I wouldn't even live in a subdivision at all personally. I know some people have no real choice because of the areas they live in, but I myself will just stick to my log house sitting dead center of my 1600 acre farm. I like being able to walk out on my back porch butt naked and taking my morning piss without some crybaby snowflake trying to fine me or call the cop's on me. HOA's are nothing but a way for people to steal money from people to put in their own pockets. The money doesn't go back into the community at all. If someone buys a piece of property and house in any type of area, I believe it's their's to do whatever they please with. Nobody should be able to tell someone what color they have to have, what vehicles you can park in your driveway, or how often you should mow your lawn. But also nobody should EVER buy a house in a neighborhood where they have to agree to bullshit rules like these. It's ridiculous for HOA's to even exist and ridiculous that someone would agree to live in such a neighborhood.

They tried this crap in my community. The HOA said “No Trucks”. So my lawyer sent them a letter asking did it mean No Box Trucks, No Hand Trucks etc. After the letter was sent I bought a 1976 ford pinto and painted in with 12 different spray paint colors. I parked that in my driveway. A week later my lawyer called me and said they were going to allow modern trucks because they are now considered family vehicles and they were amending the docs to reflect commercial trucks only.

The best way to get back at a HOA is to take it over. Get other neighbors to get involved, run for the HOA board, go to meetings, get the rules changed. Most of these are run by busy bodies on a power trip. Take it away from them. Also, get very familiar with the rules, as many board members and their friends will have minor violations that get "overlooked".

Some insight on how I have seen one HOA get taken over from the power hungry types. Most homeowners can’t be bothered to attend the meeting when the election is held. So those who were doing the takeover went around the neighborhood collecting proxy ballots from those who didn’t care to attend but were supportive of a change in the board. The number of proxies exceeded the number of people seated in attendance, so the win was guaranteed. This is the way to do it.

Yep. Eventually moved out of that neighborhood to acreage in a rural area, but I got fines for working on a car in my garage. Not running a business, but just doing a brake job and some oil changes. Only way to fix it is to get involved.

I once talked with the president of a Home Owners Association because they had short-changed their webmaster. The webmaster had then edited the HOA’s website with a repeating gif of all the HOA members driving off a cliff in a pickup truck followed by a message wishing them luck moving forward. They had to buy a new domain name and rebuild the whole website from scratch.

@DATAPUSHER I have lived here for more than 20 years. I helped get the HOA dissolved. There are no rules against my exhaust here. She was able to get me for a parking ticket because of parking across the sidewalk that goes through my driveway, and that is a city ordinance. I was completely guilty of that but also keep in mind the sidewalk in front of my house goes nowhere... it dead ends. So anybody that walks on it has to turn around and go back. I have been parking my cars there for 20 years, doesn't mean it was right but once again it wasn't hurting anyone either. She found me doing something wrong and used it.

Difference is a private business vs a government body (since the HOA can fine, I believe they're considered a government body, otherwise they wouldn't have powers to give fines nor collect upon them but someone with legal knowledge please correct me if I am wrong). A government body MUST accept any US currency, including pennies. Please don't listen to the random legal wannabe's in the comments. The official Federal Reserve .gov website has a section on this exact case. The current phrasing as of Section 31 U.S.C. 5103 is: "United States coins and currency [including Federal Reserve notes and circulating notes of Federal Reserve Banks and national banks] are legal tender for all debts, public charges, taxes, and dues." This is clearly interpreted by both the Federal Reserve and a multitude of case law as quote: "a valid and legal offer of payment for debts when tendered to a creditor" Keyword being offer. There is no Federal Statute requiring any business accept your method of payment, regardless of circumstance. The section only states that they "can accept" said Legal Tender, but are under no legal obligation to do so. Usually when you try the classic "pay a fine in all pennies", you will simply be instructed to return with a more reasonable sum, and it has been upheld time and time again that that is a valid reason to deny it. This is a far too frequent misconception, and Bill is entirely correct in this case, as deserving of it he may be.

