I have a headache and nausea mostly every morning when I wake. I have become so accustomed I never sought treatment. Looked back at my medical records from my private doc, nearly every well visit I complained of a headache and I didn’t even realize

I’ve had a in person c&p exam then a ace exam now I’m having another in person c&p exam for migraines I have a military nexus and everything with my migraines documented and the medication I was prescribed for migraines along with a list of all my other medical disabilities and medication, hospital stays etc….it’s all in order this time my story actually matches my paperwork this time the first time I went my paperwork was a mess. Also bringing paper proof of economic stability thanks for the video!

I have a In Service Event in my Military Medical Records, a Lay Statement for a Nexus, and a Current Diagnose at the VAMC. But I still got denied they said: "Service connection for headaches is denied because this disability is determined to result from a known clinical diagnosis of unspecified headache, which, under current law, is not a qualifying disability associated with Gulf War service." My medical records show that I got headaches but didn't specify what kind of headaches = Migraines. Can that be a denial or am I reading that wrong?

Looking advice. When I retired 9 years ago, my VA ratings included a deferment for headaches pending completion of a VA medical opinion. I was never called or scheduled for that VA medical opinion. Presently, my headaches are much more frequent and severe. Is it advisable to file a new, secondary, or supplemental claim for the headaches and why would one be better than the others? I do have service connected cervical spine issues that I believe are the cause of the most of the headaches. I'm getting a neurological diagnosis soon to support the claim. Is it possible to get back pay for the 9 years?

I definitely need to do this. I’ve had migraines for 30 years, 2-3 times a week and I’ve had them last nearly 24 hours. My medical records reflect my prolonged attacks where I’ve had to lay down for hours and a couple hundred ER visits on top of that. I should have gotten 50% for them when I retired but for some reason I didn’t. I had a bilateral fusion of my L4-L5-S1 discs and I am in constant pain and have neuropathy and radiculopathy with limited mobility. My right leg continues to gradually grow weaker. My overall rating is 80% but the 30% I have for migraines should be 50%, that should get me 100% I think.

If you're 80% and have 50% for migraines that = 85%. You would be paid at 90%

Wvbulldog, you are correct, your headache claim should be at 50% right now, I am willing to bet that whoever helped you submit your claim failed to get you to write a good personal statement for headaches. A good personal statement is the difference! That is why I harp on it so much and why a major portion of the VA Claims Academy value proposition is the fully pre-written "plug-and-play" personal statement templates created and refined by yours truly. Your back rating should be 30% (back) plus 20%+20% (Bilateral radiculopathy) with the bilateral factor increase. So if you also are under-rated there, I would strongly encourage you to consider filing a proper bulletproof supplemental claim. If you file a new supplemental claim and you're missing something, or the personal statements are not worded perfectly, you could actually be opening yourself up for a DECREASE so make sure if you do it, you do it the right way. The difference is over a thousand dollars per month, even between getting 94% and 95% so don't be afraid to invest in good guidance that will end up paying for itself every month. @@vaclaimsacademy I’m definitely going to do it here very soon. I was reevaluated a couple years ago for my back and the cumulative of my related disabilities led to my I increase from 70% to 80%. The next higher rating would have to be a result of a combination of atrophy and/or paralysis so I don’t know if I would currently qualify at the moment but I know that day is coming. My focus for now is the migraines rating because I’ve been, according to their own verbiage, hands down I should have been rated at 50%. Thank you for assisting veterans, I really appreciate it. Hi there Sir I have a question I already have 10%rate for tinittus, but ever since I had that issue in my head and in my earss I have suffered from headaches and anxiety and heart palpitations because I would feel deaf and not being able to hear on the left side of my ear and sometime on my right side ear, so I told that to my examiner but I only got 10%for tinnitus, can they give me 50%for migraines since this pains have been associated with my tinnitus and my anxiety all together? If it's so why they only gave me 10%for tinnitus, Thank u so much for explaining me

10% is max for tinnitus. You would need a medical nexus to connect anything else to your tinnitus

Yes, make sure it’s in writing on your personal statement on VA form 21-4138b and uploaded to Va.gov with your claim as evidence. I appreciate it my friend, cheers

@@GAvet4lyfe DAV and VSOs are free but in my years of experience, they might even ask you “why are you writing a personal statement, you don’t need that” yes, seriously 😂 Also bear in mind, you are opening yourself up to a reinvestigation when you file for your increase. That shouldn’t scare you, I just want to stress the importance of having all your ducks in a row when doing this and getting rid of the “unknown unknowns” about the process as much as possible. I’ll be able to tell you if it’s worth it or not, how good of a chance you have for what % increase, and how much you will likely be making each month after your increase is awarded. Keep in mind, if I feel like your case is a slam dunk and it just needs a good bootcamp crash course to get you to the promised land, I’m gonna recommend that route but it doesn’t have to be the course that I sell. Mine is the best in terms of efficiency, quickness and practicality being able to turn your brain off it’s so easy, but there are others like Combat Craig’s who are also a killer value considering the small price that pays for itself. But if I feel like maybe you don’t have there, and maybe you need a few more diagnoses or evidence before opening yourself up to risking a DECREASE, I’ll tell you that as well. Hi Jordan. Trying to understand the claims initial filing process better. Let’s say you used a VSO to file for certain conditions. You write personal statements for your different claims. You are denied or rated lower than you’d like. Are you allowed to write personal statements again for the denied or lower rated conditions?

