Hi, I have a question, what if it the biological father who is the sponsor for three children but has not claimed them on the taxes. Does he do three individual I-864 forms along with the I-864a forms ? Also, he also has 2 other children that he only claimed in taxes that are citizens. Do we include all 5 children plus spouse ?

I read that you only need to include children who are accompaning a principle immigrant or will be coming within 6 months of the initial filing. If the length of time is greater than that then they do not need to be included in the inital affidavit of support for household size calculation.

I am currently working in the US with a TN status work authorization. My wife does not meet the minimum annual income requirement to sponsor me. On the other hand, I make enough on my own to meet this requirement. If I want to add my income to our affidavit of support, I read that I need to provide a "Proof that the intending immigrant’s current employment will continue from the same source if his or her income is being used. what does this mean?

Hi. I am a mom of 7. 6 yrs to 20. They do not live w/ me but i have visitation (80 24hr days per yr) & i get child support. I also Do Not claim them in taxes. It is only my husband & i who live together. Can i use my CS income w/o having to claim my kids as dependents on the affidavit of support? Got an RCFIE saying i dont make enough when i was making less when doing the k1 visa that was approved no problem. If I need to add my kids I will be denied.

Im confused about section 3. If I have separate I-130s for my wife and stepdaughter and dont list them under the "family member" section how do I show them under the 'household' size? both are currently living abroad. if I dont list them I show a household of 2 which should actually be 3.

However, I am still confused due to the following: The Depatment of State Website states that the Householde Size includes: "(4) The sponsor’s children, as defined in section 101(b)(1) of the Act, except those that have: (a) Reached the age of majority (i.e., are at least 18 years old) or liberated under the law of sponsor’s domicile; and (b) Are not claimed as dependents on the sponsor’s most recent Federal income tax return;" As I mentined before my U.S. citizen child was not clamied as a dependant in my most recent tax return as he was born overseas and still resides overseas. Could you please explain why I still need to count my son as a dependent in the Household size section eventhough the aforementioned law states otherwise?

@ it says “and” not included on taxes so they must meet both conditions: be over 18 and not be dependent on taxes. Any children under 18, regardless of their tax status, must be counted.

@@usmaniafidai1141 Hello, that video explains who must fill what - I-864 from each of you - read the definitions in the form instructions and in the video what kinds of relationships qualify for I864 or I864A. Yes you still must show proof that you didn't make enough in a form of taxes or a school transcript if you didn't work at all. There is no difference for K1, the adjustment of status process is the same with exception of filing I130. Hope that helps

Hi everyone, I was married feb 14th 2023 and got my conditional green card in 8 months and it expires feb 2025. I visited my home country on dec 28 2023 and my wife decided to break up while I was in my home country my question is what can I do from my home country as I’m hesitant to get back to USA and I might have 2 more months on my 6 months period outside of the US though I got i131 to stay for up to a year outside USA. Can I still get a US citizenship after we get divorced? When should I get back to US and work on my citizenship process? She haven’t filed for divorce yet but she will soon and I might not be in USA when she files for divorce so is there a way to get citizenship and how long does it take after not being married for three years to get a citizenship? is there hope for citizenship or if i decided to abandon my green card what’s the process and will I be allowed in the US again?
