Being so uncooperative is not very wise. From objectionable to combative, you can hear “Matthew’s” escalating and narcissistic self saving busha and he sounds like a whining drunk. Those are two very patient, professional officers. I greatly admire them both. They are working on behalf of all innocent people who are hurt by drunk drivers and my friends and family have been among past victims. They don’t belong on the road. Thank you Officers.

The story on this arrest is that the investigation is still ongoing... 🤦🏼♂️ All the evidence needed for a successful prosecution has already been collected, yet they are still investigating? Let’s hope this isn’t a white wash waiting to happen.

Is it really coercion for the officer to tell him if he refused testing he'd be arrested? Because they always seem to do that if/when someone refuses a breath test. Or that you'll lose your license for a year if you refuse testing.

You usually can refuse a field sobriety test or roadside breath test with no direct consequence, except they arrest you anyway. An official breathalyzer test or blood test, depending on jurisdiction, is mandatory and comes with penalties for refusal.

@@LouieNJ It depends on if you refused the does-count-in-court breath tests, based on jurisdiction, if that comes with a punishment. They SHOULD drop it all but I’ve watched some court cases where the initial charges are dismissed and the defendant is still fighting secondary penalties, incurred while not cooperating with the first charge. So wasted time is best case scenario, and it depends on the prosecutor to which your case is assigned, as well as the politics of their office. So you can’t assume, and everyone should get a lawyer.

@@LouieNJ And on sober people failing: it’s less about deciding if you are intoxicated and more about gathering evidence to support their assessment. I’ve heard that if you aren’t over the limit on the breath test but you’ve taken fst’s, you’ve made it harder for your lawyer in court. But the breath (or blood) tests, even the field one which isn’t valid in court, are much less subjective than the fst’s; challenges to any of those are based on the accuracy and/or calibration and maintenance of the equipment, and the certification of the person running it. Fst’s, for the record, are as much about your ability to listen to and follow complicated instructions as about the actual steps. The difficulty for even sober people to do the steps is just why it makes it harder in court, because it makes errors they can tick off on the list. And the conversational stuff when they approach your car is a big test too. Do you seem impaired? is as important as Did you just come from a bar? in the actual arrest decision.

Cop says "no special treatment" .......but......1st I've seen where the police drive the car to private property to save the tow and then give a ride home to the passenger!! As a society we constantly are saying don't drive impaired, don't drive distracted yet if you pull over to answer the phone, text, or have an intense conversation you get stopped. This guy make a responsible decision to pull over to talk, now if they were making out or extremely intoxicated, I would agree with the law on this but they were not. Laws should be made to protect not harass or impede. Not all drunk drivers are impaired. This guy did not seem incapable of driving home safely. We need to start focusing on reckless drivers off the streets, not all drivers.

@@eliot3010 believe it or not, people have rights, even when they have been drinking! You need a better understanding on the process of law. The judge granted LoPresti's motion to dismiss the case for lack of probable cause; PC is the totality of the facts or evidence that would lead a reasonable person to believe that a crime has been or will be committed and the person arrested is involved in that crime. You cannot arrest someone solely based on the smell of alcohol. If the driver had been driving and serving in and out of his lane, an officer could initiate a traffic stop, which is considered RAS, enough to investigate. Most times, the evidence of the driving and possibly the slurred speech or a person is enough to arrest someone on the suspicion that a crime might have been committed. That would be enough for solid evidence to charge someone based upon the BAC level!

@@TheConstitutionalGuardian so the officer was supposed to ignore the fact that the vehicle had flashing lights on the side of a high-speed Highway which created a potential hazard for Lane three traffic and everyone else on the highway distracted by the lights, because he was not totally off the highway and completely onto the shoulder, the tires were sitting on the white line or further to the left into Lane 3 where somebody could have rear-ended the vehicle and killed everybody at the high speeds they were going, we're supposed to ignore the fact that he moved his vehicle forward when he saw the officer, ignore the fact that he refused to stop the vehicle when the officer asked him to do so, and I think when he moved the vehicle yet again. All of those actions only combined with the strong smell of odor coming from the driver constituted more than sufficient probable cause! This officer was protecting every driveway on that busy highway and the people in the parked vehicle itself. I certainly hope the driver who does not know the law or care about it or care about others on the highway (constituents?) doesn't get re-elected and you get reassigned. And if it is truly the law that this driving drunk conduct is allowed which clearly endangers the lives of other drivers and passengers, HI might consider changing it.

@@barbarabeard6017 You're missing the point; the driver parked, or pulled over on the side of the road illegally is a parking violation, not a moving violation. Those actions are not part of a probable cause arrest for a DUI; hence why the judge threw out the case. You cannot arrest someone on the smell of alcohol alone; it is not a strong case. Cases have been won based solely on the smell of alcohol, but most get thrown out if you have a really good lawyer.

The cop is saying that he is not doing them extra favor because of their status but he will do them a favor by having another officer park their vehicle out on a parking lot of a private commercial business. Would he/they do the same to a regular person they arrested? I don't think so. I believe he and his lieutenant they should be counseled and re-trained on their behaviour of giving special treatment to a drunk Congressman and his wife. It's as simple as that.

When you have to explained the situation multiple times and he's still asking the same f-ing question , would absolutely infuriate me. There are so many options to get home now why people still drink and drive baffles me.

I didn't listen to the whole video but they'll usually edit out personal information like phone numbers, addresses and names of family and friends. Also if there is a ongoing investigation or court case they'll often edit out information pertaining to the case.

I think the police officer should have warned Mr. LoPresti that he would be placed under arrest if he didn't take the field sobriety test before letting him turn it down and arresting him.

Yes, that is the least the officer could have done. Most ridiculous thing I have ever heard that answering the question of the consequences of saying either yes or no would be coercion. He is not leading him to say yes or no by giving him the results of BOTH answers, just information in making his own decision. How hard is it to give unbiased facts: Yes = take the tests, drive on if found to be sober or if can't correctly complete then get taken to station for further blood-alcohol tests, car gets impounded... No = taken to station to do blood-alcohol test anyway and court case with extra charge of refusal to take the tests, sometimes losing your license for a longer period of time (or whatever)? If he knows he probably drank too much, then the no option would be handled better by a lawyer at court time? I think people should know their personal limit if they are driving (1 drink?) or get a ride home!

@@islandgal500 this is Hawaii, it may be some law they have down there, each state is different. I'm sure we have some weird laws in WI that people don't have in other states.

@@Casinogirl56 I'm sure you are right about rules for different areas. I don't live in the US, but I just don't see the point in having things so complicated that people can't make a decision. There should be a way that instructions are listed so anyone can understand their options. Especially at that point when they are not allowed to have legal advice yet. What works for me is staying out of trouble in the first place. I'm a big sissy and would be very embarrassed.

Yes! I thought I was going blind and deaf after hearing so many of the comments about no special treatment. Also, what’s up with all that audio bleeped out? Surprised they forgot to bleep out the part where his LT asked if the body cam was still running when he explained the favors he was giving this politician. I’m pro good police work, but when will they learn that you treat EVERYONE equally. Show another bodycam video where you gave a regular member of the public a “courtesy ride” and call off a tow after a DWI arrest. Who do you think you’re fooling Hawaii PD?
