The biggest issue with H1B is that it's stated to be for the top 1% or something like that, but there are plenty of middle of the road engineering jobs that Americans could fill that are taken by H1B's. I always assumed they were just hiring for DEI points anyway. The particular mechanism for how that was happening isn't all that important. Get rid of any DEI incentives and let everyone compete on the open market. It has always been my experience that you get what you pay for with engineering. The outsourcing might be a lower price tag, but it comes with a cost. If a company decides that's worth it then that's their business.

The easiest decision as you put it is to hire the person you know. But why do you think that someone you know will work harder and that someone you do not know won’t work as hard? This is simply a bias that every manager has. I would argue it is the managers job to be more objective. You should question whether the son will really work as hard as you assume they will. If you look at the evidences of your past hiring, is it the case?

It's like in numerical analysis. An approximation method without a max or supremum on the error is not useful. In statistics, a confidence interval without a confidence level or a point estimator without an MSE and the Cramér-Rao bound is not useful. A claim without statistics (probably relative or comparative) is. not. meaningful. People like to use LOGIC, but just because something makes sense, doesn't mean it is reality. Reality can have multiple potential explanations.

There’s one issue with your argument. Lots of students including Chinese and Indian students want to stay here long term but realize that the pathways to residency/citizenship are quite unfair to them so they are forced to reconsider when they come here and so, they decide to go home in 5/6 years!

I'm British not American, but I've seen the dangers of these types of visas in the UK. I remember working at a middle sized financial firm and it was merged with another firm and for me it was like "alright not great but I can ride it out and see what happens and move on if it turns to shit". But for my colleagues who were on a H1B-esqe visa it was panic inducing. Those visas are usually provided by contracting firms and if the new leadership decides not on renewing the contract you're screwed. Then if you want to move jobs you have to go through the whole rigamarole of sponsorship etc. Which does depress wages as a major part of the labour market is the ability to go and say to an employer "well this firm says I am worth this". Also, I don't like the idea of you have to stay in the US to get a visa. I am currently considering a PhD over there in comp sci because I am relatively young I would like to bounce around to live and work all over the place. Maybe the solution is make H1B visas into like a 2 year green card if you were fired or want to move jobs. Then the exploitation would reduce.

Is it sunk cost fallacy? They’ve already hired and paid the cost, and they’re compliant with regulations because managers make the minimal effort to prove that they couldn’t find any local talent. The challenge is not being biased/racist in either direction, which I would argue is not possible for a single manager. I think what would help is simply making it even more difficult to hire from abroad sequentially, but still allowing intermittent hires from abroad.

Hey Dimitri Just a heads up. Im a mechanical/Aerospace engineer Not on H1B but on OPT. From europe that lives in america. Im totaly with you about not letting people "train in america" Leave after 2-3 years just so they can bolster their resume. Because that could have gone to someone that wants to live here long term (ppl like me i love the US and want to live here forever) But one of the terms on your student visa, is specifically that your intentions MUST be that you want to be in the US for 2-3 years after graduating and then you get the fuck out. If your intentions are others your visa will get denied at the embassy The current visa system with F1 and H1B literarly dissadvantages people that want to stay here long term. I came here when i was 18 and now im 23. I would shovel shit for a year for a green card. But my only options are to win a 1% lottery, Marry my girlfriend or beg my employer to sponsor me. Which will never happen as its a massive money investment and no one ties you to that company so its a massive liability for them. Im fully with you tho, just some insights from the prespective of an immigrant.

I'd highly recommend reading Lenin's observations on the British Empire. Basically the same thing happened in Europe leading up to WW1. I had to drill down to old turn of the century tomes and the British empire in the 1890s ceased emigration and increased immigration to the point of one decade importing 1 million people in 1 decade. I think France was 2nd and Germany was 3rd. He then looked at the capital and the oligarchs were getting richer while also middle class was slowly decaying. He cited studies and observations by Sir. R Giffen and the "rentiers" and "usurers" greatly benefited from this practice from importing cheaper labor which prevented unions from forming because they all spoke different languages so it was a win-win for big business and rentiers.

The only reason they give F1 student a visa if you say you will return back to your country otherwise they will reject your visa. And the only reason F1 comes to USA is not for education ( because from my experence US education is not very competative compared to India especially STEM )but they come for oppertunities( since there are huge tech oppertunities). And F1 have strict restrictions on work and types of work they can do in USA even with work authorization. And as a F1, they pay about 3-4x the tuition fee in school. Why do you think why F1 take huge loan ( in there country) just to study in USA? If you remove the only oppertunity they can get to gain experience in the field. There will be no F1 students in States. And believe me US benifits alot from international students. And on other hand, F1 student have strict restriction on the work authorization and types of job where US citizens donot have any.And most employer would prefer US citizen or Green card holders. So if there are enough talent to fill the all tech position by US citizen, why US citizens and GC holders donot compete on the job market since they have upperhand on employer preference and they donot have any restriction on where they can work and what types of job they can do?

