yeah it's called right of passage , the public has the right to cross the entrance when walking from one pavement to the pavement on the other side of the drive entrance of the corporation, buisness, society, etc etc etc ... the public does not have the right to enter the property and "squat" there and take pictures or video of any/everything the see .

To be fair though, if they had a high IQ they wouldn't have to be security would they? Mind you, I suppose if it was a choice of flipping burgers or strutting about in a uniform trying to dress up like a paramilitary man, I can see why they would choose the latter. And before anyone comments, no, I have nothing against anyone who flips burgers for an existence I've done it myself when I was between jobs and when my own business was going through a quiet time and enjoyed myself immensely.

@@WorksopGimp Some laws do exist. But they aren't that clear. That's because case law to back them up and refine how they are to be applied still need to be created. A few cases have done some work on it. One set out that a corridor in a block of flats was a public place because it was used as a shortcut to go from a train station to a shopping precinct. Another said that a path to a hostel was not a public place because it was only used by residents of the hostel.

What the eff has Article 8 of the human rights got to do with it ? you are standing on private property and as such have NO right to stay and film if the owner or anyone of authority says you must leave , how pretentious are you ,,, how badly are you looking for trouble , do you think that if that guy physically removes you that you have ANY legal recours? you're just looking for trouble so you can claim to be a victim , you have NO valable reason to point your camera at ANY shop, bureau, office, company, factory etc entrance . You're just pointing and waiting for someone to come out so you can start an argument ,,, you do know that in USA people are bieng taken to court where the judge orders psychiatric evaluation and the cameraman is bieng sent to a psychiatric hospital for treatment ... or simply locked up in prison ... @@7king8debs79 They are not permitted to withdraw it, if it is a public right of way. The whole idea behind a PROW is it can't be closed off and the public can't be refused the right to use it (emergency circumstances are an obvious exception).

That's right, but it wasn't a public ROW. It was private property with what's known as a "permissive path". It means trespass law can still be enforced.

@@budgetnuclearweapons7858 If an owner of a permissive path wants to restrict access, it must be done to ALL users of the path. An owner would have NO rights to restrict access to certain groups or people. It's however unlikely that a city centre property would have control over the pavement as it would be considered part of the public highway. Without access to a path, pedestrians would be forced to walk on the roads - as this is clearly dangerous planning permission would not be granted without guarantees of public access rights.

So long as discrimination legislation is complied with, it rests entirely at the land owner or occupier's (or anyone acting under their authority) discretion. Its not a "right" so you can include or exclude whoever you want.

A member of the public is not responsible for the security of a private building. It is up to the business owners to secure their building. A member of the public is under no obligation to consider the feeling or security concerns of any staff member or security guard employed by a private business.

@@MrAndrewFarrow there has to be implied public access and no signage saying private property etc. Tresspass is a civil matter and it requires a court order to remove you, but the landowner can indeed use reasonable force to remove you. The problem is that the area may have implied public access and therefore the landowner needs to remove the access to you and then they can ask you to leave. Use of reasonable force by the landowner may constitute an assault and discrimination claims (if applicable) could also be made.

@@blobrana8515 you’re getting a bit confused. It does NOT need a court order. Some organisations such as Councils, get a Civil Court Order because it is a criminal offence to breach one. Being public bodies they don’t like to get involved in a punch up. But Common Law is clear and has been since 1189; a landowner may use reasonable force when necessary to remove you. Any implied right of access can be revoked, as here, by telling him. You give an implied right of access by having a gate and a letter box. As soon as you see TV Licensing and say “go away” that implied right is gone. Use of REASONABLE force CANNOT be assault. If you so much as raise a hand the other way that’s assault, possibly with aggravating factors as he was carrying out a lawful activity. If he takes a piece of 4 by 2 and beats you to a pulp; THAT may well be illegal.

It depends what you are doing. If you decided to spray paint the place they may be able to arrest you until the police arrive. But just standing there with a camera in a place that has 24 hour public, freely given access, certainly not.

It is not against the law to photograph or film anything or anyone from a place with public access. Tresspass is a civil matter so unless there is a breach of the peace or some other criminal offence being committed they have no powers to remove you other though the courts. Threats by the security guard to forcefully take a camera is grounds for dismissal. A security guard has no right to stop a member of the public going about their lawful business.

A reception desk in a private building is concidered as accessible by the public. Photography is allowed in a public place or in a place with implied public access. There were no signs or barriers that forbade access to that area; therefore the public can access that area. A court order is required to restrict access to an individual. Ie you are not aware of all the facts. The auditor was allowed by law to be where he was.

