I got really pissed off with the dude, like wanting him to have many bad things come to him... until Ethan got to the bit where he spoke about his son being rushed to the hospital due to the smoothie.. at that point I understand his anger, he did go too far but regardless I would have probably been just as pissed off. Nobody hurts my family. I definitely wouldn't have thrown the smoothie and especially wouldn't have come closer and tried to get behind the counter. But still I understand his anger.

No matter how angry I’ve ever been, I’ve never said anything even remotely as vile as that, because that’s not reflective of my values. Also, if my child had a deadly allergy, I would never buy him food from a place that even handled that allergen, just because it’s not in the food. Of course there’s a chance of cross-contamination. I won’t even let my kids take things like normal M&Ms, or other Mars company products to school, because they are made in the same factory as Peanut M&Ms, and I would never want to put another child at risk, even slightly (same reason behind why we’re all fully vaccinated and always wear masks). And this happened within 30 minutes of purchase, which means as his son was supposedly dying in the hospital, he was here attacking these teenage girls, instead of with his sick child. He’s disgusting on all fronts.

As someone with a severe peanut allergy: it's not their fault. If you want to have a peanut free item, you NEED to tell them that there are allergies involved. On top of that, you're taking a risk every time you buy something at a place like this. There are warnings for a reason.

I guess it’s a controversial opinion but I don’t feel like people with allergies or other health issues should have to disclose it’s because of a medical issue. Why should the server get to decide if your reason for wanting it made different is valid enough for them to actually do it? I know people with celiac disease who after asking multiple times if the food contained gluten then had to be driven to a hospital because the waitress insisted there was no gluten, assuming they were asking because it was “trendy”. Even in my case which isn’t nearly as serious 1/4 times when I ask for lactose free milk or one of those alternatives I’ll still get served drinks with normal milk and then spend the next 3 hours on the toilet with brutal cramps. People with allergies still deserve to live a normal life not having to disclose their medical conditions every time in hopes of the server being kind enough to actually

If someone has an allergy it needs to be made in the back with separate materials and that’s the case in many kitchens, it’s your responsibility to say you have an allergy instead of just saying “oh no gluten products thx”

As someone with a severe peanut allergy, I’ve learned that it is much easier and safer to just avoid places that it is very easy to cross contaminate ingredients like a place like this. And if you do want to take the risk, you need to make it super clear and even if you do if your allergy is that severe just avoid. Ethan is right in saying that it is better to avoid

When I used to work at Starbucks, it drove me nuts when people would say "I'm deathly allergic to almonds/etc!" I did the best on my end, but if someone had a reaction, it wouldn't be my fault. The responsibility is on you if you have that severe of an allergy.

So it’s actually his fault , he didn’t specify it was an allergy and the receipt did show there was no peanuts. It’s his responsibility to express if there is an allergy, how severe it is and then make a decision if it’s worth the risk. These girls did their job , he didn’t do his. as a dunkin employee, we have specific cleaning measures that we do when someone with a nut allergy comes in. we clean our hands wear gloves and clean all spoons, wands, etc that are used to before hand. however we don’t do this UNLESS you specify you have an allergy. i’m sure they would have cleaned whatever equipment they needed if they were told beforehand!!!! this is insane

@@samanthaM7119i agree with you and it´s not the same thing, for instance i always ask to have my smoothies without ginger not because i´m allergic, just because i don´t like it, once i ordered a smoothie without ginger and the employee came with the drink and told me he had forgotten and he put it in anyways and he asked me if i was allergic and wanted another one, asking for a component of a drink or food to be taken out doesn´t always mean you are allergic, the guy should have told them beforehand how important it was to not have peanuts in the drink

ethans take on allergies is dead on and I say that as an anaphylactic girl myself!! i have gone into anaphylaxis for touching stuff in the past and I could not imagine ordering a drink, that originally had nuts, without specifying that I don't want the nuts BC of allergies. THAT completely changes things. esp the process the employees follow. poor kid but the dad should've specified!!!!!!

Just a little info as a smoothie barista for a popular chain, There is two blenders, color coded, one for regular and one for any smoothie with peanut butter that is bright orange. It is assumed if you are removing peanut butter even if they don’t mention the allergy to be extra careful but if you are THAT allergic please make it clear and please be aware that we could do everything right and there still might be a chance for cross contamination as at every location we work at the peanut butter and almonds are left open on the smoothie start table at all times. We can do everything right, use fresh fruit from new containers, sanitizer the blender with a special solution first, but the peanut butter will always be open about 5 feet away. I’m not saying people with allergies should never get smoothies, but I know how easy accidents happen and i’d literally cry myself to sleep everyday if I knew I made someone have a reaction for something out of my control.

