European here, assume she did make a mistake and did the list the wrong way. Isn't this action a bit overkill? If someone would have done this mistake where I live, it would probably been something like this: -"Hey, I noticed you did the list from the bottom" -"yeah..." -"Its more important to do the top of the list, than the bottom, so do it from the top from now on." -"Okay" -"Coffee?" -"Yeah, sure" Two weeks later, neither of the two will even remember the "incident"...

@@nilov71 Imagine in a 3rd world country a programmer writes a poor code that "assumes" the inputs are right. Then someone swaps the list from top to bottom to bottom to top and it's a medical facility. Like just imagine everyone getting their medicines swapped up, etc. Depends really on where you are, for example not as a list but in a "water processing facility" (or smth similar was years ago) I had been on school practice and basically one guy swapped up labelings and they were like "do you... know... how serious this sht is?" and they couldn't tell if it was me or them so we both had to label about a few hundred bottles to "learn a lesson". That wasn't a nice day and I knew it was likely them as I remember checking every row I sent in about twice. I also am an introvert for most part and hate when people are dissatisfied as that means they will complain which is something I don't want to hear so instead I check everything three times if only needed twice too. Just to be sure. The reason I say it was "likely them" as yeahh that was a moment where I was like "okay we are done.. I guess... we sit and wait?" but then who knows if maybe I missed it or not. Maybe I looked at 77 and thought it was 71 who knows, we got questioned about it a few days later too soo. but since then I document everything I do if it's official at least in a note.

Well not 2 days after I installed it got another complaint. This time showed the tapes from the entire route and got to go home early with pay. Next morning found out all the complaints were being reported by one guy at work who I had a beef with. He hates delivering products to customers and wants all customers to come to the store instead. He tried to justify not having deliveries with amount of complaints. But the dash cam blew it up for him and he still mad.

Pro Tip: Speak to a criminal lawyer in the jurisdiction you work in and make sure it’s legal to record people, BEFORE you record them. Recording someone without consent in a two party consent jurisdiction or recording someone without consent in a place where they have an expectation of privacy is a crime in some place. This is why you can’t put a camera in a bathroom.

True, but it also matters how they were recorded as well. For example, if the company has the ability to record a work telephone and someone calls said work phone, then it would be allowed. There is no expectation of privacy on a phone that records or can record calls. But here, it's hard to say for certain how it was recorded.
@Toliman.3 ай бұрын
Recording a call within the context of a workplace is not so unusual because various companies forward/manage their calls via a PBX type VOIP system which records all calls, internal or external for 'testing and training', sic. Complexity is an understatement. Various companies compel recording for different purposes, legal domains, causes, performance and other actions. Keystrokes, logins, presence / security keycards, bluetooth tracking fobs, call monitoring, call recording, phone recording, phone tracking, phone administration / management, et al. Privacy in the corporate environment is a luxury in the modern day. Two-party laws are uncommon, as is video with audio recording in private locations. Some places, you can't record a driveway or front door, while others it's legal since it's private property. Transcriptions are also a grey area on this as well, since lip-reading can be obtained, sic. Making your own audio recording isn't always legal, except in certain circumstances, i.e. where you are recording your own performance and someone comes to interrupt. Hence the justification of this use-case can be fleeting, you also need to be recording your own performance ie attending a video meeting and someone coming up to you does not require two-party consent, since they are the third-party (sic), in this case. You can see that this presents lots of issues in certain justification/scenarios where you want to record yourself, and another party intervenes. Bigger Multi-state or Multinational companies often have the advantage of location to provide transcripts/recordings, depending on incorporation locations. It's another Delaware advantage, sic. Legal issues aside, It's a rather large investment in time to keep these recordings. It's hundreds of hours of audio in low quality. Most companies that switch from older voice calls to PBX with internal lines / extensions will have a call recording function built in for internal calls and extensions. Not always, but often enough. Virtual PBX or VoIP handsets, the recordings happen at the exchange, or in the cloud, sic. which allows for the audio to be sent off for auto-transcribing. A few companies will auto-transcribe the calls and office-communications, used for reviews, timeline investigations, conduct/manager reviews, and when HR deals with potential conflicts. Mostly to establish conduct, because they can't easily be used as evidence without direct consent. It might not be able to show these transcripts to employees, depending on the legal issues or location of the recordings, sic. But they would likely have a few key words flag calls, emails and communication topics that are potentially liable. This would be part of the work contract to allow for this, but in general, it's 'noise' until something goes wrong. Even in a two-party state, internal call monitoring and video without audio is often used to skirt these restrictions, because even with a sign or alert, that's not enough for legal affirmation. It has to be signed over or waivered to ensure legal fidelity. Workplace contracts and conditions will also often state an adherence to recording in public areas for the purposes of safety, training and supervision, you are granting consent to recording in open areas and to have your performance reviewed, conduct and activities, et al.

The manager gives Veronica a "needs improvement" on her next two performance evaluation. Then fires her for not meeting standard after manipulating her performance records. The manage continues to treat the staff poorly. After a 48% turnover, upper manager is baffled as to why performance is dropping. The upper managers calculate how these numbers will negatively effect their bonuses, and decided something must be done. The middle manager is promoted to a senior position and gets a pay increase, and is put in charge of employee retention.

I started doing this in the early 2000s. We kept getting in trouble with our management because they said that we'd leave our trucks trashed. We, of course, didn't. I started taking pictures of the interiors prior to us leaving for the day. Turns out that maintenance liked to eat lunch in the back of the trucks and just left their trash in there. Additionally, we were frequently told to do inventory on sets with expiration dates. We'd know that stuff wouldn't expire for months and all parts were present, but they'd want an exact report. We took to putting seals on the sets with the earliest expiration date. Nobody could break into the sets to "borrow" something without breaking the seal, and the expiration date was not going to magically change. They'd give us their inspection task, we'd fill out the paperwork in 5 minutes, but we'd forget to turn the inventory in until the end of the day.

btw in almost all states you can record your own conversation with anyone so long as you notify them. Some states don't even require their consent so long as you are part of the conversation, but in other states you need to obtain their consent to record them. However, this consent doesn't need to be expressly stated (except in some rare cases). Simply notifying them that they are being recorded. If they continue with the conversation willingly, that implies consent. Obviously look up the law in your own state (assuming you are a citizen of the united states) and ensure you are following it. It's always a good idea to protect yourself, and if someone refuses to have a business conversation recorded, that typically means they are either going to lie to you, or they are doing something shady that they don't want other people knowing about.

the problem is, since she DIDN'T consent to being recorded, its still going to be HR hammering her, because she just violated the others rights, which is an actual legal issue, not just a "you did your work incorrectly" problem. She proved she didn't do the other action, but she did so by admitting to something else far worse, legal wise, like how you will be in legal trouble for resisting arrest even if you are cleared innocent of the crime you are being arrested for. So while she'll be let off for the prior action, HR would most probably turn around and go "thank you. And I'll talk to her about that. But you are in far, far more trouble now as you did something legally wrong on COMPANY time as a company employee, putting the company at liability if we don't take action." because if HR were to take any other action against the manager or aknowledge this, yeah, this ISN"T law and order, but then her superior can legally bring it against the corporation itself for utilizing it in their decision for any discipline she receives. Because the corporation actually cares more about an employee doing something that could jeapordize them financially/legally more than incorrect work. Its a catch 22 here. She may get HR pissed at her boss, but she just torched herself in the process. This has big "And then everybody clapped" energy to it.
