@@rossmanngroup Louis, I always respect (and mostly agree) with your opinions but I believe you are wrong here. When the initial supply of a product is so limited (like newly release video game consoles or tickets to live concerts/sporting events), a malicious 3rd party middleman can interject themselves between the producer & consumer by purchasing large quantities of said product for the purpose of inflated re-sales (e.g. - Ticket Scalping). The Cybertruck would definitely qualify as a product that is both "highly in-demand" and "extremely limited in supply". As such, it would be reasonable to view this fine as "anti-scalper" & thus actually = a rare example of a "pro consumer" policy in today's economy.

They sign to get the exclusive early access. It's a gross marketing ploy, but not as wrong as today's sponsor. Aside: Why is anyone waiting for a cyber truck? If you ever read the TOS on software you bought, you'll find that you have no recourse whether the software works or not, whether it destroys your computer, collects & sells all your private data, or anything else. It's perfectly legal to sell a product that not only doesn't work, but causes you to lose everything you possess; so I reckon if those are the legal rules we are supposed to follow, then screw 'em: GO PIRATES!

I've seen one in the flesh here in Europe on a demonstration display. Looked cool, but that front will never get through the basic certification process here. That front end is one big razorblade for pedestrians. On the other hand I like the balls of Tesla to say "screw it" and just build the thing.

If the purpose of the no-sale agreement was to prevent scalping, they would have specified that you cannot sell the vehicle for more than your purchased it for, and possibly given an even longer time frame than a year. That would be reasonable. That solves the problem. Eliminate the profit, and you eliminate the scalping. Louis is absolutely right about their motivations.

@@Frank_inSA I get what you're saying. And I would have agreed with you prior to 2019. But having seen what happened to the video card market when scalping ramped up, I think it's reasonable to have controls in place to prevent it. Allowing scalping does nothing productive. It allows people with a lot of money to get people with less money to give them more money for absolutely no value. That is not good for society. That is just exploitation. It's another way for the rich to get richer while life gets more expensive for the vast majority of people.

They will offer to buy it back. It's in the terms of the agreement signed when the buyer bought that horrible parody of a motor vehicle. The agreement states that the buyer needs to inform them that they do not want the vehicle anymore and provide Tesla with enough time to decide whether to buy back the vehicle from the buyer or to "allow" them to sell their vehicle to a third party. There's a bunch of language in the agreement that allows them to drop the price (based on the condition of the vehicle) in their favor to low ball the offer as well. I can only hope there will be enough people rich enough to drag this agreement through court to see if this nonsense really allows a company to force you to waive your rights as a consumer or not.

Hmm , funny as a young bloke I worked in work shop with 20 other mechanics servicing and turning cars the old way before we had computers , points , plugs , carburettors, the whole bit , for many years after that I drove big rigs and heavy machinery, I’m retired now, and I probably had way way more of the dreaded carcinogenic particles going up my nostrils than most people …. But I live ! I’d be far far more afraid of being near an electric car on fire and breathing in 15 seconds of cooking highly toxic battery smoke .

If the goal was to eliminate scalping, then the contract would say "You can't sell it for more than you paid for it." or "You can't sell it for more than we do." or something like that. This contract says you can't sell it full stop. And they won't buy it back from you either. At this point they're just seeing how far they can shaft people and still get away with it.

That's not what the contract says, it says you agree not to sell it within the first year and that under Tesla's discretion and certain conditions they may buy it back from you. It's a contract by signing it you agree to the terms within when you buy it. If you don't agree then you are free not to sign it and buy something else. No one is twisting your arm to buy it in the first place

That's going to be the case with every company and they are going to extend it just like how you used to actually own the things you bought and be able to use it how you wanted after you paid for it, but companies pushed the envelope a little at a time and no one did anything and the sad thing is it's continuing to happen because of that attitude, because no matter what there are going to be people that buy it and unless there are actual repercussions then the companies aren't going to stop these practices.