Yea I worked at movita, if you say you have a nut allergy it is taken seriously, as I’m sure it is a robeks, but if you just say “no Pb” it’s assumed it’s not that big of a deal you just don’t want PB in your drink. There are signs to let barista know if you have a nut allergy, because even if you order a mango smoothie, there could be tiny trace amounts of pB from an older drink

I was coming to the comments to say exactly this. As someone who used to work in food service, we do as much as we can to avoid cross contamination but ultimately we can't guarantee you won't have a reaction if you are that allergic to it.

But he’s the one that failed to inform the establishment that the peanut exclusion was because of an allergy. Also most people with allergies or parents with kids with allergies wouldn’t even trust a place like that due to cross contamination. I think he got tired of parenting, because he clearly lives an unhappy life and forgot to mention the allergy. The anger he had been holding in was too much for him and finally had an excuse to let it out and who to let it out on.

I think his issue would have been not declaring it was for someone with a strong peanut allergy. The notice I think covers them for trace amounts of cross contamination, not actually putting in peanuts when they were requested to not be in the smoothie

The thing is he order a peanut smoothie with no peanut butter even if they excluded peanut butter other ingredients in it may have contained peanuts. If he expressed it was for someone with a peanut allergy they A) probably would have suggested something else to him and B) properly sterilized everything before using it. Instead to them it just was a preference to not have peanut butter in it. So really he’s to blame for his sons allergic reaction. Also his son is 17 I believe so you’re telling me within 17 years you haven’t learned to be thorough and safe when ordering out for your kid?

I grew up with a severe peanut allergy, cross contamination was a real issue and something my mom taught me to always be aware of. This guy is not setting a responsible example of how to deal with his allergy... it is too risky to go to smoothie places where they make smoothies peanut butter, not worth the risk. I used to avoid smoothie places altogether because of the risk.... Either way, this guy is handling it terribly; i can understand how he could be frustrated, worried, etc. but this type of reaction serves no purpose and like I said is setting a very bad example for his kid. These workers probably don't have much experience with food allergies, and it is corporates job to educate them, so it is just useless for him to get mad at them.

I used to work at Smoothie King and I was lead for 2 years, I have dealt with many men like this. I always said it isn’t worth fighting back unless they threw their smoothie at me like this guy did. Which is where I think this man crossed the line. These smoothie shops to keep the doors open need to sell hundreds of drinks a day, and nearly all of them are completely customized from a single recipe. If you don’t start your order with an allergy note expect that risk, because they have completely different blenders specifically for fruit, tree nut, and peanut allergy. Everything else is made using the same bowls which could have oils and allergens even after wash. Nobody is going to know preference from allergy, you run the risk by not being specific in a fast service industry. If he had covered his bases he easily could have tried to sue but he likely knew the only person who could bully was the low income worker who made it.

Even if they had not actually put peanut butter in the shake, since he did not specify an allergy they were probably using a blender that was potentially cross contaminated with at least one molecule of the allergen from peanut product. When you specify an allergy they are supposed to ensure the tools they use are properly sanitized before they prepare it to prevent the chances of allergens being present on a surface the food comes into contact with. They aren’t liable for this issue. And he even threw his only evidence back at them. He could’ve saved the smoothie and called corporate, and then sued them and claimed he did specify an allergy.

One other thing to consider about this situation: the girl who he threw the smoothie at was on the news, and she said that his order was a peanut smoothie (without the peanut butter). If that’s what it was, I don’t see how the staff would have known it was for someone with a peanut allergy without him explaining that. The three smoothies on the menu that have PB in them are “800lb Gorilla”, “P-Nut Power Plus”, and “Nuts About Protein”.

I don’t know, I’m simply sharing what the girl who was there claimed. Also I realized I had accidentally typed peanut butter smoothie, I think it’s supposed to be just peanut smoothie, which maybe means he wanted a protein shake.

@@Jrl1002 I got curious and looked up the menu. There are 3 smoothies that had Peanut butter in them. The 800lb Gorilla, P-Nut Power Plus, and Nuts About Protein. The first two use soy milk, the last uses coffee, and they all use Whey powder. A peanut allergy doesn’t necessarily mean you’re allergic to soy milk too but it’s possible. Or maybe there was something in the whey powder. But yeah, if you order a smoothie called Nuts About Protein, I would never guess you have a peanut allergy unless you tell me. And in that case I would double check that nothing else in the ingredient list could have traces of nuts.

