How Foreigners Can Own A House In The Philippines.
Questions in the comments welcome.
In this video I wanted to show you the current costs of a modern better built house in the Philippines built on a 420 square meter plot.
More and more foreigners are expressing a desire to retire to the Philippines to take advantage of the low cost of living and laid back lifestyle. Houses like this in some countries could cost many times the cost of a similar house in the Philippines. The house featured in this video is located in Cebu City.
Some foreigners want to own their own home. There are however legal restrictions on property ownership, many thinking the only way over it is if they are single is to buy a share of a condo project which will last fifty years.
However few know it is also possible to lease land for 50 years (25 plus 25 automatically renewable) for a one off payment for the full fifty years. You are basically buying the land at market price but rather than getting the title you are getting a maximum lease allowing you full use of the land for fifty years. You have the opportunity to have a garden and you can retain full ownership of everything you build on the land. It can also be written into the lease if the laws change about property ownership for foreigners, for a small nominal payment (to cover the taxes) the full title can be transferred to the lessee from the lessor. It is also possible for the lessee to sell the lease and property on the leased land to a third party or leave it to their heirs and successors under the same terms and conditions if the laws change about property ownership.

I’m Filipino but was born and raised in America, can I still buy land and a house in the Philippines or do I need my father purchase it since he was born and raised there?

​@@pangelo4023 If you were born in America, you are an American Citizen and would be treated as a foreigner when attempting to purchase a house and lot in the Philippines. Only natural born Filipinos that gave up their citizenship can re-acquire Filipino citizenship.

I love the informative nature of your channel. I wonder, a foreigner can only lease the land for 50 years and own the house, but since the house becomes a part of the property, does the lease also apply to the home so that it can't be moved? 😀👋

No, the lease is only the land so any improvements done is owned by the lessee and when lease is up he either remove the house or have it refunded by the land owner but since its a 50 year lease it is like the land is bought by the lessee and a house may not last the term of lease.

As a foreigner who lives in philippines don't bother buying a house,buy a condo which will be yours 100% and can sell anytime ......

pilots71 I need to do a video about condos, few know a condo project has a life term of fifty years after which the if condo project no longer becomes viable their ownership becomes questionable.

I totally disagree. Condos are completly overpriced and usually located in crowded Areas. Depends on the Place/City, for the same Money you get maybe 40-50 sqm Condo instead like here, 220 sqm House and 420 sqm Lot. For those People have any fears for their Investment, you can find a big number of nice Houses for rent. That's the best way if you're Single without any Family Connections. You stay flexible to move to another City/Place anytime. Additionally I have to say, it's not easy to sell a Property in short time. Most Filipinos don't have Cash to buy a House, only Foreingers can do. There's a huge offers of Condos and Houses in the Market, so you're in a Competition with other Sellers. Rent first and look around, invest your Money only when you're pretty sure that the choosen Place is perfect to settle down.

The thing I've noticed at virtually all of the condos I've looked at and lived in within Phils. is how poorly they are designed. The people who design those should be forced to live in them. I'm serious, it's like they were designed by intern architecht wannabees.

The design life and construction quality of high rise condo buildings in PI will struggle to get 50 years old and still be viable. A single house built and maintained to your standard will give you a lot of enjoyment and value and still have value to sell the balance of the lease after 25 to 35 years. So your money is not lost

Looks like a very nice house even by western standards. I was expecting it to be much more as the quality and craftmanship seems to be much more than usual. I think I'd still risk it all and buy the land as well in my wifes name of course. I think if you use the better products and keep a watchful eye on construction to make sure corners are not cut you can have something built that will last quite awhile.

Matt Hammer Compared with Western prices I think they are good value. There are a few comments that Filipinos can't build houses compared with the UK and Germany, but there is nothing stopping people building their own houses to what ever standard they want.

@@villagepeoplephilippines I think with compared to here it's an absolute great value. And then mix that with the much friendlier people, weather, food etc. it's the best deal out there. I think maybe what people don't realize is that there is different grades for the rebar, pvc, wood, cement, fixtures, appliances tile, etc. there. So you can build something nice that will last a very long time or not.