Always respect Louis' opinions, but this will be the first time I will have to disagree & say that he's wrong. This fine is necessary to prevent scalpers from buying up the entire stock of a limited supply product (like PS5's on initial release or in-demand Ticketmaster concert tickets). The issue here SPECIFICALLY is that the initial stock of the product in question is so limited that the supply can be effectively cut off from the consumer by malicious scalpers. As such, this is a PRO consumer policy. Louis' reaction is entirely understandable given how consumers are being treated in virtually every other case, but is ultimately wrong here as he is failing to see how "anti-scalper" policies are actually pro-consumer.

This is why I didn't buy a TV last time I needed one, I instead purchased a tuner off Aliexpress for 30 dollars and plugged that into my monitor and a set of external speakers... if works just as good and if I want a bigger screen I just plug it into a bigger monitor or a projector. No smart tv features ftw, no network connection, just a device to plug my antennae into and watch free to air TV only

Tesla, like most big businesses, have a deep connection TO government. So many subsidies and government contracts. End ALL subsidies. End ALL government support for ALL companies. End NEARLY ALL barriers of entry to get into fields (unfair licensing requirements, regulations that hurt the little guy upstart at the benefit of the established blob corporations, etc) and watch how fast all this garbage reverses when REAL competition can grow once again without government interference.

People like you and me are no longer their target market, genuinely rich people are. In today’s world if we stop buying the product they will just transition to sell the product to someone else and then if they can’t they will get government bailouts. Supply and demand doesn’t really apply in its traditional sense to the car market, mainly because of government intervention and regulations.

Or just get rid of a TV with a camera or microphone and get one without. You'll save a ton of money and get a much better TV for the same price(usually significantly less) from TCL or Hisense in the same price bracket. TCL and Hisense don't have any microphones or cameras on their TV's(although some have one on the remote). However, you can always buy a cheaper Roku or Google TV remote(depending on the model) without a microphone on Amazon.

@@worldspam5682 I stopped getting those since I use nordvpn (which sometimes is a frag) and blocked mic usage to most of the apps incl. shitbook, messenger, I dont use chrome on the phone at all. One cannot isolate itself totally, but you can feel yourself a bit safer and private. There are various guides that help you through this, but I can tell you for the first time it will be frustrating and nerve wrecking, and it is worth it, go for it.

I will take an LG television over a Samsung television - after seeing your sponsor so many times, I decided to go to my Samsung TV's settings to see if it has something similar. It actually has something WORSE than LG's. LG's TVs have a "Don't Sell My Info" toggle, so you can just turn it off. Samsung does NOT have a toggle. They have a *Request* Button. It's just a button that says, "Don't Sell My Personal Information," and when you click it, it says "Request Sent." It does not tell you if your data will stop being sold.

Ford did this with the GT some years ago. MSRP was about 500k. You had to be chosen by Ford themselves to even buy the car. As part of the buying contract, you couldn't sell it within the first year of ownership to discourage flipping.

I hear what you're saying but it's a double edged sword... The parasitic companies couldn't profit by themselves, so they rely on the parasitic media, parasitic advertisements, and just general materialist propaganda. Yes we physically have the ability to hear these things and not do/buy them, but the fact remains that they are constantly bombarding us with information that is harmful to ourselves, to the point where it is impossible to avoid completely. Again I agree with what you're saying but the problem is still at an institutional level, where the companies and government are justifying indoctrination with these ideals as Free Market and Free Speech. The cultivation of children to be consumerist cogs is the most offensive part of the equation to me.

There are TV's out there now that won't let you use them until you register the TV with the manufacture. (Westinghouse, and I'm sure there are others now) Stay away from those. As for the manufacture not letting you sell, modify, or repair something you own.. I fully agree that this needs to stop. Just like the newer cars tracking your data and driving habits and selling that to insurance companies without your consent. Or how about those dealers that are installing GPS trackers without consent. The list goes on... Until manufactures see consumers stop buying their products, they won't stop these stunts. Sadly, there are too many manufactures doing it these days.

