The shell of article 370 was hollow by many of Presidential orders made before August 5......... Kashmir has defacto UT (not dejure) and has never rejected any proposal of Delhi..... Already by previous orders around 300 article +90subjiects of union list +44 subjects of concurrent list was being implemented in Kashmir before August 5........ Thus on those subjects no consent of assembly was required in the law making

If the state abided by the original thought about uplifting the schedules cast by giving compulsory education and more hygienic life . IThat ground reality I think would have been simplest to bring all upto more equality ! Excuse me I am not an expert but a lay person . When powers are transferred under the president's rule to the parliament the views of assembly doesn't matter. Because president's rule comes itself when there is a violation of the constitution. If that logic stands how will parliament make laws, they will keep waiting for next elections to come and debate to happen.

Not a good interview. There were many points where we could have gained a lot of knowledge from thr guest. One example being him pointing out that Constitution allows for Centre to reorganise states. Mr. Karan Thapar could have asked about his vuews about why is this so, what the founding fathers were thinking when making this point. Mr. Thapar could also have stressed upon more broader themes such as these. These would be exactly in line with CAA and 370. These are basically questions of how much power the centre holds. He could have asked the guest about why he views 370 as not necessary. Mr. Madhav even hinted his excitement to speak on this. Mr. Thapar could have also counterquestioned the guest on Nehru's choice to amend the constitution instead of by-passing it on the basis that even Modi has used it or could have used it. Could have asked y the two must be set up different. This is apart from the insistence on CAA and 370. Those sections were much needed but combined with broader themes, the interview could have informative instead of just doubling down on we(as well as Mr. Thapae) already knew

While I agree with you but then that interview would be for a broader context. Just like you I feel many points or ideas could have been expanded and expressed but I also do understand the point that the interview is to drive home the point that how dangerous is/was the way 370 was amended . The idea that states could be made union territories without state consultation (although Madhav shared that consultation should be taken) is a dangerous trend. In such a scenario there would be no incentive for any state/union territory to make any news. In fact the powers to make local laws would be much reduced. There is so much to be gleaned and understood but this requires a much larger debate by lot of people who understand our constitution and how it came about.

I don't agree with his stance on CAA. If CAA is applied without NPR/NCR ie for future immigration, it discriminates against immigrants, not citizens! Just like u don't apply your own law, constitution, security guarantees, welfare benefits, etc. to population all over the world, u can't apply secularism to people who aren't Indian citizens. There are many valid and genuine reasons to oppose CAA(especially in it's present form), this isn't one, rather it's very idiotic.

I think you missed his point which I found to be pretty interesting is that there is no need to proof that there is religious prosecution. In this way a spy who may be 'a hindu' could come to India and do what he wants. What is the process of vetting, that is not told to people as well. Also remember the whole CAA thing is about pre-2014, not what will happen in the future, somehow people miss that part as well.

Or for e.g. Ahmaydiayas, Hazaras etc. Most important point is how you would know if spies come in the guise of refugees. On the other hand, the stateless people who would be there, there is nothing for them. No other country will take them.
