Yes we are I can’t thank you guys enough! You guys came out to the Zombie shootout at the Aurora sportsman club in 2018 or before with several suppressed ARs and let me run the range with it! It was an experience I’ll never forget because we don’t get this stuff here and never have. I tell everyone about it and just really have wanted to say thank you!

Suppressors are not just devices affixed to firearms. There are also INTEGRALLY SUPPRESSED FIREARMS which have that feature built in - therefore the state is attempting to ban a class of firearms. Therefore the burden is on the government to prove that a ban is supported by the text of the 2nd Amendment. AND THIS IS IMPOSSIBLE.

I’m from Illinois and I’m having a difficult time trying to figure out why they want to ban suppressors. If it’s not a firearm why are they banned ?

They’ve been banned in Illinois for decades. We came close to fixing it legislatively in 2015-16, but didn’t get it across the finish line. We had an anti-gun lobbyist at the time tell tell a legislator in a meeting that they opposed it because they don’t like guns, but they didn’t know why they didn’t like suppressors. That’s about all you need to know about anti-suppressor opposition.

Because they are scared, black people in Chicago will use suppressors to assassinate people on the streets.

They just pretty much ban all NFA items in the state. Keep in mind that this is a state that has an assault weapon ban so extensive that basically any semi-auto rifle is off limits now.

@@kenofken9458you’re absolutely right that the gun laws in Illinois are draconian. The overreach is massive. We wouldn’t stand a chance changing the law in Springfield right now, but we do have a good chance in court.

It was the courts to which I refer. At much of the appellate and certainly the state supreme court, gun politics very much mirrors the General Assembly and governor. I don't know if the federal Seventh Circuit will be much more welcoming. I think at the 10th Circuit appeals level, they ruled silencers are not "bearable arms" and thus not entitled to 2A protection. The Supreme Court refused to hear the case, although that was before they had done Bruen. People have this idea the Bruen just magically invalidates all gun laws on the books, but that's nowhere near the case. The nature of such rulings leaves 500 questions for every firm answer. There's a lot to yet be answered about "dangerous and unusual weapons" doctrine and a host of other matters.

Suppressors are, by legislative definition, "weapons," thus "Arms," in 720 ILCS 5/24-1.a.6: "(a) A person commits the offense of unlawful use of weapons when he knowingly: ... (6) Possesses any device or attachment of any kind designed, used or intended for use in silencing the report of any firearm;"

People should be able to buy a suppressor without any government regulation. Texas passed a law that states if a suppressor is manufactured in Texas, a Texan can buy one unregulated as long as the suppressor stays in Texas.

Why doesn't any sue the local and state authority for damages related to hearing loss? Wouldn't firearms owners be able to claim standing and sue the government for not allowing them to protect their hearing. The Karen Safety-ists are always complaining that things are not safe enough.

Heller, is even worst for them as now they have clearly made it an arms ban case. As the ATF has clearly stated firearms with attached suppressors are in common use. That should be the end of the discussion!

Agreed, it's a sad state that it takes a lawsuit to decide a simple question. That said, we're very confident in our arguments and fully expect to win!

Thanks for taking this up on our behalf, it’s been far too long. I’m curious though because on the state level we have people arguing these are arms and protected by the second and at the federal level the argument against the ATF/NFA is that they aren’t arms and therefore don’t fall under either. At what point do these arguments collide or are we looking at an ouroboros.

You're absolutely right - it has been far too long. Ultimately, Congress and state legislatures can regulate whatever they want however they want if what they're regulating is not protected. When it comes to suppressors, which are classified as firearms under federal law and are only regulated because of their use with firearms, Second Amendment protections should absolutely apply; however, those protections are largely ignored - hence eight state level bans. That's what we're getting after in the lawsuit. Protections from the Second Amendment apply to suppressors thus you cannot ban their ownership, possession, and use.

Suppressors are needed to reduce hunting pressure on the ecosystem for non targeted game. Similar to NZ where they are required.

Yeah, it's kind of funny that in many countries, suppressors are either required or heavily encouraged. They're considered "polite" to use. Here in IL, our politicians base their knowledge of suppressors off of Tom Cruise movies.
