As a loan officer in public bank, the cancellation of loan after signing letter offer will be RM2k. However like sean said, i would suggest you to inform your bank about the false advertising done by agent and seller and try to get the cancellation fee waived

Actually many advertisements in property portals are misrepresented too! Sometimes i wonder if there is any law to catch all these culprits. Unfortunately its getting blatant nowadays. Not all but there are a lot.

Erm, it's an unfortunate truth that there will always be such behaviours as the qualification to be an agent is rather easy. It has improved tremendously now where agents are required to be registered but no penalties are imposed or enforced for their 'bad' behaviours. Anyway, thanks for sharing Kelvin=)

Just to add, if you decide to abort the sale, you can sue both agent and seller to:- 1.claim back all monies paid to seller / agent 2. recover all wasted costs including penalty by the bank n all losses arising from the misrepresentations. 3. Legal costs (may not be full). 4. Your current lawyer should be able to advise you unless your lawyer do not do litigation matter. Don't let this unscrupulous agent to commit fraud to earn commission. He is the agent of the seller. You can sue both n chances on recovery is good.

shud also beware those agent advertised with property guru,my experience was this joker advertised the property said to be in old klang road,when called up he inform me the actual area is in Seremban,asked why states as old klang road,his answer-you need to go thru old klang road to reach Seremban......hope property guru will screen so it wouldn't be abused

This case consider the agent wilfully misrepresented the material info about the property (leasehold and bumi lot)which could affect the buyers decision on whether to buy the property or not. In this case, I believe that the deposit would not be forfeited, and the buyer can complaint to bovaea, and claim any such losses from the agent or sellers...

It is fraud because the agent knew. At 100k below market many other potential buyers must have checked out the house and found out it was lease hold and inform the agent.

After paying RM 2k, if the house is sold after that, the price difference before renew and after renewal shall be split with the state government. But it makes a lot of sense for own-stay:) Thanks for sharing