Another Point to discuss -- If America send back all H1B Engineers back to India ; or Germany may take them and establish German Silicon City ; then what will happen-- all work today being done in Silicon Valley shall be done in German or Indian Silicon City, at less cost to Customer. America's Economy shall be affected. If less Students come to University -- German; French & British Universities are ready. Again it is America who is going to loose. Its like Businessman telling his Customers ; Do not come to Me. OTP is USP of University . H1B expenses should not affect their pay. This is legally something the employer is not allowed to deduct, because in theory they said they needed to do it, therefore it is their cost to get a benefit of getting a qualified candidate. However, the contracting firms cheat people, so there you go...

You suggest us stay long term but the visa officer wants me to give reassurance that i'll leave after studies. Except for 30% of the current h1b talent the rest all jobs can be done by an American. But the culture right now in tech is a rat race and the employees are kept on the edge to outperform to keep their jobs. There are tight deadlines for tall orders on a quarterly basis. Look at the AI wave and how corporates followed suit without knowing its relevance. The best solution is to introduce American talent at every level of the hierarchy in Tech. From Analyst to Directors just so the culture is still balanced out, the decisions made are fair, deadlines are realistic because Americans prefer to have a life after work and not sit with someone sitting across the globe everyday just cos your boss' boss is saving a fortune for the company. Whereas a h1b would do. Note: Many of us are inclined to becoming Americans, have spent a decade here assimilating into this culture, we value freedom, rights, culture, music, etc etc. And never took a single thing for granted but have to wait with everyone else for decades to receive a green card.

Wow man, never thought you would bite that topic, its such a firestorm. Respectfully disagree. I don't see what is wrong with temp workers. H1Bs were trying to help the US see that the programming jobs were too high salary. Too many people went to expensive schools for them. If we looked at the writing on the wall, we could have shipped the jobs and do other things. Personally I am building something and will be shipping maintenance to Africa or India for discount services. AI is making it even cheaper. I don't agree with citizenship though. Those are principles that have been around before recorded history. Nobody should be allowed to be permanent without huge reasons. Edit: The college systems need revamp. MIT needs to educate waaay more people and the amount of time in the schools need to be shorter. Those guys are smart but don't produce nearly what the title suggests.

@johnp9890 a lot of industries rely on illegal immigrants to provide services to all including construction, agriculture, and hospitality. Many work for less than their state's minimum wages. I can tell you living in Texas is much cheaper than living in Washington state where I used to live due to a difference in minimum wage. The higher cost of goods disproportionately impacts middle and lower class families and not the wealthy. Of course the cost of a lot things is going to be lower if you have people working below minimum wage, disregarding environmental legislation and disregarding occupational health regulations. That is what a large part of the economic succes of china is based upon, they can produce cheaper because they do not have to adhere to any of those regulations. But I really do not see how you can argue that that is a model that the west should copy. Absolutely not! There is no "right" for the middle class to partake in the exploitation of people! If the entrepeneurs who use illegal labour can only produce at a competitive rate when they hire people to do the work for them on an illegal, below minimum wage and not paying into any social insurances, then clearly their business model is flawed. The economy should be there to serve the people, not the other way around. That is what I said, if you extend this thought, then slavery would become a viable option again, because the wages in slavery are 0, or just cost and board. Slavery and paying below the minimum wage have one thing in common: they are illegal. Of course you could argue that even working for minimum wage in the USA is slavery, with the cost of living being so high! How can somebody who works for minimum wage afford a mini appartment with prices starting at 1500-2000 dollars a month? They cannot! And you wanna lower their income even more? It is exactly this kind of flawed free market thinking that is killing the middle class in the USA. Because it doesn't stop at the lower class. If the foundation of minimum wage is gong, then pretty soon the wages in the "middle class" will begin to erode, until they too, are lower class, and so on. In the end you have just a couple of billionaires and a huge army of poor struggling people. Just look at southeast asia, where most people do not make more then 200-300 dollars a month, with prices for groceries just as high as in the west. That is not a model worth copying, but that is where the west is heading in the moment.

He means basic values like believing women are equal to men (thus can vote, be in positions of power and you know walk and talk outside of the home), and the basic idea that crimes should be adjudicated before being punished. Also the basic idea that in this country people are in general judged by their skills and qualifications - not by a caste system. (That’s not a dig at any Indians but I personally experienced this from an Indian manager who simply wouldn’t believe my degree was real, she was later fired). The bar is low. The US isn’t even the most developed country these days but you have to remember that a lot of countries do not have functioning institutions and thus people from there don’t have the same basic values and principles as an American or westerner might.