Ferrari has done this as well, and I believe ford also with their GT cars. Edit, ok, I see you mentioned ford with the lightening, but i believe ford told customers they weren’t allowed to sell their car back all the way from 2008 with the limited edition ford gt40 they made, and did it again with the next GT as well. Ferrari has been known to sue famous people for having their Ferrari wrapped in pink etc, because it wasn’t looking good, and on some super rare cars they would also not allow customers to resell their cars. They also have a policy on many of their cars where you can only buy a Ferrari if you already own a Ferrari etc etc, and so yeah I imagine they’d want to lock down the resellers to keep that exclusivity. Sorry for the rant, but the point is.. u,m actually, Tesla isn’t the first company to do this, it has been going on for at least 14 years, not with all a company’s cars, but for those new release, small batch ones.

Ferrari getting on people's case for changing the color of their cars is just another example of the company putting their branding above all else, as Louis touched on in the handbags into wallets video posted prior to this one. It is the same reason that Windows has become so uncustomizable. Even though it is your PC that you paid for, it has to "look like Windows," whatever that is at that particular moment. Even if you are one of the many people who find white backgrounds intolerable, you had to put up with it, because Microsoft's branding concerns are more important than you actually being able to comfortably use the PC you paid for. That has been somewhat alleviated with the dark theme in more recent Windows versions, but it doesn't work for everything, and not everyone who wants to avoid retinal pain wants to go all the way to a dark color scheme. It used to be that a consumer product was meant to serve the needs of the consumer. The money was made by making that consumer happy. Now we have consumer items that are meant to keep serving the manufacturer even after they change ownership.

Home builders do this, too. When they sell a new home, they record a performance trust deed on the house title that prevents the owner from renting out or selling the house in the first year. This to prevent competition against the builder while the builder still has more homes to sell.

A serious problem with the auto industry is resellers always trying to flip limited production or long wait-list vehicles. In this case long wait-list. This is a good incentive to dissuade those parties that order 20 of them so they can resell them, or auction them, over the MSRP for the period that people are willing to pay it.

Always respect Louis' opinions, but this will be the first time I will have to disagree & say that he's wrong. This fine is necessary to prevent scalpers from buying up the entire stock of a limited supply product (like PS5's on initial release or in-demand Ticketmaster concert tickets). The issue here SPECIFICALLY is that the initial stock of the product in question is so limited that the supply can be effectively cut off from the consumer by malicious scalpers. As such, this is a PRO consumer policy. Louis' reaction is entirely understandable given how consumers are being treated in virtually every other case, but is ultimately wrong here as he is failing to see how this "anti-scalper" policy is actually pro-consumer.

@@matthewobrien5925 Ooooor, just let the market solve it. PS and luxury, yes, luxury cars are not a necessity. Scalpers can't do much when the market is not willing to pay more for early access. Scalping works for concert tickets, because its a limited time opportunity. With items like cars, consoles, games, physical goods, all you need to do is wait for the next releases, and have the scalpers stuck with items they can't resell (happened to PS scalpers). This is 101% not in place to deal with scalpers. IF, and this is a big IF. Cars were in limited supply, then sure. But they are not. You have plenty of choice on buying a car in most countries. This limitation of resell, is literally just in place to prevent a second hand market that bypasses the original producer.

No. As to how the policy goes too far. It affects individual consumers too much. A fee for reselling more than one car would be more reasonable, and would stop any one entity from buying up and then reselling the multiple cars. This is also a problem of what cars are, cars should be a luxury commodity, instead in North America they're a necessity. If they weren't the price would be more fixed according to demand.

I looked it up, and it says Tesla has indeed implemented a $50,000 penalty for reselling Cybertruck within the first year of ownership. This clause is included in the purchase agreement to prevent early reselling or "flipping" of the vehicle for profit due to its high demand and limited initial availability. If an owner needs to sell their Cybertruck within the first year for an unforeseen reason, they must get written consent from Tesla, who might choose to buy back the vehicle or allow the sale under specific conditions

Not saying that contract is legit or no, but in Norway (one of the biggest EV markets) people were buying the cars and selling them even before it was delivered to the new owner.. This was done especially in front of tax change ... So even the advertising platforms for ads has made it obligatory that you have taken delivery of the car and the car is in your title/name..

