With the amount of knife crime in London, you would be stupid not to take action or run away. As for walking into my house, I would take off his head with a cricket bat. These are not pranks, they are crimes, especially at a time of so much criminal activity by gangs in big cities.

I think that was about the only point Mizzy made that had any reference to anything. I saw that too. He is lucky as has been said that he is in UK where guns are not a general 'thing'. Unlucky for the rest of us perhaps. Mizzy couldn't string a sentence together in that supposed interview - I think the only sentence he could string together would be a well-deserved prison sentence.

I once stayed in another country where a burglar was caught and killed by the homeowner. The response from the police there was " Tough. The burglar should not have been there". The burglar never did it again.

How to enforce such a ban? EDITED to add......I despise his actions and would happily see him going to jail for a long time for his already documented behaviour. He's invading privacy and it's extremely unfunny. Social media sites in this case Tik Tok and those who watch such videos are also culpable

@@dawnmoriarty9347 Might have to enforce common sense in his case. if he is in "trouble" again in the next 10 years say and it is to do with his social media 'presence', then he goes to jail for 5 years for a start maybe. We need to stamp out behaviour like his, before someone dies in a scuffle or from shock, like the old woman might have done when her dog was stolen. I can honestly say with hand on heart, that if a dog of mine had been taken in such a mannner as that, I would now be inside charged with his manslaughter.

Its ridiculous. The law is upside-down on home invasion. If a stranger enters someone elses home they should be aware that they are putting their own life at risk invading a house. They are putting themselves in danger. The fact that this is up for discussion is ridiculous.

There was nothing remotely disproportionate about Tony Martin's actions. He should not have been charged with anything given the circumstances.

He left a window unsecured, took the fuse out of the lighting circuit, removed several steps from the staircase, and sat at the top of it cradling the shotgun he did not have legal possession of, one that required a Firearms Certificate rather than a Shotgun Certificate. He wasn't an innocent homeowner caught unawares, he set a deliberate trap with the intention of shooting any intruders he deliberately attracted.

@@Nickcooper625 On the other hand, his farm had been robbed repeatedly and the robbers had publically claimed that the police couldn't help him and they'd continue to target him. As I said in another comment, regardless of how you feel about this case, it was more convoluted than the headlines suggest.

I believe if someone comes through your door or window un announced you should have the right to seriously hurt them. Otherwise how are you supposed to protect your property. It's actually ridiculous, criminals have more rights than homeowners in the UK

I know a lad by the name of "Scouse" (no prizes for guessing where he's from) and his girlfriend was telling us at a BBQ how there was a woman in Liverpool who was going around shouting for help through letter boxes so when people opened up to help, men would burst in and tie them up and rob them ect. Scouse at the time was about 16st and looks like Tom Hardy in Bronson but with more tattoos and a beard. He had a plan to deal with these intruders but that never happened but what did happen (allegedly) is two people tried to steal his car, so he (allegedly) got his girlfriend to cover him in baby lotion (an idea he stole from the film Bronson ironically) put on a pair of battered old army boots and climbed out of the bedroom room window and onto the canopy above the door and then jumped down and started attacking the two men. Moral of the story is, people might be prepared for a fight but they're certainly not prepared for a 16st naked scouser to fall from the sky and start chasing them. Honestly the best way to deal with intruders is to just charge at them naked because not many people want to get bummed.

Tony Martin should NEVER have been charged in the first case ,3 people were involved excluding himself ,and he was alone in the middle of nowhere,he gave a warning to the intruders which I believe they ignored. IF The law on firearm ownership was not taken away from the public previously by the politicians these people/criminals maybe would not have committed their crime . The Law still is an ass when it comes to protection of UK citizens ,Criminals have all the lethal firearms (even tasers or spray are not allowed )and the public are still denied the right to fully protect themselves and their families with deadly force .

Best self defence advice is to not call the police afterwards, unless you have reason to believe someone else has witnessed the events. That is the best way to legally protect yourself within this corrupt country.

No, call them to report a crime at the premises. You are not employed by the public prosecutors office, you are not able to assess the offence they would assess ascworthy of prosecution. The failure of the police to attend is their decision.

I have to disagree with you there. Firstly you will never be sure who is aware of what. And if the criminal attacker gets seriously injured, they will probably go to the hospital -who will almost certainly report it. The authorities were not there and did not see what happened, and if the first story they hear is from the criminal, they may question why the victim did not report the crime (they might not even be able to tell who is the real victim if the mugger claims he was the one being mugged for example). A lot of them are not deep thinkers or philosophers, and just following basic training. My best advice is use reasonable force following the law and report everything. This may not seem fair(as the system is not perfect) but you can't beat the system these days, just try and work with it as best you can.

In Englandstan people can't even move protesters blocking roads without getting in trouble. In Florida, it is a 3rd-degree felony to do so without a permit and drivers trapped by protesters may escape even if it causes injury or death to protesters and the driver will have no civil or criminal liability. Have not seen roadblocks lately.

Depending on which State, it's usually shoot to kill in the USA. In many States, the gun you store in your home does not even have to be registered (especially inherited fire arms - _grandpa's shotgun_ ).