One time my family and I went out to dinner. My brother is severely allergic to peanuts so my parents asked what foods contained peanuts so my brother didn’t eat it. The lo mein was said to be peanut free so my brother grabbed a plate. Turns out it did have peanut oil in it. What did my parents do? They calmly asked what was in the noodles and the chef listed off ingredients. When he realized what happened he apologized profusely as we were gathering our belongings to take my brother to the dr. My parents never raised their voices, never were rude because they understand it is a risk when eating out and just needed to confirm that this was from peanuts. Now when we go there the chef makes my brother his own noodles. This is how to handle the situation correctly.

I feel like the kid came into contact with the peanuts via cross contamination, meaning the employee did their job by not adding peanuts to the drink and the dad messed up by not specifying there was an allergy, which would require the drink to be made totally separate to anything that has come in contact with peanuts in the past

i have a food allergy (not a life threatening one) and you just have to realize that you can’t trust other people to cater to your needs. the only person you can trust is yourself. which i understand is a sucky situation but it’s better than getting sick/having a life threatening reaction. these girls obviously didn’t do that on purpose, he didn’t note the life threatening allergy, and when you go to places like that the risk of cross contamination is so high and you’d be better of making your own smoothie. how he reacted was so inappropriate and wrong. he deserves what he got and i love the aspect of social media bringing these sort of events in to the publics eye resulting in these people having consequences. you can not degrade, be racist, and try to assault teenage girls and have no consequences. what if he had got through that door? how terrifying would it be to be these young girls and this guy is trying to come at you and do god knows what? he should have been with his son in his time of need and reporting this incident to management should have been an after thought. it is absolute bull to “not be racist” and to say racist things. absolutely disgusting.

I work at a coffee shack (drive thru only) and we’re often alone for hours at a time in the morning and for the last hour before closing. we also have drinks with peanut butter and they have a separate blender but cross-contamination is likely. I’d be so terrified if something like this happened to me and I was alone.

I've had severe nut allergies my entire life, and have been rushed to the ER after eating something after I had done all the right things (told servers about allergies and ordered seemingly safe food). I would NEVER blame the people in the kitchen or working for that mistake! If my parents had done that when I was a kid, they would've had to go back to a LOT of restaurants and smoothie places. Irresponsible parenting, and absolutely should not have gone back or reacted the way he did. Should have called corporate if he was looking for compensation - works every time.

Definitely not saying what he did was in anyway justified. But I feel like you have every right to be angry if you SPECIALLY tell them you have an allergy and you still get a reaction by having something cross contaminated (whatever it was to cause you a reaction), the person who made the food (knowing you had an allergy) is definitely at fault. I work at a custard shop with a bunch of different toppings including nuts or other common allergy foods (we sell something similar to DQ blizzards so a lot of times some toppings can end up in a different spot and we don’t clean the mixer after every single mix) and there are many methods to making sure it is as safe for the customer. It is part of our food handling license to know about this stuff. Him saying “no nuts” instead of saying “the person you are making this for has a severe allergy” is completely different tho and he had no reason to literally throw it at them and say racist remarks.

@@Lobos222 1. It's not reliable to just trust every customer is going to always tell you what their diet restrictions are. Plus, there are numerous instances where mistakes are made, or people are making group orders and don't know everyone's medical history. There's so many places where communication can break down, or mistakes can happen that trying to force all food businesses to hold all the liability of making sure they know every diet of every person who ever eats anything from their business is insane. 2. This shop did have signs posted warning about potential for cross contamination, as required by law. The guy KNEW from their menu that the drink he ordered his son typically comes with peanuts! We can and should always strive to make things safe for the general public, but in a situation like this, there is no reason why this man should not take some individual accountability for the fact that he didn't ensure he wasn't feeding his child poison. And actually, in some places in the US, his failure is extreme enough to be labeled as criminal neglect towards a dependent.

I worked in retail while in high school and I had my fair share of crazy customers. I can attest that this type of situation is traumatizing and anxiety inducing. I feel bad for these kids just trying to make a buck and getting treated like that. I hope they know this was not their fault no matter how they reacted.

