Until then, I don't think it's crazy to go with "if it quacks like a duck" and assume the worst about KZbin. Personally, I'm not completely sold either direction, but whether this was specifically a case of KZbin abusing their power to censor and influence for political reasons or not, it's something KZbin's absolutely been observed doing before. They haven't done squat to earn any trust and they've done plenty to destroy it. YMMV.

The only part of law I am intimately familiar with is the Safe Harbor Protection act that KZbin tries to fall under. Essentially, the act stipulated that Platforms are not liable for the content distributed using the Platform. For example, if someone uploads a copyrighted show or song, KZbin cannot be sued for it, only the uploader can. This is because Platforms can't or don't have knowledge of what is on their Platform. You cannot be liable for something you have no knowledge of, and the Platform is so vast, that this is a reasonable thing to say. However, Safe Harbor Protection Act doesn't apply to Publishers, because by definition, they have knowledge of what they are Publishing. KZbin is trying to have it's cake and eat it too. It says that it cannot be liable for illegal or malicious acts performed on their Platform because they can't possibly know what's on there, while at the same time, dictating what can and cannot be on the site, saying that they *do* know what is and isn't on the site.

I had a new found appreciation for how complicated the English language is after working with a Dominican supervisor. I realized after speaking with him that most languages when spoken are pretty direct and state things as fact where as English, we tend to use similes and metaphors regularly to a point where a non native speaker, even if they know English, has no idea what the hell we're talking about.

It works the other way, too. Speaking a foreign language, I had to he very careful not to literally translate an America ism. Not only would it not be understood, it would frequently be misunderstood, leading to embarrassment for all, but especially for me.

They were great once, but the infiltration of these platforms by big corporations and celebrities trying to control what was organically grown by normal people has ruined everything. Money is a wonderful thing, but I'm under the impression that money horribly corrupted these platforms and destroyed the user-enjoyment they once had.

Google did nothing good for KZbin. I'm not even talking about moderation policy or algorithmic ranking anything like that, I mean the tech itself. All they did was remove features, over and over again. It's like going from a 3 monitor gaming rig with a stream deck and a sound mixer, to a 90's Macintosh with a one button mouse. It's like they're actually trying as hard as they can to kill it, but everyone is infuriatingly convinced that they have to be on here because that's what everyone else uses. Just like me I guess.

It's not the money. I think that the moment the platform grows, the owner of the platform suddenly realize they have great influence over the users, and then they are reminded of the quote: "With great power comes great responsibility...bility...lity....ty......" and so they force themselves into a moral conundrum, which they resolve by checking the smart people over at the academy about their thoughts of morals, and they learn the beautiful, sensual and all-mighty embrace of ideologies like (but not limited to) Critical Race Theory, Queer Theory, Feministic Theory, etc.

I was permenantly banned from Twitter. 13 years and a 1-strike system. I can agree that I was wrong in my comment on a video (a young white punk harrassed and punched an orthodox Jew). My comment was "why is everyone watching and video recording... the dude needs his arse beat." They felt that was targeted harassment. No warning... just a permenant ban. Very upsetting. Tried to appeal twice and twice I was told "no."

KZbin's business is selling ad space on content. Creators sign a contract (in the form of the ToS; terms proffered, terms accepted), then they provide content for KZbin, and receive an agreed upon portion of the profits on those ad sales. That makes creators KZbin's subcontractors. So, if youTube unilaterally changes the contract, or refuses to honor it based on vague reasons, they're in breach, and can be sued. Liable for damages, loss of earnings, loss of future earnings. Right? Why not?

Unfortunately it doesn't work that way. Part of the TOS is that KZbin can change them however and whenever they want. So they can hide behind that a lot.. Second KZbin (Alphabet) is a multi-hundred billion dollar international entity with deep political ties & many other similar entities with similar interests to have the law interpreted in ways favorable to them. So they tend to just win.

"We may change this Agreement, for example, (1) to reflect changes to our Service or how we do business - for example, when we add new products or features or remove old ones, (2) for legal, regulatory, or security reasons, or (3) to prevent abuse or harm" They also openly state that use of the service is subject to Community Guidelines. Which also mentions that they are "regularly updated" aka changed. You were correct I had not actually read the TOS however I've been around long enough to know all of these big media sights include crap like we can change the rules and if you don't like it leave.

I would like to see an amendment similar to a 14th that applies to monopolies and potentially other significant companies that can exercise significant power that resembles tyranny. No Monopoly shall make or enforce any policy which shall abridge the privileges or immunities of citizens of the United States; nor shall any Monopoly deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its service or employ the equal protection of policies and law. It may need work to address the “what about”s. However, I prefer this over offering them protections that they hide behind.

What about the whole KZbin Partner Program thing? A partner in business is usually a part-owner of the business, but youtube seems to strategically mix in the term creator, and gives creators/partners basically none of the rights a partner typically would have. How is that a binding partner agreement, that's mutually beneficial, when you don't get any of the standard partner benefits? It's much more like a contractor relationship than a partnership.

New Texas Law which essentially forbids censorship by large social media companies b/c they are essentially a public utility, b/c of recent ruling is on its way to the US Supreme Court. All of Rekieta’s subs & members being denied access to content they’re entitled to may provide Rekieta Law a cause of action against YT & any other social media company that censors or bans content as well as for shutting down a channel..!

I don't think it'd be desirable or even fix the problem to treat websites as common carriers, but all the services that a website relies on to exist like hosting, domain registrars, payment processors, DDoS protection etc. could be common carriers because that's where the coercion to censor usually comes from, and they usually don't even know what their own customers are using them to host pretty similarly to phone calls.

Note that the United States Court of Appeals for the Fifth Circuit (Texas) recently upheld the constitutionality of Texas' law prohibiting content-based discrimination on social media platforms. Time for us all to incorporate in TEXAS!

They can just claim another reason. You can't legally compel a company to carry content they believe (sincerely or not) is damaging their business by for example alienating advertisers.

If they are determined to function as utilities, they are NOT free to censor content any more than the phone companies are, or the electric companies. Second, they maintain legal liability protection, as 'neutral platforms,' under Section 230 but, in moderating content, function as 'publishers' and are, therefore, NOT 'neutral platforns.' So, you are wrong. Companies, when providing near monopoly services in the public interest, MAY be compelled to accommodate that which they disapprove. We will have to see what the Supreme Court rules when the conflict between the 5th and 11th Circuits is resolved.

16:26 Nick section 230 actually has provisions of services that forums and social media platforms are supposed to provide. it's piggybacked on the Telecommunications Act of 1986 which covers Bulletin Board Systems. No judge whose ruled on a case involving Section 230 has actually read the law in Question, even though these Social media companies violate section 230, No judge wants to rule against them.

The last statement/solution by Nick has one hole: SHADOWBANNING ... which is "breaking the EVERYONE GETS TREATED THE SAME clause", but which is NEARLY IMPOSSIBLE TO PROVE and might even be PART OF THE ALGORITHM! The THEORY needs to always be compared to the REALITY ... when coming up with solutions, which is why many ideologies/-gists show themselves to be WRONG/BAD by only ever CLAIMING things but never PROVING things.

Lawyers haven't sued big tech because of Section 230 protection...not what the actual statute says, but how it's interpreted.
