It's a shame that you have to jump through hoops and consider and plan just to exercise a guaranteed Constitutional right. This is a prime example of why we need national reciprocity.
@quintaeco4 жыл бұрын
why we need #2A advocates to push law in a 2nd Trump term!
@iii-ei5cv4 жыл бұрын
can't have national reciprocity if states' rights matter on regulating firearms You don't want NY or CA laws being applied to Texas (that's one form of reciprocity, obviously not what most people mean). We have two real options to further reciprocity (of the kind we want anyway): 1) The federal government steps in and says that states may regulate certain aspects, but at the same time all states need to respect certain baseline standards. This is somewhat de facto in that right now laws like the NFA and organizations like the ATF regulate certain aspects of firearms ownership, while most legislation is controlled by states. The issue with this approach is that even in 'preserving' states' rights you are empowering a federal institution to govern firearms. The most logical organization to oversee this is the ATF, which of course no gun owner really trusts 2) Force the courts to consider the issue of gun rights through the prism of the of the 14th Amendment. Supreme Court cases like DC v Heller and McDonald v City of Chicago took this approach to strike down local gun control legislation. Future cases are most likely going to make their way through the court system, and where gun rights are preserved/gun control struck down, the 14th Amendment is almost certainly going to be involved. **** Let's circle back to something though: citizens in Texas do not want to be governed according to the whims of NY politicians when it comes to guns or anything else for that matter. As a gun owner in NY, I very much would like NY gun laws to be more like those of Texas, but the majority of citizens in the state (most of whom live in/near NYC) very much disagree with that. There is an easy solution to my issue: I move to Texas, or any other state that I feel has policies in line with my principles/interests. This is the beauty of federalism and the way our nation was intended to be governed. Frankly, a lot of us think about gun rights the wrong way: we *shouldn't* ask that other states be governed exactly like our own state, since we know we'd hate for those other states to govern us. Instead, we need to insist again on different states having wide latitude in determining their own policies. States' rights shouldn't be thought of as a relic. Instead, they should be embraced whenever possible as a necessary compromise where local priorities can be codified as law, instead of our present political environment which places far too great an emphasis on controlling national institutions.
@compasslife66584 жыл бұрын
The 2nd amendment as written needs no reciprocity. States have over reached. Can you name any other Constitutional right that changes at state lines? SCOTUS needs to rule on this once and for all.

Wrong, if you are stopped it is because you are *SUSPECTED* of something, even if it is as simple as driving a car vaguely matching the description of a car they are looking for. You are innocent until proven guilty, even if they do not treat you that way. Don't answer questions and never consent to a search. Ever. You have nothing to gain by doing so, and the most illegal and harassing searches become legal the second you consent to them. NY and NJ don't respect FOPA. Make your lawyers life easier if they do decide to trample on your rights, once you consent it can't be thrown out. Exercise your rights people.

Just moved to North Carolina from California. I couldn't store/ship my ammunition let alone my firearms. So I put the back seat down, placed the firearms in cases locked and unloaded on the floor of the trunk and back seat. Then I placed the ammo and accessories on top of that, hard cased and locked. These were a little off to the side. Then I placed the duffle bags on top of all that, a really tight fit. I had a California CCW and hit the road with two weeks left on my 30 day apartment notice, so technically I still could carry had I chose to. This of course in states with reciprocity, which are not that many with CA. California does not recognize CCWs from other states, and for that reason, not many if any states have reciprocity with California. I opted not to carry period on my move. I made a pit stop in Memphis and picked up my AR and continued on my journey. Love is an AR you haven't seen in about 5-6 years. Oh joy! Rapture!-The Scarecrow Had I been pulled over and been hassled about the firearms, I would have challenged the officer to access any of the firearms from the driver's seat buckled in with keys in hand. In two minutes. Not possible. Anyway, no longer in Commiefornia. It's probably not strictly legal, but it is the spirit of the law. None of my 10 firearms were accessible from the driver's seat. So I was comfortable with it.

But, crossing those state lines makes us felons-in-waiting with our arsenal. Anyone figured out how to deal with that scenario?? Leave coach at RV Resort with guns (maybe $200+K value) locked inside, using Jeep to cross into CA. Rent storage locker (U-haul,...) to leave arsenal. LEO suggested exploring leaving at gun store/range before entering CA. All have high risk and/or require exiting anti-gun land at same entry point to recover arsenal/coach. Anyone traveling to shoot competitively/for training that has successfully dealt with this issue??? Real sticky issues.

Understand that some states narrowly construe what it means to travel. Did you stop for the night? Guess what, you stopped "travelling". Would stopping to eat mean you have stopped "travelling"? I guess that depends on which cop stops you. For multi-day, cross-country trips, this means you start "travelling" in the state you are in in the morning and stop travelling in the state where you get a hotel at night. For FOPA to be effective, everything you have must be legal in the state you start travelling in and the state you stop travelling in. Also know that interstate travel with NFA firearms, with a few exceptions, must be approved by the ATF.

When I fly to Florida, I can legally check in my firearm at the airport in Philadelphia. But sometimes I have to fly from Baltimore. Maryland has very strict gun law. I am not sure how they would react on me transporting firearm to and from the airport. My understanding is that I should be protected by FOPA since I am going from point A to point B where I can legally be with a firearm, and Baltimore airport is just a transit point. Have anyone had a similar experience? Please share.

Y'all should apply for passports as non-citizen nationals. James C Lovett on Yt has videos on it. If you have at least 4 stars, you'll be put on a do-not-detain list because it restores your Constitutional rights! You must write the endorsement # 09 (ALL), write "UCC 1-308 Without prejudice" before signing and provide an explanatory statement and your COlB (Certificate of Live Birth) or an authenticated (state and federal levels if born in the USA) Birth Certificate! Get rid if your driver's license if you do not drive commercial (Uber, Lyft, USPS, Shipt, etc).

FOPA will not help you if you have magazines that hold more than ten rounds if you are driving through new york or massachusetts, etc. So you won't be arrested for the gun, but the magazines. FOPA is very weak.
