ICC prosecutor urges commitment to international criminal justice

The prosecutor of the International Criminal Court (ICC), Karim Khan, emphasised the importance of upholding the rule of law and stated that every human life should be valued equally while briefing UN Security Council members on the situation in Libya.
He announced at the UN Security Council on Tuesday that the investigative stage of the legal proceedings into alleged war crimes in Libya is expected to conclude by the end of 2025, transitioning into the judicial stage.
Khan urged the international community to seize this moment to renew commitment to international criminal justice.
“If a cause could unite this Council, naively perhaps, but I believed and hoped it would be the cause of international criminal justice,” he said.
“Which state is in favour of genocide, war crimes or crimes against humanity? Which state doesn't want to be a protector of the vulnerable? Which state does not want to be on the side of legality and against the kinds of violations that we see in so many parts of the world?”

The ICC isn't a court of "the world," it's a court of a limited set of countries that have agreed by mutual consent to create it and to give it jurisdiction. Neither Israel nor the United States is among those countries. So, yes, outside those countries, they have to ask, and the answer will certainly be "no."

See United States Code, Title 22, Chapter 81, Subchapter II. "The President is authorized to use all means necessary and appropriate to bring about the release of any person described in subsection (b) who is being detained or imprisoned by, on behalf of, or at the request of the International Criminal Court." The people this covers include US officials and officials of non-consenting allies, such as Israel. "All means necessary and appropriate" is understood to include military action if needed, which is why this law is commonly called the "Hague Invasion Act" in the US.

The integrity of the ICC is indeed on trial. Will they have the integrity to recognize that their jurisdiction is limited to the parties of the Rome Statute, or will they arrogantly try to claim power over the sovereign states that have legitimately rejected them? If they do the latter, they could find themselves on the sharp end of sanctions, or even military force, as those states exercise their legitimate right to protect their officials against unlawful kidnapping abroad.