Yes you are, it’s now “new and relevant evidence” which is the criteria for submitting a supplemental claim

I got 10% for Tinnitus. I get anywhere between 2- 4 migraines a week, and I am prescribed SUMATRIPTAN. Should I file Migraines as a secondary or primary?

I have the longest history with the VA and my chronic migraines. They still won't give me any rating because they say it's not frequent enough although I told them I have one everyday.

I hit 90% first try with migraines granted 0%. Decision was made on Dec 21st 2023 when migraine log was submitted on Jan 30th 2024. All I had submitted prior to decision was personal letter. I presume HLR is next step?

I got rated 0% and then denied increase with prescribed medications supporting dbqs and frequent attacks as i have told my neurologist i had submitted an migrain log stating my frequent attacks aswell, buddy letters.

Yeah they put me at 0% and I had an attorney that ended up doing an appeal for it and they denied that as well because the attorney was stupid and they didn't even submit any new evidence so I've withdrawn from them and I'm going to do everything myself. I got 10% for tinnitus and 70% for PTSD all by myself before hiring anyone

Had a C&P exam for migraines and provided a lot of evidence in my favor. About a week later I noticed that the C&P examiner submitted six DBQ’s in relation to that exam and I’m just wondering if that’s a good sign or a bad sign? I guess I don’t understand why so many would be submitted for just one claim for migraines. Any insight would be appreciated.

Johnny, I completely understand getting a bad examiner. I am guessing you did not submit a bullet proof, personal statement with that initial claim, I would file a supplemental claim, and take the time to write a bullet proof, personal statement. Cheers

Thank you Mr. Swoopy, don’t forget to have your fully developed claim filed 180 days away from your DOS. And do yourself a favor by really going hard on those personal statements. Trust me it makes a massive $$$ difference. Turn in on VA form 21-4138.

In my C&P. I had everything and the only box on 4a for Economic Unadapted he mark no. SMH. Gonna have to wait so I eventually increase and he put Mortin instead my actual med I’m on

Alfred, sorry this happened to you, did you submit a bulletproof personal statement for headaches explaining how you were losing hours? I don’t like relying on the doctors to do their job for that exact reason

@@vaclaimsacademy in personal statement I forgot to incorporate that, however he did ask me and I explained I was currently unemployed due to it and have to take on odd jobs so when I have to take the day I don’t risk getting fired for always needing to call out. That one box changed everything. I have a question when they check off that the condition affects a person ability to work is that good? Thank you for replying

Yes, that box being checked signals to the rater that you are in fact experiencing economic inadaptability as a result of your condition.

Can Migraines be claimed secondary to ptsd. I was seen once at sick hall for headaches but migraines started within 6 months of my discharge from the navy. They initially denied me saying they were a result of a car accident in 1994 and have since denied it every time a claim them

Should I submit a appeal? I told the c&p examiner that my migraines make me lay down in a dark room, and I also lost my job because I took too much time off and couldn’t switch to night shift like they wanted me too, due to light sensitivity while driving, I wear shades during the day but I wouldn’t try driving with shades on at night

@@AllSaintsWhodat Okay, there is no point in going for appeals and HLR's when your claim was fundamentally flawed due to insufficient lay evidence by way of missing bulletproof personal statements. My advice is to start over with a supplemental claim and do it the right way from the beginning knowing what you know now

n p ptsd exam telehealth with ves. A week later va schedules in person c n p ptsd exam in person optum. Is this normal or they didn't get the negative opinion they were looking for on 1st exam so they gonna do it again. What's going on here.

Maybe you can give me some advice? I have a 10% rating for tinnitus. I've been cleaning for years that my headaches and migraines stem from my tinnitus and I have seen four different neurologist none of which will make the connection they keep giving me drugs that's all they do they give me seven different drugs I've had 3 CT scans two MRIs also nothing wrong in my head get the headaches consist probably an average five times a week migraines at least once every 6 days yet the VA keeps denying my claim for the last two-and-a-half years. How do I connect it to tinnitus?

Not really Mark. People are so obsessed with those when the personal statements are where the real value is at. But personal statements can be done by the veteran so they’re harder to sell $$$$

I’m only 10% tinnitus . I have no service records for headaches . But I’m currently been on VA medication for headaches since Sept . No of it works . How would i be able to claim this , Been out since 2000 and have no civilian medical on this either

You need a diagnosis for headaches. Once you have that, claim headaches secondary to tinnitus, then write a bulletproof personal statement, and pay for a doctor to write a nexus letter for you

Ah I’m sorry to hear that, lots of vets get denied before getting approved though so it’s not over. Appeals are a court process but lots of our clients do supplemental claims with us

You identified a handful of hours, but mine last days... Usually get 2 a month with several small tension headaches throughout. Would this be similar then as your example for 50% or qualify? I use migraine buddy to track it all. For personal statements, are those added to the FDC or to the C&P examiner directly?

You would need to convey that you are missing $$$ as a result of your frequent and prostrating attacks in story telling format. Personal statements go to the rater
