Josh, ALWAYS go armed! I know you don’t want an altercation but whoever is trespassing may not care if they have an altercation or not. If you go out there unarmed you very well could end up severely injured or dead. At least have the means to defend yourself. Nothing says you have to draw a weapon.

I know you don't want to ugly up things with the signs, but honestly I think that's what you're going to have to do. Not only for the deterrent factor, but also potential legal liability if someone gets hurt on your land, it's an additional shield for you that a person knowingly trespassed and thus took on additional responsibility for whatever happened next. You also mentioned that part of your land is not yet fenced..you need to remedy that ASAP. Finally, I don't know what the laws are there but here in Texas you can paint the fence posts purple and that has the legal standing of a combo no hunting/no trespassing sign. That might be an alternative to the ugly signs if you've got similar laws on the books there. edit: North Carolina indeed does have a purple paint law. Check it out :)
@CSnipes
@CSnipes Жыл бұрын
Since he's in NC, he can benefit from posting signs since NCGS 14-159 allows for the posting of signs to act as a deterrent and/or warning that the area or property is private and the trespasser should know that he/she is not welcome. Many states, like GA where I live, posting a sign doesn't matter. In order to be charged with OCGA 16-7-21, a person must remain on the property after being told to leave by the owner, tenant, or representative before the trespassing become criminal unless there's also some monetary damage associated with the intrusion.

Howdy Josh - you said it was black powder season in NC? He had a crossbow, I assume bow season is in as well? Of course naturally it is personal preference and however comfortable you feel being armed/unarmed in a situation like that. As a rule I tend to be armed anytime I'm out of the house. Nobody would know I'm armed as I conceal my holster, so I'm not too concerned about escalating any confrontations. Having been held up at knife point in a mall parking lot, my sidearm is my security blanket lol. I'm a bit of a talker, so I much prefer to talk my way out of sketchy situations. But just in case... That thing almost walks like a racoon... but the coloring is all wrong. No clue. Please let us know if you figure it out! Thanks for sharing 🤠

I hollered out, "Please make this your last trip on my land." He flipped me off. I had dog food, he had his hunt gear. Yup, no argument. Post your property. Use Purple paint or post signs. Without posting all you can do is ask them to leave. The Police will not arrest them if the property is not posted. It is not considered trespassing unless they climb over a fence/gate or walk on a posted area. They can always claim they did not know it was not posted they thought it was public land. I would of had a firearm. I carry a Glock 26 everyday on my farm. I would of not had it drawn. I also carry a AR15 in 300 Blackout this time of year on my ATV. I have foxes and coyotes.

Hey buddy I understand you don't want the signs up but I will say in Florida and in ga on our properties we went ahead and put them up to cover us legally bc we had a poacher trespass on the property, fell out of a treestand, sued us and won brother, yes and won the suit. We currently are appealing it so i don't know yet what the outcome is, that's pretty messed up. Our illustrious legal system always protects the criminal. I don't know so much about n.c. but if it were me I'd put up some signs. Yeh people should know better then not to trespass on someone else's property but we live in a different society today and there's some crooked, unethical, irresponsible folks in this world. For me if I am approaching a potential trespasser that has some kind of weapon I'd most definitely be taking a concealed firearm with me 100%. You never know who you are dealing with and you know they have a weapon so they are 1 up already. If your 6 is concealed they won't know you have it so I don't think it would cause a confrontation and if they ended being one at least you had a dog in the fight right. They animal looked like a beaver, muskrat that lost a tail to me. In my opinion being how fast you got over there that hunter may of been using your property to crossover onto another piece of property. When I con fronted these morons they claimed I was trespassing on their property and I needed to leave before they called the police. I told them the sheriffs department was already on the way. When the deputies (friends of mine) arrived the idiots still tried to say it was their property. It got pretty heated for a few minutes but they finally admitted they were trespassing and both were arrested. One was charged with possessing a firearm under disability (convicted felon), the other guy was charged with criminal trespassing with a firearm. it's my responsibility to tell someone else that they aren't on their own property? Do we have to put a sign on our houses that says this isn't your house? Or your car in a parking lot? What about a screwdriver? If it's not your property..then good manners and common sense says to leave it alone right? Despite having no trespass signs up..I still have this problem...fences, signs and purple paint doesn't stop a lawless individual unfortunately....but it's not my responsibility, nor is it your responsibility to tell a person what they already know...if it's not your's then leave it alone and don't go there right?

Notice that the trespasser wasn't wearing any orange. They knew they were trespassing and absolutely didn't want to be seen doing it.

Adding to someone else’s drone comment see if a infrared thermal imaging drones are inexpensive enough to be practical. You can spot a trespasser and wildlife much easier than waiting for some motion.

Do they have bio security laws where you are as in England all farm birds have to be kept indoors because of bird flew and people walking on your farm could spread disease and sign as restricted area.

Can't use a crossbow in NC without a permit, it's illegal. Call game warden. Use purple paint.

Dude looked like he slid down the bank would have thought you could have seen that. The critter looks like a piglet, but you definitely would see signs of that, I wanted to say muskrat without a tail but it would be the biggest one ever, curious!!

*Josh, That person is hunting with a cross bow and it was loaded. So be danged careful when approaching said hunter. Put signs up that can be seen day & night. If said hunter got lost, then they will spot the signs. If a animal is hurt and crossed into your land, then said hunter should come see you, and you both can find said animal and put it down, if it can not be saved.*

If you can't get the game warden out then you can attach a speaker near the camera so you can turn it on when your camera trips for a hunter so you can tell them they are trespassing.
@StoneyRidgeFarmer
@StoneyRidgeFarmer Жыл бұрын
camera has a built in speaker...but unless they hang out under the camera you won't have time to catch them and talk...fyi they know they are trespassing for sure...just the same as if you went out in a parking lot and got in someone else's car...these folks know what they are doing

you really need to put signs up to legally protect yourself if someone was to get hurt on your property you will spend thousands of dollars for legal defense even though the trespasser was entirely at fault. this happened to a friend of mine. protect yourself, remember nice guys always finish last it's the world we live in

Your little critter looks like a muskrat or nutria that's lost its tail. As far as the trespasser is concerned I would always be armed for your own safety, concealed would not be in there face especially when they are carrying a crossbow that you can see. Never know what else they may have on themselves, stay safe!

There are usually alternative posting methods. In Alabama, purple paint stripes on boundary trees is legal for posting. Without postings, any legal recourse is hindered even through natural domain rights are in place. Postings simply remove the “ I didn’t know” statements. If you plan future prosecutions, POST YOUR PROPERTY IR CONTINUE TO WASTE YOUR TIME AND FRUSTRATIONS.