Your ex was quite stupid to accept that payment or simply didn't bother her as much as you thought it would. All she has to do is take the coins to the bank and they will count and deposit it in her account, so no big deal really.

Heck, I remember how infuriating it was, the one time I only had like 700 bucks in change and both banks I use, told me it had to be rolled. It's particularly stupid, since they have machines that can deal with it a thousand times faster than one can roll it!

Some banks will take both, depends on the location. If you want the cash right a way, it usually needs to be rolled because they can weigh the rolls easily enough in the back and know if they are correct. If you have bank account with them and just want the coins deposited, it won't matter whether it's wrapped or loose because they will send it to the main bank with the machines to count the loose change. i feel your pain. i grew up poor but was able to built my dream house in hayden colorado, by myself out of milled logs (2.5 year build of nights and weekends). my hoa is particularly evil, they sued the neighbor to the hoa because he was legally living in a trailer while he built his house, they just didn't like to see it when they walked the back trail. they tied him up in court long enough that he gave in. they routinely bully those in the hoa that dont grovel to the president. i have never let them bully anyone without speaking up at every meeting for all their bs. i quickly became their bully target with monthly attacks etc. i finally decided to build a barn and at the meeting to propose my barn, they out right told me that they would never allow me to build anything. at that meeting, the out of control board got violent with me, one put his fist in my face, gritting his teeth, and told me he would "wipe that smug grin off my face" while the whole board screamed and hollered for over an hour. i sat patiently and quietly and let them throw their insults. at the end of that, i prayed God would take us from here. now today, we are selling our house for 1.5 mil and we only spent 250k to build. needless to say, you can't pay me to live in an hoa ever again.

i had a ludicrous experience when looking for my current home. I found a local realtor, we went over what i was looking for, and they put together a list of homes to look at. One thing i specified as being a 100% dealbreaker was having an HOA. The very first house the realtor showed me had an HOA. When i asked why the realtor even bothered to have me look at the house, they had "forgotten" about the HOA. Same story on the 2nd and 3rd house. I dropped that realtor and found another. The 2nd realtor informs me that the other realtor is known for getting kickbacks from the HOA's managing company for steering them potential "problem" homeowners (so they can collect more fines), and that since I'm obviously into cars they saw $$$ if they could get me to move there. fuggin crooks

You obviously never experienced buying a home in modern times, you have a house you are grandfathered into or bought your house 30-40 years ago, congrats. HOA homes are cheaper then non HOA homes, they have cheaper finance options, and hell they are the ones that are actually available in the market for young home buyers. living in a Townhouse is far more economically feasible for young buyers vs a "traditional" home in a nice community.

I had a HOA claim that my car parked in the public street area was a violation. Claimed it was a clean street day. I moved the car because he was getting loud. I checked my door after locking it. My car door opened and something fell off the door. I made damn sure all the doors were locked after that. It turned out the person was a convicted criminal and leaving items in my door so he could open it later at another time. Be careful of who tells you to move your stuff.

My HOA tried to tell me that my high roof work van (brand new, clean, no logos) was an “oversized vehicle” and not allowed. Little did they know, they didn’t have a definition of oversized vehicle. And the nearest jurisdiction defining it (state of Colorado) defined it as a semi truck essentially. I contested it in writing and in person and they conceded - but told me to remove my ladders (of which there was no rule about). I did, begrudgingly, but wasn’t worth taking them to court over. Meanwhile, numerous neighbors have larger full-size trucks than my van who were never hassled. Since the incident, they sent a legal addendum to all the homeowners defining vehicle sizes. If this has ever happened in your community, they have zero jurisdiction unless it was clearly defined when you signed the HOA papers when you moved in. Do not let them bully you!

Although I tried to make it right, the HOA put me in a position where I had to miss my child's funeral. But they do good work and we need rules to live by, so I paid all my fines on time.