@@maddhammer5776 If the lease is 25 years or 50 years. Then the quality of build should match with a useable life of 25 years or 50 years in my opinion. It would be poor economics to over develop the site.

I will never buy a house in the Philippines period. I don't care what ways you try to go around it, I have read of people getting screwed on those leases too. Bloody waste of time and money. People will never learn.

Thankyou thankyou thankyou!!! Finally a video showing a house that is not too basic, not a mansion, not a condo and a realistic price. There must be a 100 videos online showing hollow block steel roof, basic houses but this is a comfortable option. Can you please give me an idea what area near Cebu it is in ?

Mark Jones. Yes there are available plots, closer to the half hectare than the 2 hectares available on long term lease. It depends what you are looking for and the purpose. If you are thinking of a farm the land in Cebu City is rather expensive but you have the luxury of being close to points of interest, hospitals and comprehensive shopping. What is you intended plan?

@@villagepeoplephilippines I understand large land will cost more but a min 4000m2 would do the job. If it was priced ok I would consider buying something bigger that could be split into smaller pieces. In that way we could sell what we want to reduce the cost of keeping more. I have done this before and it is a good option. I am not concerned about some of risks of having it in my wife's name.

​@@kramsenoj1 I know of raw plots that size for sale, located in the mountain Barangays of Cebu City proper 15 Minutes from major hospitals. Selling around P2K to 2.5K per square meter overlooking. Land selling in the same area selling as subdivided plots are in the range of P7K. Land further away from the city costs less.

Foreigners can't own a property in the Philippines so don't kid yourself that they can. I know. I am married to a filipina and we lived in a house we built, for much less than this one and better and bigger too, and my name was on the deeds etc. BUT... when we came to sell it my signature and presence were not required at all! My wife simply signed her name and it was sold. I asked the attorney, who was also a friend and she explained that my name on the deeds etc was simply a way to show my presence in the process and that it a way of identifying those in the process but my wife could have sold it at anytime beneath me. Not that she would but we heard of others who had this terrible experience. So don't buy into the myth that you can buy and own a property in the Philippines, you can't.

borjastick I think every foreigner knows, that follows my channel, they cannot buy a house and lot or buy a lot to build a house on. But this video is about the cost of building on leased land. Foreigners can legally own a house built on leased land. The constitutional restriction you mention applies to land ownership not the structure built on the land. It doesn't work for married couples as it is not possible to lease from one's spouse. Also your lawyers explanation about why your name is on the title deeds of the land is not correct, the only reason a foreigner's name is on a title deed is to show the marital status of the legal owner of the land recorded on the deed. One other thing, I agree you get more for your money if you self build, this was a contractor build. I even made a video about self build vs contractor build.

Foreigners can not own the land. If her wife and in-laws are against him, he will be told to leave together with his house. So the ideal house for a foreigner is a camper van.

@Village People Philippines... 2 QUESTIONS!!! Being an American married to a Filipina my main concern in this scenario would be not being able to pass the house and property on to my wife and any children we have, after I die. I'm 60 and she is 38. A 50 year lease puts her at 88 years of age with the potential to be homeless at an age that she would need housing and financial stability. 1st question, when the lease of the land property expires/terminates after 50 years and the house is a permanent affixed built house on the property, does my wife and children lose the house ownership that was titled in my name to the property leaser or is the property leaser required to purchase the house from my wife at the value I had it built or for fair market value at the time of lease expiration or does the leaser retain possession of the house as well as the property? I am not a fan of losing assets even after I'm dead, to someone I do not designate as deserving them. My wife and any children that have not been corrupted and are responsible deserve all my house assets, not a leaser. 2nd question, is it a legal possibility to lease land from a Filipina for 50 years before you marry her, since leasing afterwards is forbidden legally. In other words, can she buy land with money I give her before we marry and I then lease that land for 50 years from her while we are unmarried and build a house titled in my name as owner on the leased land. Then in a specified legal timeframe marry her in order to avoid any legalities? I appreciate your input. Thank you in advance.

