she waited months to pay the balance. I forget what the episode was called. The judge flat out refused to look at screen shots of the conversation. She asked for it in their phones. And I’ve seen her do this in most of her cases. So why is she accepting screenshots or printed text in this case. That doesn’t seem fair to the other cases where they didn’t have the whole conversation any longer but did have proof of a screenshot. Second, I do think she’s suing in this case b/c she was fined for the workers comp case he filed. Third, you don’t wait years to sue for a not so good repair. Especially ones you never had corrected by a different person. The judge asked if she had proof it wasn’t a coincidence & she says ‘yes’, doesn’t look for it & then starts to talk about a screen… The plaintiff is shady in this case.

I don't know why she was required to pay him because she wasn't operating a business period a private individual has no duty to carry workers compensation hammer hit his hand. That's not the way workers comp works. Now if she had been negligent, for example if he came to her house and got hurt by something she knew about, then thats different. Thats a negligence case not WC.