No there does not have to be a sign or closed gate , There is a common law right to refuse entry to whom he/her chooses, provided the refusal is not on grounds of sex, race, disability, gender, sexual orientation and religion or belief. Being refused actual entry to premises is a simple extension of the right of refusal to serve. thats totally legal look it up instead of trying to defend YOUR belief

It has nothing to do with my beliefs. That is the law. You are perhaps confusing the right of a shop to refuse service to anyone; this is about trespass. Tresspass is a civil matter and requires a court order to remove someone from a property. It could also be argued that the public crossing implies that anyone has access to this area and that a court would perhaps rule in favour of the tresspasser.

You do know that 99.99% of CCTV is never watched by anyone , literally all of them record on a hard drive and are only consulted if there has been a crime to see if there is proof . and after a certain time the images, video is deleted and recorded over. But some stranger who refuses to identify himself (usually hiding his face with mask, glasses, hat or hoodie) pointing his camera purposefully at someone elses property is highly suspicious , he could be preparing a crime , he could be stalking his next victim , he could be employed by someone to gather information about someone or about the company. NEVER has ANY citizen had a problem filming in public NEVER has the security come out and stopped a tourist from filming as he walks down the street,,,,,, but suddenly a certain number of lazy jobless brits have decided to copy the american sovtards trying to get revenge on the society that took their driving licience by annoying ordinare hardworking people 'cos they're jealous 'cos they can still drive ....

I was born in Bristol 68 years ago. It was somewhere near St George's park and our house was bought for 'slum' clearance where the council knocked down a couple of streets, then did nothing with the land and years later made it a park (Gaunts ham). How lucky was I that my late Father rejoined the army and we were posted to Germany and I grew up in the countryside there, and all our other postings. I went back once and was horrified at how loud and busy and *dirty* the place was. I now have settled in the flat, clean and peaceful Fens.

Section 33 of the criminal justice act 1972. All land including public land that's been delagated public access allows the same rights that the public have on any public street.

I believe he is technically correct when he says he is an agent of so he can perform certain duties as laid out by the people who pay his wages BUT he is wrong because he himself cannot do what he is threatening to do in regard to doing you for trespassing.

That security guard needs to learn the law especially when it comes to rights of way. If he had tried to obstruct your use on any public right of way he would be committing a criminal offense for causing an obstruction. Use of public rights of way is protected under the law. The security has zero authority and no protection in law to obstruct anyone.

I love watching these things because it is usually two people spouting the law at each other, neither of whom are lawyers, with little idea of how to actually apply it....or just talking bollocks, quite often. In this case the first security bloke was remarkably knowledgeable in what he was saying and he was kind of right that he does have the right to; (a) As the servant or agent of the land owner, ask you to leave their private property. and, (b) Use a reasonable level of force to remove you from his property if you don't leave, and your legal action wouldn't get very far if he did. What I question is their claim that the crossing and the footpath each side is private property. I would bet my bollocks that it is either public land, (and I notice that the footprint of the building didn't overhang it), or, under the planning consent granted when the building was built it has effectively been made so and they will have consented to it as part of the planning application. It is unquestionably a public right of way and as such I would suggest that you have all the same rights as you would have were it public land and that includes filming and photography. As to filming into their underground car park.....when do I laugh? Even if you were technically, at that point, on their private land, there is the principle of "De minimis non curat lex" or to put it in layman's terms.....the law shall not concern itself with trifles.

Security guards should be trained to never go out into public right of way locations to interact with members of the public, they are employed and empowered to patrol the private areas where the public are ‘*NOT*’ allowed to go. Because if they venture outside the only thing they are going to do is to put the company that they work for at risk. If you want to control the area in-front of your property put up fences and signs to clarify the demarcation of boundaries. [Put up a Boundary line and stay behind it.]

PCA - I need to mention again....Neither a landowner, nor anyone else, can trespass anyone!.....Only a trespasser can trespass! This is use of English language in UK. I believe that because of the influence of some illiterate yank auditors, who believe landowners "trespass" trespassers, some UK auditors also believe this. Landowners, or their agents or representatives, merely ask or tell trespassers to leave private property (or forcibly eject them if necessary). They do NOT, and CANNOT, "trespass" them.

Look at the lay out of that street, according to these two, Pedestrians are supposed to cross the road in order to progress along that footpath because to continue walking on that side of the road, they would have to enter private property. No way was planning permission granted for that building if it took away a public footpath and handed the land over to a private concern. Utter BS and nothing more than this company trying to assert control over land they do not own.
