Seconded. I also question the causes of action. The product includes the packaging, true, but they serve distinctly separate purposes. Even if the toy company owned the pornographic website, for the sake of argument, what "enriches" the business entity? I don't doubt the plaintiffs had some shock and embarrassment. However, a reasonable person would not find deceit there. Maybe carelessness.

1st: It's a packaging defect, not a product defect and according to podcasters who went to the website, it does have an 18 or older gate that you have to click thru. 2nd: If the child had the necessary child-controls on her i-Phone, this wouldn't go there at all. If she used her mom's phone, then mom should have been there to watch the 18 or Older gate come up. All mom's fault here. If by chance, i-phone/pod's child controls did take her to this site, then mom's beef is with them not Matel. 3rd: As soon as Matel knew about it, they recalled all the current packaging and told parents to rip up the packaging if they have already purchased it. However, others are selling the original boxed toys on ebay for lots - so beware buying them on eBay. I hope they throw this suit out because it's a basic money grab. Mom should be making sure her children have some sort of child controls on their electronics or be observing them every time they use non-controlled devices.

Emily, If the UPC label was printed on the back of the packaging, consumers would not have to purchase the doll to use the link. Anyone could use their smartphone at the store prior to purchase to access the site. No purchase is actually necessary. Does this impact the potential lawsuit in any way?

If you go to that web site on your phone, first you get a warning that the site is adults only and you have to click through. Then there is still no actual HC pron, there are advertisements to become a member, and the advertisements are suggestive, but you can't see pron on that web site without clicking through you are an adult and then providing a credit card.

My son is 6 years old and is obsessed with the Titanic. He would 100% examine every part of the box. However, he always comes to me first when navigating online and using a search engine. So no, I don’t find it hard to believe that a kid would see the website on the box and want to visit, especially someone who wants to know ALL about the things they love (like my kid, lol). i have been using spotify for years. it's amazing drake is possibly suing about umg and spotify pushing kendrick when i remember when drake's last album came out and the whole album was on the top of the chart and it was plastered all over the app even to me, who doesnt like or listen to drake ever. it was infuriating. i couldn't listen to the spotify curated top 50 playlist for at least a week if not longer until half the music on it wasn't his. there has been multiple times when drake's music has been pushed by spotify. so for him to get mad about spotify promoting kendrick is insane. but not only that, does this mean that no company can promote music? that would be interesting to see how it would change the industry and music platforms in general. i'd love to see what his numbers would look like with no help

The woman was too stunned to speak. It gave me a good laugh though. Its not a product defect. It's a packaging defect. However, an adult site on the back of a child's toy is a huge problem. Is it lawsuit worthy? No probably not. Mattell should pull the doll and fix the problem and issue a public apology. It will cost the company a lot of money just to do all that alone. That should be enough.