Can't remember the last time I got a smart television and refuse to do so. Be amazed how often people will throw out large quality HD flatscreens. Got all of mine for the cost of just taking it off thier hands. Though this crap modern companies pull is absolutely ridiculous.

This has been going on for decades. Manufacturing employees can get discounts that are cheaper than what dealers pay for the cars. Limiting the number of cars bought per year and not being able to resell for a year has been going on since at least the 1970s. My dad worked at Ford and he had friends at both GM and Chrysler. They all had this restriction. Not supporting it, just saying things like this aren't new.

Bro. Thank you for your public service. Although I'm European, I too feel this is happening here. When you buy a new car you can't use it until you accept terms and conditions that make you wave away your right to privacy. These companies are worldwide conglomerates and they just adjust slightly to each market. Unfortunately only a few like yourself are aware and put in the effort to help us fight back. Keep up the great work.

Things like this are common in the exotic car market too, it's both to prevent people from turning right around and finding a buyer for more, but also preventing people from knowing sale prices in case it's significantly lower than the dealers want to charge.

Ferrari does this but they also don't sell those particular vehicles to the general public. That said there's a huge difference between a Ferrari Portofino and a Daytona SP3. Ferrari doesn't care if you get rid of your Portofino after a few months of ownership. There is nothing exotic or fancy or even rare about a tesla. It's a giant overpriced turd with depreciation rates that make BMWs looking like an investment.

@GHOSTSTARSCREAM i can make a car in limited numbers for $5 that doesn't mean its mass produced. and yes people have waited on waitlists for yrs for one. As of April 2024, Tesla's website lists the expected delivery time for new Cybertruck orders as 2025, including the all-wheel drive version and the Cyberbeast. However, as of January 2024, some say that new orders are being scheduled for 2027 due to a slow production timeline. In December 2023, Wall Street analysts estimated that Tesla could produce 48,500 Cybertrucks in 2024 and 78,000-230,000 in 2025.

@GHOSTSTARSCREAM Someone who is homeless and no income cannot afford the pricetag of a cyber truck, so it's not affordable to everyone. Second point, even if you have the money you cannot go out right now and buy a cyber truck, that is why they have a wait list.

Why are politicians not introducing legislation to prevent companies from charging fees which are unrelated to the provision of the good or service? In Australia if a fee structure resembles a fine or is punitive in any way it does not stand. Only statutory authorities permitted to have a fee structure which resembles a fine or a punishment in any way. Bank fees which are deemed to be punitive in nature have been struck down. Banks are a good example here, because they have been found to have fee structures which are totally unrelated to the cost of providing their services, and such fees have also been deemed unenforceable.

Damn. I have an LG C1 as it was the best bang for the buck for image quality at the time. But I noticed it had a ton of agreements and stuff when starting it up. The cybertruck is easily the ugliest car I've ever seen in real life. It's like someone wanted a lambo truck from the PS1 era in real life.

yeah price gouging in sweden is so common people just accept it as "privilige to pay for quality!" (EVs and hybrids in scandinavia can at times doubble in price compare to rest of eu) we even had people be hounded for buying harddrives outside sweden as "engaging in piracy"

I bought a Fairphone, not because I particularly cared about the environmental aspects, or even the repairability, but because the fact that they cared about those things means that they're less likely to be looking for ways to screw me over. But I'd be thrilled if the various anti-consumer things were made illegal. I'm already glad that Europe basically made USB-C the standard. I want places to have to compete by providing the best products at fair prices, not by who's best able to deceive and/or screw over their customers. The sooner I can let my guard down when making a purchase, the better.