In my view, if someone breaks into my house I would immediately feel threatened because I wouldn't know their intentions. People have been murdered after a break in, so just hurting them allowing them to respond would not be sufficient to keep me safe, so I would have to make sure they wouldn't be able to harm me the first time. So extreme force initially would be my first option. It's always easy when a jury sits and decides after a few hours or more whether you used the correct amount of force or not, but you have to make a split second decision - possibly to save your life. Get that wrong and for you it could easily be an coroners inquest!

Imagine how that poor family felt when their home was being invaded, they probably still feel traumatized by it, same as the lady whose dog was snatched. It may be funny to the perpetrators but it leaves a damaging and lasting effect on the victims. The laws of this land are ridiculous!

The coppers always pick the easiest option if you have an home invasion and you defend yourself the chances are the householder will be prosecuted before the perpetrators. If you get your property broken into this is a traumatic experience before anything even happens.

I personally think if someone enters your home without your consent or without a warrant then what happens to them is of no consequence. Being a UK citizen who had 6 youths break into my flat and make themselves at home and them not listening to me when I insisted they leave and having my phone in the front room they subsequently barged into and stole, I had to wait in terror and fear for my safety and hope somebody in my building rang the police. The laws in this country are honestly a travesty. if someone was to do that again I would pick up the first weapon to hand and only stop until they stopped moving. thankfully somebody did call the police and the offenders were arrested, however they were not charged and were released with no consequences. if I had stabbed one and killed one that night and the other 5 were arrested and charged maybe we wouldn't have little miscreants running around doing this kind of stuff for views. the UK police and law have only their selves to blame for this absolute joke a society

I would imagine most people's take in this is going to be the same: If there's an intruder in your house, your only concern is going to be your loved ones. The legality what happens next isn't going to be at the forefront of your mind.

There was a case not so long ago where two people broke into a house and attacked a young lad and his mother with knives. The lad managed to wrestle to the knife from one assailant and killed him and wounded the other. If i remember clearly i think he was also injured himself. When it went to court the young lad was eventually cleared of all charges but only because the assailant that survived kept changing his story. His council stated afterwards that if it hadn't been for this he would most likely have been convicted and sent to prison. This would suggest that the idea of being able to use even proportionate force isn't guaranteed in a home situation.

Dear BB, this video is relevant to a comment I made on one of your previous episodes regarding a home intruder many years ago. Where an elderly lady was attacked by said home intruder and her dog, a pet not a trained attack dog bit the intruder. He began proceedings to sue. I don't know the outcome. Can you make an episode please on the ramifications of such a happening and the rights or lack thereof of either persons. Blessings to you.

So, being in my mid-70s, I'm expected to deter two drugged up morons who spend their off time working out on steroids and then having to hope that an eloquent and persuasive prosecution barrister doesn't convince a sympathetic jury that these two 'boys' were simply having a bit of fun ? Why not simplify it ? Anyone breaking into my home, they're now at my mercy. Simple answer, don't break into people's homes.

The law in theory and practice seem to be two different things. When "Mizzy" was leaning into peoples' faces and asking them if they "wanted to die" and telling them he "could take them out right now" he was IMO inviting a swift 'Glasgow Kiss' to re-arrange his nose for him. Were that to happen and the Glasgow Kisser was arrested and prosecuted, and a recording was available for it to review (even just audio) then IMO a reasonable court would rule self-defence, but the law is an ass so ...

I've never been satisfied with our self defence laws, especially when it comes to repelling a home invader. The citizen has to consider proportionality in a high-risk, very stressful situation, whereas an attacker intent on harm has no such shackle. The Tony Martin thing was an abomination of systemic failure and injustice. He'd been burgled multiple times, and the police had utterly failed to offer him any protection. The burglars he shot at were career criminals, which the justice system had failed to adequately deal with. The "system" had failed him completely, so he used a shotgun against the three criminals when he was again burgled. The 16 year old that he killed already had made 18 court appearances, and had managed to rack up a criminal record of 29 offences, some for theft and some for fraud, and was out on bail when he attempted to burgle Martin's farm. Still, the media and prosecution depicted him as an angel who just took a wrong step. Of his accomplices, the 30 year old had been in court 35 times and had been jailed three times for burglary, and once for wounding. The 34 year old getaway driver had been in court 52 times, and had been jailed twice for burglary. None of these three should have been on the streets in the first place, but because they were, Martin ended up having to defend his property, and was hauled to court. Martin was handed a murder sentence of life imprisonment, with minimum 9 years before parole, later reduced to 8. Nobody would have been killed if he had been left in peace, or if the system had done its job. Public outcry at this obscenity provided much of the motivation for an appeal to reduce his sentence to manslaughter, and he eventually served 3 years in prison.

Back in the early 80s in my road two guys from the local Pub were going to really do a guy over in his house one had a Cricket bat the other a knife. Turned out the intended victim could look after himself an turned the Cricket bat on the two attackers both of which ended up in hospital! Funny thing about this Countrys law is the guy who defended himself Ended up in Prison not the Attackers..

