My field sobriety test took an hour and 36 minutes and during the horizontal gaze the officer administering the test was shining a bright blinding light in my eyes and I stated five times that I was being blinded by the light. I have several medical conditions and medications which caused failure. If you have a court appointed attorney this will not be brought into consideration.

I have nystagmus and the cop said that's ok it won't count against u but we'll do it anyway. I said ok whatever. The same with the balance test. The cause of nystagmus is unknown but it's thought to be linked to the inner ear/ brain and the eyes/ears is what controls your balance. Ive never had the greatest balance. The funny thing is that these test are really unnecessary. They don't prove anything conclusively. What they do is create a bs line of reasoning for probable cause. To search you, your passengers, your vehicle, to arrest you for something else entirely. It creates a bs excuse for being "suspicious" in the first place. It's profiling/ discrimination at its best

I don't drink at all but I do have nystagmus all the time. What would happen if I happened to be pulled over even though I am not intoxicated?

If accused of drinking, I'd suggest asking for the other drunk tests, and if that's not enough, a breathalyzer test. I've been pulled over twice and accused of DUI and I was Stone Cold sober both times. Once was made to do the drunk walk, touch nose, and recite alphabet backwards. All on the side of the main road. Humiliating.

For everyone saying the have nystagmus, this is why there are multiple levels to a field sobriety test. They aren't going to take you to jail (or I should say the absolutely shouldn't take you) based off the failure of one test.

So we don't know for sure they aren't going to take us to jail for our medical condition, but they shouldn't. That's reassuring. They shouldn't shoot unarmed people. But they do. I think y'all are missing the point. It's not the arrest that matters. It's the fact you trained police to look for a certain disorder. Neglected to mention that plenty of people have it. Told them I'd they encounter someone who they suspect of being drunk they should test to see if they have nystagmus if they have nystagmus that's a sign they are drunk Ok well we skipped right past the test and went to "how cops know we are drunk" Based solely on the fact I handed you my papers and my eyes jiggled

My sister and I both have nystagmus, hers was her only real eye problem, and she had to have surgery to get it fixed so she could drive. Mine is apparently so minor that nobody thought it important to tell me about.

They're also looking for overall eye control, pupil dilation and at the whites of your eyes. I can't pass the HGN regardless of sobriety due to eye problems. I find cops are usually pretty forgiving if you're honest. I just say I have a bad astigmatism, lazy eye and dystonia causing involitary movements. This is actually part of most regular neuro exams.

this video is a laymen explanation. what we look for is this: there are six different cues with regard to the HGN test. lack of smooth pursuit distinct and sustained nystagmus at maximum deviation early angle of onset prior to 45 degrees (three cues for each eye) lack of smooth pursuit: this is the initial test. two passes each side. this is just seeing if your eyes are tracking properly. if you are impaired, your eyes cannot smoothly follow the stimulus (my pen) without rapidly jumping all over the place. distinct and sustained: when i'm at the maximum angle for each eye (once again, two passes each eye) i hold it for a minimum of four seconds (this is REQUIRED, as in the study it was held for a MINIMUM of four seconds), and see if you are experiencing nystagmus. this means your eye cannot hold it's gaze on my pen, it wants to jump forwards. it's very obvious when you're looking at it but hard to explain. lastly, early angle of onset: this is most usually seen when someone is higher BAC, likely minimum .12% but it depends on the person sometimes. two passes each eye. slowly, i move my pen toward the far side of your eye, until i see a sudden jerk of your eye (nystagmus). I then move my pen back very slowly, and once i see the jerk again, I hold it. i hold it at a point where your eye once again cannot focus on it, and it wants to jerk back forwards again. like i said, you usually don't show this unless you're .12% bac. i've guessed people's BAC within +/- .02% on the regular just based on the eye test. I literally told a guy I thought he was a .18% based on his tests, and he blew a .18%. he thought i rigged the machine. i have arrested a lot of people for DUI, well over a hundred, and no one has EVER had less than .08% BAC, even when they had refused all testing. if i'm iffy about it, and didn't see many driving actions, then i'm not arresting you. the problem with DUI's is, LOADS of cops have ZERO IDEA how to properly conduct them, which leads to the public thinking it's all bullshit. i don't lose DUI cases. I lost one because the DA was a newbie and she didn't subpoena the officer who saw the violation (i just did the testing) and i can't prop 115 for another officer during a preliminary hearing, it has to be straight from that officer. so he won because i didn't see the traffic violation that he was originally pulled over for. they tried to get me to say i say another violation, but i'm not going to lie in court because at the end of the day i don't give a shit and i'm not going to lie. even though i could have totally said all day yeah he did this or that violation (no dash cams).

Did you toss back a few because, SCIENCE... or can you just do that with your eyes? I've known a few people who can make their eyes shake, I tried to teach myself to do it years ago, but no dice. I did however teach my eyebrows to move independently lol

You tell them before the test you have nystagmus. And then you also tell them you have back issues and very bad balance. They only have a certain amount of time to do all this stuff so they definitely won’t call your doctor to confirm. When you get out of your car act like you have difficulty walking so your story backs up. All this is true for me so that’s my story