People should realize that if a company is publicly traded that the CEO has a duty toake decisions to make the company as profitable as possible. It is basically written in law. Back in the day the dodge brothers sued Henry Ford over not making decisions that would raise profit prices, and the brothers won. Now , obviously there is more to the story than that but the message is basically still "make us stockholders money". So companies are basically incentivized to be as scummy as possible. It is up to regulation to set the ground rules.

If their reason to stop new car owners is to prevent scalpers shouldn't this fine only apply if the owner of this car (try to) sell it for higher than the current MSRP at the current time of sell? If they were doing their agreement like this NO ONE would have a problem with this agreement even if this agreement legally had to be given/apply to the new owner. Nah, let's punish anyone for no reason.

The most popular vehicle among the wealthy is the Ford F-150 because of its multi-purpose practicality and versatility.

Price gauging was bad from dealers but horrible with the private sales. Used Broncos were 30k over msrp, less than 2 years ago.

So sad that its this way now just to make some more money. In Denmark thats called (Købeloven) and its a Buyers Law, its illegal to hide or other ways to add an Xtra money-charge or Fee thats not written in any given Contract and the shop can get a Fine equal to or more of the Xtra (hidden) charge/Fee and the Contract can be Cancelled, if you send something to Repair and the shop cannot fix it when tried 3 times you can cancel your buy and get all of your money back. And Købeloven says that If you buy it, you Own it.

If this were about preventing price gouging, the contract would not bar sales near market value. It would still be a nonsense, anti-consumer, illegal practice. But it would have more plausible deniability compared to them doing the equivalent of just spitting in consumer faces with blatantly obvious lies.

@@youtubasoarus yeah but being one of the first people allowed to buy an extremely limited product is not an inalienable right. So if you want to be first in line you have to agree to their contract. If you don't want to agree to the contract then fine you can still buy a cyber truck You're just not going to be first in line

These companies want to generate hype by limiting the initial release numbers, then also want to limit people reselling them. It's really quite stupid. I don't know who believes this crap. While i'm at it, adding a contract that prohibits resale WHEN YOU BOUGHT THE GOD DAMNED VEHICLE should not be allowed at all. Either they sell the vehicle or they don't. Once the sale is completed the manufacturer loses its right to it because they relinquish ownership at the time of sale.

@@youtubasoarus I might be more amenable to your position if you manage to get the facts correct. You've obviously never worked on ramping a product before. You think you can just switch on all the machines and have max production immediately? There's always going to be a ramp as the production rises to meet the demand and until that point there is going to be pricing issues. Secondly just because someone relinquishes ownership of something doesn't mean they can't still enforce a contract. Goods and services are bought and sold both personally and commercially with all sorts of contracts. It may be your wish that once you own something You can do whatever you want with it but the reality is if you entered into a contract you're going to be bound by it. If companies want to prevent scalping then they have the right to do so, and you have the freedom to choose two or not to enter into that contract

Actually ran into another channel that covered the Adobe thing and when I used the special word describing their mentality the only response I got was about the choice of word and how the descriptive words BEHIND that word seemed more apt (I.E. - forced to accept things they don't want to, not given choice, not allowed to say no) to which I got no response when illuminating I wasn't calling adobe rapists, but that rapist *mentality* is a different thing than the crime itself and is far more publicly widespread and seemingly *accepted* given how people fight against rape but defend rape mentality in business and more.

This is common practice in pretty much any high end or limited production car. Try to buy any limited edition high end brand like a Ferarri and this clause of the contract is the least of your worries. It's not a new thing, to my knowledge these contracts have been around since the 70's.

I would honestly like to know, if this would hold up in court. If it is to stop people scalping, I could see it holding up, but if you're wanting to sell it, because of other circumstances, I could see a court over turning it.

I just checked on my Samsung smart TV and tracking my activity/selling my data was on by default. There are two menus you need to go to to turn tracking off. The first is Settings>all settings>Broadcasting>Data service and then check "do not track". The second is Settings>all settings>general and privacy>terms and privacy> privacy choices> and then check "do not sell or share my personal data". You will then be told that your request will be processed in two weeks.