A person's house and grounds should be considered to be their castle and bailey and that unlimited force should be allowed to be used to get rid of someone who has burglarised the house or doesn't leave the property when asked (except the emergency services carrying out their lawful duty, of course).

The laws on preventing these situations happening in the first instance should be strengthened then innocent members of the public won’t need to protect themselves or their loved ones, why should someone walking down the street or sitting at home have to defend themselves and end up in the criminal justice system because of someone else’s behaviour ?

If a person enters your home illegally without permission, then they, by their own action and intent, have left any 'human rights' they might have had outside when they crossed your property's boundary or dwelling's threshold.

Mr BBB, the problem is that most people are not trained like yourself, in reasonable force. There will be four outcomes, get away from the danger, too little force, and you get your head kicked in or worse, just the right amount of force, which is legal, or...too much force caused by panic and you, the victim end up being the aggressor. Absolute minefield.

I studied law at uni and always found the Martin case very difficult. Ultimately the burglars fled when they seen he was armed and both were pursued briefly and shot in the back (which was a major factor). That said if you've broken into my property and I catch you there I feel like I'm entitled to perceive the highest level of threat without any objective challenge - you've broken in with the intention of stealing from me, am I wrong to believe you may be armed (at the very least with the tools required to break in which could be used offensively) - therefore I do not think that the use of severe and/or deadly force in any circumstance whilst you are still on my property should attract any scrutiny from the police or the courts. You shouldn't have been there, end of story.

It might be seen as not unreasonable to expect such a gratuitous invader to be carrying a knife. This might not be on show while he wanders about my house, smirking. My severe response might be grossly disproportionate if he was shown not to be carrying a knife. What then?

Do they take into account that the homeowner would be alone, or a family with defenceless children. Whether they are female and the intruder male, which is the most likely scenario. How many intruders, as in Tony Martin case, he was outnumbered from the start. Whether a homeowner is disabled. It is not always a one on one situation, a male and male.

UK law on intruders is so backward, if an intruder dies when breaking in it should be a case of "That's too bad" room temperature challenge award no further action taken against the homeowner.

Under normal circumstances house invaders intent on threatening or harming you in the UK are extremely rare many people can get the wrong impression if not consulting statistics.

I had a friend who was a veteran, he was stationed in Hereford. He was woken up by four men breaking into his home. He took them up on their offer to play but the fourth one ran away even though he waved to him with the shattered arm of the third man. The police arrived for a post play review but the only conscious one didn't want to comment. They never took him up on the rematch.

8:20 obviously what I am about to say is purely personal opinion, and has no basis in law. But in my personal opinion, it's quite reasonable to continue to give chase to a person who entered your home uninvited with ill intentions. It is also reasonable to continue to attack said person, until they submit to you and then you can wait for the Police. But if they are running away, having already broken into your home, then they are trying to escape justice and in my opinion the person whose home was attacked has a reasonable demand for justice to be served under those circumstances. The piece of crap burglar, if he doesn't want to get attacked, can just submit and wait with the home owner for the Police. Otherwise, he's going to get what he's going to get. If he doesn't like it, perhaps stop breaking in to people's homes. I don't have much sympathy.

I take the position that if someone enters my home like that they pose a threat to my family. It is my duty to protect my family so I would do whatever was required to remove their ability to cause them harm. What action that includes would depend on how they responded to me but I would not be inclined to believe a single word they say, after all, they committed one crime by just entering my home.

This is where I disagree with the law. To defend yourself is to make sure the person attacking can no longer attack you. If you hit someone they go down they can get up again. You cannot be unjustified when someone has come into your home to make sure they stay down, leaving them on the floor in your house and expecting Hollywood movie knockout to last as long as it takes to the police to arrive could be your final and fatal mistake. You do not know the strength of a home invader nor anything about them as nobody plans for their home to be invaded. Incapacitating someone in the heat of the moment should not require you to think about the damage done to someone who's taken their own responsibility to come into your home and hurt you and/ or your family. This country is a joke. Wasting your time in court arguing you used reasonable force when all you thought about at the time was protecting yourself or the people you love from an unprovoked attack.

Ok. What do you think of this? A solicitor office was being burglarised and they discovered the offender was gaining entry through the chimney, so they had the chimney bricked up. Then when the offender next tried to make entry, due to the bricks he got trapped and died. Knowing they had comparatively built a trap by blocking off the exit whilst leaving open the entrance should they be held responsible?

If he invaded my property, especially if my wife and daughter were home. My take on it would be that I don't know who he is and I don't know if he's armed, and in that case I'd rather be judged by 12 people in court than carried by 6 people to my grave. He wouldn't be walking out, and that's for sure.

If a stranger says, "Do you want to die?" there is no way of knowing whether they intend to kill you. Random killings happen all the time. I would have to take that as a genuine threat on my life. If I couldn't easily get away I would have to at the very least incapacitate that stranger for long enough to give me time to escape. If he ends up dead and I get charged with murder then I would have to plead not guilty, get a good lawyer and hope that a jury would see sense. If they don't and I end up in jail then at least I'm alive. If a person breaks into your house at night then there's a good chance that no one knows they were ever in your house so if you do kill them you're better off just making the body disappear and keeping your mouth shut.
