All you guys kicking off.. Dont you realise MOST dyno tuners state they WILL NOT be held responsible for any damages/failures while they work on your car? Dont know about HPF's agreements, but thats what majority say! This wasnt anyones fault..

i am a subscriber of HPF. I LOve this Massage .... yes it not his fault, i wish i could have done that when i didn't fit the timing belt correctly, I could have sent him a you-tube massage to my customer saying its not my fault lol

Also who is to say they did not warn him prior to this tunning sessions that his axle is on the way out and the customer just said fuck it and to go ahead and if it breaks to just call him and they will go from there.

There is no warranty on a dyno. If shit breaks the owner replaces. It is usually agreed upon before either by paperwork or a mutual agreement that if something breaks the owner will replace it and the shop is not responsible. Common practice in all tuning shops.

Because HPF has no proof that they handled the car correctly before it broke, They have no proof that they might not have done something to compromise the strength of the axle. If they go to court, HPF's case is totally screwed. The breakage occurred under HPF's watch.

No actually it does work like that. I have milk and cookies under my supervision and they get eaten while I'm sleeping on Christmas Eve doesn't mean Santa is real. Common practice in all auto body/tuning shops is that "we'll do whatever you want how we want, we will make suggestions but not mandatory. However if something breaks because of what were doing by your request and you have not taken all precautions to prevent it, it the owners problem". I study law and worked in a shop for 5 years

For all of those people saying its HPF's fault , I am pretty sure HPF would not try to screw someone over an axle they are very professional about everything they do. And it is common sense to upgrade axles when you decided to make more power. As someone already stated you got to pay to play.

HPF wouldn't need proof, the owner would need proof that what they did directly compromised the axel, and had they not done what they did it would have not broken. Which is impossible to to because if your take 100 2002-2005 M3's, strap a stage 2.5 system to it with stock axels, your gonna see a lot of failures meaning there is no fault on HPF's part, but rather the power is to blame. But you can't sue power, so this has to be dealt with by the owner, and HPF is just sorta stuck in the middle

I have tuned about 6 of my own personal cars between 3 different shops depending on brand and mod, and all 3 shops have a release form before any tuning done. Stating that any and all damages done during tuning session is responsible by customer, due to it is your responsibility to do your research and build your car properly and have the proper supporting mods necessary ie... akels for the torque curve from and larger more aggressive turbo. raxles.com problems solves end of story..

Totally not HPF's fault. The shop did their duty by recommending the axle upgrade, which in reality absolves them from any type of liability. Even if they didn't, common knowledge dictates that an item under twice or thrice the stress for which it was designed may fail. Now, if the customer had zero common sense, was convinced of HPF's total liability and demanded the fix, if I were Chris I'd probably just do it so the customer, albiet wrong, is satisfied and comes back. Just good business.

Obvious the customer stood behind his axels that they would hold up. Hpf are professional enough to tell him to upgrade them before and have known by experiance of these blowing apart. I seriously doubt they would put their customers through this on a regular basis without telling them the risks. And wasting everyones time and money. The customer must of been stubborn IMO.

Not shops fault they tell you what you need to change to support power if costumer says no but still wants the power they go through if something goes it goes on the Customer not shop, if you wanna be cheap thats what you get, getting a car to go fast not only depends on slapping a turbo n turning up boost, you need to build from ground up the first time right if not you still going to end up spending the same amount over time when piece by piece break...

first off, everyone read the description "this is why we recommend upgrading to ...." You recommend something before you actually do it, all customers know full well what needs to be upgraded in order to handle the power. But when people decide "no, lets just see what happens with stock" this happens. Its easy to strap a 1000hp to your car, not so easy to get it to the ground unless you've built your car proper and followed all recommendations and regulations. Then shit like this won't happen.

The car is designed to cope with the standard 340bhp, if you modify it for extra power without strengthen the rest of the car, that's what happens...

It broke under HPF's possesion, in court that means its HPF's responsibility. You have a point but it doesn't work like that in court. After all, If I owned HPF, I would replace the axle free of charge.

you must be a little off, do you think in anywhere in the world you could tune your engine to say 700-1000whp then leave it to the shop to dial the engine in, with stock drivetrain, and if they break it under the tune in, they should then replace it for free? that is simply stupid, think alot of people would starting to go to the tune shops with stock drivetrains just hoping they would break it and replace it with new shiny things..... ;)

I think that is bullshit thinking the shop will pay for that. You are putting more power down so expect things to break that are stock . OR fucken stay at stock power!. I broke both rear axles on my sti that made 440 at the wheels. Grow up pay for it and move on. once you have those and realize it opens up a new driving style you'll be happy.

The fact is the geezer should have known some mechanical parts weren't up for the job. It seems a bit of a cop out. As part of their upgrade packages they should know what needs uprating. Seems to me someone was cutting corners, possibly the owner.

Will HPF sell you a stage 3 kit without upgrading internals? No. So why would they install a kit if they say an upgraded axle is necessary/recommended. They should refuse to install a kit without the axle, because they did install it anyway and broke the axle, they better replace it because it was not required, like upgraded internals would be required. End of story.

Who broke it though? If the risk was that great for damaging an axle with a 2.5 kit. HPF should make it mandatory to have a special axle. If HPF gets sued, they will lose big time, sending more ridicule towards their name.