I'm blessed and grateful to have grown up in the Philippines. Wanna know why? So I can explain to these poor, perverted middle aged dorks that they're being sold a pipe dream. Firstly, the legalities of real-estate leases and property ownership are shoddy and questionable at best. While the Philippines has a beautiful culture, and the people are some of the most hospitable in the world, the truth is they know about desperate old guys desiring to retire in their country. Subsequently the laws are set up to protect citizens, not ex-pats. Putting a house in a filipina wife's name is madness... I personally know a guy that married and purchased a home, truck, and motorcycle in Cebu. Seemingly he decided to return to the states for a two month visit, and when he returned, his wife had divorced him and he lost it *all*. The police wouldn't even let him in his home to retreive what was his...his wife had moved her family in. Scammed and hustled. Your best bet is if you really feel compelled to move there is to just lease a place. If your desire is to meet a woman there, fall in love, and live happily ever after, rethink your plan....especially if you're middle-aged, trying to hook up with a young woman.

If the foreigner leases land and he can for fifty years, he can build his own house on the land and not have to concern himself if he wife divorces him or his girlfriend leaves him. Leasing from a third party removes a lot of relationship worries. Had the guy you knew leased from a third party in his name, it would have been a different situation.

@@villagepeoplephilippines it's the laws there which favor citizens...and rightfully so. There are also nightmare stories on other channels with comments about 50 year leases and what went wrong. Seemingly building standards are not comparable to those in the U. S. , Canada, and other western countries for that matter. For example, I noticed how the home in this video lacks proper ventilation in the soffets of the roof... very important especially in climates of high heat and humidity. Also, the foundation of that house doesn't seem to be sitting on a proper concrete slab. In sum, if I was to ever consider moving back there I would build a house with my own hands or be on site to monitor all the contractor. Again, most male Americanos that move there have the intent of meeting a young Filipina wife... they need to rethink their intentions.

@Tony M Spoken like a true Prophet. Not only in The Philippines, but throughout SE Asia foreigners cannot own land. I don't know why she's lying to the people. (a sales, money hustle is my guess.) Even the lease hold she talks about is never ever done in Cebu.

250 square meter house ? That's a pretty good size houese ! My fiance owns land in Butuan, Anini-y, Antique on Panay Island and her brother will build our house for 1.5 million php. I cannot wait...I think we are going with about 157 square meter. It is my understanding that a foreigner cannot own the land but can own the structure on the land.

you can buy an ugly old house in Angeles now for about 10 m pesos. land is becoming 20k per sq m. a condo of 60 sqm will set you back about 6 m in some areas.

No, if its in the contract that is legally signed by the land owner. And also that option should not be in the contract and a penalty of some sort if landowner chose to not to honor the contract. Its all in how the contract is written because a long term land leasing is like buying the land itself .

A Foreigner Living in the Philippines. Good value for a furnished house. Location has a lot to do with it, Talibon is known to be a cheap place to live and that is obviously reflected in the property and rental prices. 5000 per month would get you a very basic unfurnished room, without a kitchen or garden.

Mathew Peter Foreigners can not buy land but they can lease. If leasing for residential purposes maximum first lease is 25 years plus renewable for another 25 years, but for commercial purposes maximum first lease is 50 years plus renewable for another 25 years. A foreigner can not own the land (except under certain circumstances concerning inheritance) but they can own the structures built upon it.

I have been looking at property in Cebu for 6 months now. The realtors there seem to specialize in just one tract of new homes or one area. I looked in Vista Grande but to hilly for me. Would like to find something more level for walking. Let me know if you can help? A reputable contractor would be nice too. How long was the construction to get the house to this point? Thank you. Actually its just different carpenters, masons in the neighborhood doing different kinds of jobs as they go on under the supervision of the owner itself. The house is designed by an architect friend of the owner.

As far as I know a foreigner cannot own land in the Philippines, so how can I own a house? I am aware I can form a corporation which has to be 51% Filipino owned, which can own land. This means I would have to trust my partners, and I have been divorced twice and lost a house twice.... I have no problem putting the title in my wife's or our daughter's name though, so just making people aware! I also know, as a fact, that foreigners can inherit property which can be sold or only be passed on to a Filipino.

Foreigners cannot buy land but they can lease land for 25 years and renewable for another 25 years in which they can then own the house they built on it.

