The main issue I have with patents is that it puts exactly your amazing idea in full-description into the hands of people that know how to produce it, so if the patent office guys is getting a kickback from the massive manufacturers in China then he just tells them the latest hottest idea...they create a bogus prior-art patent real quick and now you have nothing, you just gave it to them for free...you even paid them! But if your idea is junk they wont say a word, they take your money for a patent and pay their bills. The best way to do this is get a small group of private investors to go in and get the thing made, then right before it gets off the boat run your patent, get ahead of the game.

My Fears exactly - AI just makes this more scary ! ! Imagine a truly BIZARRO idea that is AMASING - if AI claims it came up with it - people will think "This idea is bizarro and could have only been created by AI - they would never believe that a person, who is not even in the industry, could come up with it spontaneously. EXAMPLE: I have never taken a class or any training in sailing a boat, never even been on a sailboat, but I designed a toy sailboat that tacks on it's own and sails UPWIND without any power source or controls. I also created the most efficient centrifugal pump ever made and I have ZERO PUMP EXPERIENCE OR TRAINING above that of an average handyman. This is a truly human ability that AI has not reached yet! scary stuff. I used to call Patents - the "Early Warning System" for corporations ... they just toddle down to the patent office and pick up a few new ideas to "Previously Develop". Harold

I am not sure I get it right. How can they overwrite your PPA with a prior art? Does it not protect your invention from such tricks? If this is possible, what is the best route if I want to manufacture the product myself (from China)?

Absolutely the best content on inventions, licensing, and provisional patent applications! I've been developing a process to make a material that I believe can be used for many applications. I have found prior art in an expired patent. The patent was for a specific application in the medical industry. I have produced and tested the material in a few applications and it works well. I will be manufacturing a simple product with this material myself after I file a PPA. I do believe there are many applications that I could license this material for. Do I need to file a PPA for each application? I will be using your SmartIP for my PPA.

Depends on your strategy. If you would like to have multiple patents pending you could do them separately. If not, you can combine them all. They will be probably be separated later through an office action once you file your non-Provisional the application. I am not a patent attorney. I am not giving legal advice.

Thanks Steve for such an excellent video. I have also invented a product that solves a basic problem in a particular industry. I tried to submit the idea to a company with non disclosure agreement. The company will not accept ideas without a patent pending status. I don't have a lot of money. I do have a couple of questions though. Can or should I hire a law firm to do a patent search? Should I hire a company to do technical drawings. I all ready have a prototype built from different items configured to make the prototype to work. After watching your video, I am actually going to build the finished product. Thanks to years in manufacturing, it is not a stretch.

I typically don’t file for Trademarks. Companies usually determined the names they want to use. But I have filed for Trademarks and have received 13 of them. It’s not that difficult.

That's a good point about being broad in the description of workarounds. Let's say you created an invention that uses a physics principle but it could be achieved in 2 different implementations of that physics principle. Instead of filing 2 different patents, you could file a patent that describes the use of the output of the physics principle instead of describing how you implemented the physics principle. Is that the point?

OMG!!! I'm blown away! I am almost late for an apt because I couldn't stop watching haha! I'm at the PPA level after 6 months of intense work and R & D, I'm so excited as it seems I'm doing everything right. I think I heard you mention a PPA Template or am I dreaming? I don't think I saw a link but either way, would you be kind enough to send me where I should go to start writing my PPA if I understood correctly? I thought that if you filed a new PPA then that starts the 1 year clock over? You seem to suggest here that basically you can amend an already submitted PPA and retain the date. I'm sure I've seen other invent right videos that say you can't amend? I'm confused.

You cannot amend a PPA. But you can bring them all together before the year is up. When you file a new provisional patent application with clock starts over. I’m not a patent attorney I’m not giving legal advice.

I applied for a patent, which was rejected, but the application is published by USPTO. However, as I understand it, the PPA is never published, so if you abandon it there is no public record. So, it sounds like once you file the PPA, the clock starts ticking.

Use broad language. That means I assume to employ words such as for a runner track that holds another item that moves in it you would not state any particular shape for that track as that would limit your Patent and someone else could redesign and swipe your idea!?

The first point was answered in this or similar videos - PPA is valuable as you will have a year to fine tune and potentially combine multiple PPAs into a single non provisional application. It will also give you time to make your prototypes, market test, and do other validations before you spend big $$$ on the real one. So that should answer your second point - no you don't need to wait to do your prototype. If your idea isn't viable you have arguably wasted your time with the PPA, but it's up to you to decide if you want to do it early. It could turn out your idea doesn't work, and that is totally ok, you can file anyway.

i just had a utility provisional appl. under 35 usc 111 (b) file on july 26, 2024 is this wording (utility prov. appl.) correct or should it say (utility prov. pat. appl.) and the company that i am working with said that after (3 mos) of reaching out to companies that they will shelf my product by i would at that time have (9 mos.) left and i am not ready to file a (non-prov. patent) so can i refile my (prov. appl) to add another year.

With provisional there is not event a patent search done! so what good is it if 90% of searches are rejected and you find out a year later you just wasted your time. Pat attorneys persuade you to go this route just to make more money.

Don't bother with the provisional drafting program they have. Finished writing one up and found out it is set up to submit to the old EFS system a week after they took it down. I'm not good with computers, the patent office isn't very helpful for us little people, local counsel used to give one an hour pro bono, now they won't talk to me or take my money. Been trying everything for weeks, change to pdf, abstract over 150 words, it just keep bouncing back at me.

What do I do if I want to create something that is super simple? I can make one in my garage in 10 mins? 2 materials used. Just a simple idea for a problem certain people have. Do I get an expensive patent that’ll eat the costs where I’d end up paying for creating my design? I may not make the money back for the patent just because the audience isn’t for everyone…

Why does not putting manufacturing in make the patent not have value? How can you indicate that how its manufactured is irrelivant? Like for a chair, it could be hand made, 3d printed, moulded, or made with a robot. It could be made with hard wood, soft wood, metal or plastic. It could have wheels, be ergonomic, have an adjustible incline. If you hold the patent that says its hand made of oak, couldnt someone just come along and say "well mine is birch"?

Over 97% of all patents are absolutely worthless. Those patents are basically just concepts. If you cannot make your invention, efficiently, cost-effectively, it’s not worth anything.

Always include workarounds,variations to create your invention.Steal it from yourself. It’s the best protection. Put that information in your patent application. I highly recommend you watch more videos.. These are great questions, but you can find the answers another videos.
