How to Avoid GDPR Legal Issues Over Cookie Consent

If you use certain types of cookies and fall under the scope of the GDPR, you’ll need to get consent for the use of those cookies.
Cookies that require consent include cookies that collect personally identifying information. For example, analytics and targeted advertising cookies require consent.
Consent is not needed for essential or strictly necessary cookies, such as those that are required to make a website work. For example, cookies that remember shopping cart contents or allow media to play on a website do not require consent.
GDPR-compliant consent must be:
- Freely given: You cannot require consent to be given
- Specific: Offer choices to users about what types of cookies to accept
- Informed: Add a cookies clause to your Privacy Policy, or have a Cookies Policy
- Unambiguously given, such as via a clear, affirmative action: An “I Agree” checkbox works best.
You must allow users to revoke consent easily after they’ve given it.