And you are wrong, a foreigner can own land under special circumstances like a Foreigner married to a filipino can succeed land thats the only a foreigner can then own land here. I will do a follow up video to answer comments and more thorough details.

This doesn't seem like a 250 sq meter home. That about 2,700 sq feet which is HUGE, seems there a lot missing.

@@villagepeoplephilippines Goodmorning to you day, its already 0651 here in New Zealand. The term "Master", was an old fashioned reference to the head of the house, usually the husband or father of the family and usually only applied to landed gentry, (rich people with a title) hundreds of years ago. That term in not used in todays society where men and women are more regarded as equal. Generally speaking, the bedroom where the husband and wife sleep is referred to as the main bedroom or the number 1 bedroom and this is also referred to as the Master bedroom, (no "s). In the video it was likely a slip of the tongue, I meant to say "master bedroom" as it was the principal and largest bedroom and my audience was foreigners, I had not meant to say "master's bedroom" although actually BOTH ways of referring to it would be correct here in the Philippines. Don't forget here in Philippines as the term "master" is still used in the way that it was being used, as you described hundreds of years ago. Live in maids and drivers, still refer to the head of the household as "their master" which may be repugnant to some but it is a fact. So if talking to a Filipino asking a question I would probably say "where is the master's bedroom?" But if referring to it as a room to the viewers I should have said "master bedroom".

Would it be better to buy the freehold in the filipina girls name then she grants you a 50 year lease for a small price. Then you build a house that is yours but will end up being your pinays in 50 years time. If you split up she moves out or you sell the house. If you die you could leave it to her or someone else or e.g your kids if you have them together, seems like everyone is a winner in this type of set up? What you you think ?

Captain Bitcoin, there is an anti-dummy law here in the Philippines, which you could be accused of violating by the Filipina if you split up and the Filipina complained. Something that would not be a problem with a third party. One can also not lease from their spouse. I intend to do a more in depth video about the legal aspects explaining why such a concept is a good solution compared with a condo purchase which too only has only a 50 year life which many people do not understand.

I am curious. If you were to build this same house without a contractor. How much do you (rough estimate), think you would have spent, minus non-citizen fees and land? My own personal estimate would be less than one million pesos. Maybe fifteen thousand pesos.

I think with no contractor you just organize the build yourself and just the house building around 2 million pesos same finished as contracted here, with walls around the property, driveway and gate

Who pays the yearly property tax on a leased land? Will it then get re-appraised with a new house on it and at such be have a higher property tax amount?

Bal Susan. The house is assessed separately from the land, the house assessment can be in the foreigner's name who will pay them directly. The land taxes can be paid either by the land owner or the occupier, depends on the lease contract.

I think renting the lot to build a house works for a single foreigner. If you're married to a filipina, you can buy under her name and build the house.

Had you leased land and built your own house, then when your ex left, you could have continued living there as the lease holder and owner of the house.

Village People Philippines the land was owned by her father who gave it to us so we could build a house were i could retire...everything was done in good faith ! But after sending money for a year we arrived and what i saw was only 4 walls and a roof ...i was in shock ! I did my best to accept and for 4 months i spend the rest of my savings to finish the house but it was to hard for me to keep on spending and sadly i had to go back for major surgery to my country belgium ...and once we were back a few months later she left me coz she didnt want to play my nurse she said ...now i am sueing her for the fact that she and her family have been lying to me all the time while i was sending money ...her father never owned the land ...the title belongs to her grandparents

Jennifer Davis, Correct, but Foreigners can however lease land from a Filipino and own the structure they build upon it, which in is essence similar to a condo ownership. They could build a nice house on land they leased for a similar price to a one room condo here in Cebu.

Some people think it is stupid for foreigners to spend their retirement in a small room when they could have spent it in a house they own on land they leased for the same price or even less. But it was not my idea, there are many foreign corporations leasing land and building large buildings on it. I even know of a mall owner that leased the land and built a mall on it.

Mark G Written into the lease there should be a clause that if the law on foreign ownership changes title to the land would be written into the lease. Single foreigners spend a lot on condo units, I am showing them another way. It won't really apply to you as you would be better buying a plot, or rather your wife buying title to the plot, and building.