For the last 5 years my husband and I have owned 2 small donut shops in our town. Over the past 2 years people have gotten increasingly mean and aggressive. I used to work the front of house at our restaurants almost every day and I’ve had men AND women yell at me, threaten me, get in my face... I’ve cried many times in our walk in fridge.... we actually recently sold them because we just can’t do it anymore. People really need to stop and think about how they’re treating others. No one deserves to be treated like this while just trying to do their job. My anxiety got so bad near the end because every day I would worry about whether or not someone was going to freak out at me over a long wait time or something. Leave your servers BIG tips guys. They need it. Even people who work behind the counter. You might think they’re not doing a whole lot but I promise you they are. And they’re having to put up with people like this. Treat your servers well. Leave good tips.

They didn't put PB in the smoothie, it was cross contamination because they obviously blend all the sht together. You need to specify if you have an allergy because employees need to use new and clean equipment

I worked at a Dairy Queen for years in HS and it was the most anxiety inducing thing to make allergen free orders. Since smooths guy didn’t specify it’s an allergen there’s no way they’d know to be extra vigilant. Even if he did, no one can guarantee it’ll be completely safe and neither could that Jamba Juice.

Ethan, they didn't put peanuts in the smoothie. He didn't state the allergy so they used the normal blender which was cross contaminated with peanut butter instead of the one for people with allergies. You need to state severe allergies when ordering food incase cross contamination is possible.

I worked at juice it up at 3 years. Looking at the equipment and aprons this store looks like it could be a juice it up as well. I’ve seen people talking about color coated blenders but my store in particular didn’t have this system to prevent allergic reactions. We just promoted very thorough blender washing. But we also had stickers all over the glass of the store front saying we could never 100% promise that our smoothies wouldn’t contain peanut or other allergens. Long story short I would always ask if it was allergy related or preference when asked to take out an ingredient. Also if the dad ordered a peanut butter drink without PB and didn’t specify allergy it’s so easy for the employee to forget when they make that same smoothie 100 times a day. It was an accident that the father made into a headline. He deserves everything he got.

Nah I have multiple food allergies and tread the world with extreme caution. People make mistakes when they’re in work mode. You go into flow state. If you want care taken when they make your order you have to make it very very explicitly clear you have a SEVERE allergy. Only then would it be their fault. Even then it’s still a risk

I feel like customers don’t realize that when you’re allergic to something, it’s not enough to just say “hey no peanuts in that one” you need to tell them that there is an allergy involved so that they can make sure no nuts even come into contact with anything for that smoothie

As a food service employee, if you have an allergy especially a severe one you have to specify that so that we can sanitize the equipment before your order because the same equipment is gonna be used for everything. Even so we can't guarantee no cross contamination when we're using allergens in the same area. This guy should really know this by now if his son is that allergic. If I were him I wouldn't even be ordering food for my son in a facility that uses peanuts. That's just how it is unfortunately and most people with severe allergies will tell u this.

You can be charged with assault for causing apprehension of harm: if you are holding a gun while yelling at someone, that can be assault, even if you never point it or fire. So how in earth is this not assault? Not only that, it’s prima facia battery: 1: he threw a smoothie 2: he intended the smoothie to hit an employee 3: the contact was offensive (most battery statutes say harmful or offensive, not both) 4: the girl felt the contact as offensive.

I worked at Jamba, if you say "X smoothie without peanut butter" any employee can make the smoothie, but if you specify that you have an allergy, no matter the allergy/allergen, a manager or higher ranking employee will make that smoothie with fresh, uncontaminated ingredients from the back and freshly washed, separated utensils.

If you have a child that has an allergy severe enough that they have to be rushed to the hospital if they come into contact with whatever ingredient, you have to know better than to buy them something from a place that uses that ingredient bc there is ALWAYS a chance of cross contamination.

My best friend has a peanut allergy and she NEVER orders anything that originally had peanuts and always specifies she is highly allergic. It’s not worth the risk, even if they don’t put the peanuts in they might use the same equipment with traces left over.

Right? Him, as a father, should be extremely clear and specify his child’s allergy, rather than just simply saying “no peanut butter”. You can’t just assume that these teenage girls will somehow know the seriousness of getting the order wrong. You can’t rely on ANY fast food joint to get your order right 😂 so you definitely have to be hyper vigilant and specify that you have a serious allergy. Either way, it wasn’t intentional! This guy is a serious threat to the public, with that level of rage. He’s clearly mentally unstable

As someone whos worked the service industry theres procedures we have to take based on what the customer tells us. "No peanuts" is a prefrance, so that means we wont clean our utensils or change gloves. "I have a peanut allergy-" This means we wash EVERYTHING and change gloves. He never told them of the allergy so he whole heartedly deserved what he got, not his son tho but his dad did not specify. I feel like this is a thing of cross contamination.
